The Polyphonic Courtroom: Expanding The Possibilities Of Judicial Discourse, Robert Rubinson
The Polyphonic Courtroom: Expanding The Possibilities Of Judicial Discourse, Robert Rubinson
All Faculty Scholarship
This Article draws upon the ideas of Mikhail Bakhtin to critique judicial discourse as embodied in written opinions. Judicial opinions are typically monologues which reject exploration of complex issues of meaning in favor of simply justifying a result. Opinions should instead be part of a continuing dialogue whose hallmark is exploration, not simplification - what the Article characterizes as "polyphonic," Polyphonic opinions should embrace dialogue and complexity and recognize the validity of multiple perspectives. This goal can not simply be willed, however, because cognition by necessity simplifies. To meet this challenges, the Article concludes with recommendations for "judicial calisthenics," including …
The Tintinnabulation Of Bell's Letters, Kenneth Lasson
The Tintinnabulation Of Bell's Letters, Kenneth Lasson
All Faculty Scholarship
It is easy to admire Derrick Bell for the passion of his principles, and to empathize with the pain he feels for his people. Those same emotions, however, are so often conveyed with such rhetorical acrimony that his considerable merits as a role model - as well as his standing as an impartial scholar engaged in objective and well-reasoned analysis - have come to be substantially diminished. Nevertheless Bell's letters have a disturbing resonance, a tintinnabulation that gives many people of good will second thoughts about the quest for equality in America.
Professor Bell certainly has a right to his …

A Comparison Of The Ovulation Method With The Cue Ovulation Predictor In Determining The Fertile Period, Richard J. Fehring
A Comparison Of The Ovulation Method With The Cue Ovulation Predictor In Determining The Fertile Period, Richard J. Fehring
College of Nursing Faculty Research and Publications
The purpose of this study was to compare the CUE Ovulation Predictor with the ovulation method in determining the fertile period. Eleven regularly ovulating women measured their salivary and vaginal electrical resistance (ER) with the CUE, observed their cervical-vaginal mucus, and measured their urine for a luteinizing hormone (LH) surge on a daily basis. Data from 21 menstrual cycles showed no statistical difference (T= 0.33, p= 0.63) between the CUE fertile period, which ranged from 5 to 10 days (mean = 6.7 days, SD = 1.6), and the fertile period of the ovulation method, which ranged from 4 to 9 …

Trading With China - An Opportunity With Historic Precedent, Tim Brady
Trading With China - An Opportunity With Historic Precedent, Tim Brady
Publications
Dr. Brady writes about the future growth of Chinese industries with a focus on the impact of their growth on the aviation community in the United States. The opportunities for trade are enormous and should be handled with an in-depth knowledge of Chinese culture. Opportunities in higher education also abound.
The Trouble With Postmodern Zeal, Monroe H. Freedman
The Trouble With Postmodern Zeal, Monroe H. Freedman
Hofstra Law Faculty Scholarship
I have always admired the adversarial advocacy with which Professor Carrie Menkel-Meadow attacks adversarial advocacy. Also, given her postmodern skepticism that there can be any certainty in truth, I respect her certainty about her own version of truth. She exhibits both of these qualities in her Article, The Trouble with the Adversary System in a Postmodern, Multicultural World.
I premise my own system of lawyers' ethics on individual dignity and autonomy. Accordingly, I believe that people should be able to choose how to resolve their disputes. It is possible, therefore, that I have no disagreement with Professor Menkel-Meadow. If she …

Modeling Nutrient And Plankton Processes In The California Coastal Transition Zone: 3. Lagrangian Drifters, J. R. Moisan, Eileen E. Hofmann
CCPO Publications
Two types of numerical Lagrangian drifter experiments were conducted, using a set of increasingly complex and sophisticated models, to investigate the processes associated with the plankton distributions in the California coastal transition zone (CTZ). The first experiment used a one-dimensional (1-D; vertical) time-dependent physical-bio-optical model, which contained a nine-component food web. Vertical velocities, along the track of simulated Lagrangian drifters, derived from a three-dimensional (3-D), primitive equation circulation model developed to simulate the flow observed within the CTZ; were used to parameterize the upwelling and downwelling processes. The second experiment used 880 simulated Lagrangian drifters from a 3-D primitive equation …

Modeling Nutrient And Plankton Processes In The California Coastal Transition Zone: 2. A Three-Dimensional Physical-Bio-Optical Model, J. R. Moisan, Eileen E. Hofmann, D. B. Haidvogel
CCPO Publications
A three-dimensional (3-D) primitive equation model, developed to simulate the circulation features (filaments) observed in the California coastal transition zone (CTZ), was coupled to a nine-component food web model and a bio-optical model. The simulated flow fields from a 3-D primitive equation model are used to advect the constituents of the food web model, which include silicate, nitrate, ammonium, two phytoplankton size fractions, copepods, doliolids, euphausiids, and a detritus pool. The bio-optical model simulates the wavelength-dependent attenuation of the subsurface irradiance field. The overall objective of this modeling study was to understand and quantify the processes that contribute to the …

Case Studies Of Selective Mutism In Hispanic Children, Colleen Anne Gittins
Case Studies Of Selective Mutism In Hispanic Children, Colleen Anne Gittins
Theses and Dissertations - UTB/UTPA
Selective mutism is a consistent refusal to use spoken language in specific social situations. This can occur in a particular environment or with specific individuals. A collaboration of four case studies was used to study the possible etiologies, characteristics, and intervention strategies associated with selective mutism. Four children from public school campuses in the Lower Rio Grande Valley of Texas were subjects in this investigation as well as teachers and parents.
A questionnaire was used to gather data along with informal interviews. Results concluded that prevalence rates for selective mutism are relatively high in the area surveyed. Furthermore, many professional …
