Reviving The Rhetoric Of The Public Interest: Choir Directors, Copy Machines, And New Arrangements Of Public Domain Music, Paul J. Heald

The decision to photocopy or not to photocopy has significant consequences for the music consumer's pocketbook. Photocopies cost around three cents per page, while an original printed version of a choral work costs about thirty cents per page. The expense of buying rather than copying public domain sheet music is directly absorbed by the taxpayers who fund music education in public schools, the church congregations who must raise money for the church music budget, and the patrons of the fine arts who finance music ensembles with their admission fees or donations.

Equitable Recoupment: Revisiting An Old And Inconsistent Remedy, Camilla E. Watson

This Article examines the development of recoupment by first comparing and contrasting other equitable remedies. Because discussions of related equitable remedies have filled tomes in themselves, this Article concentrates only on the more salient aspects of these remedies as they pertain to the development of recoupment in the federal tax context. Next, the established elements of recoupment will be discussed in depth, with particular emphasis on the views of Professor Andrews. The Article questions whether Professor Andrews's views represent the most effective analysis of the recoupment criteria in light of the judicial inconsistencies.

Chloroform fumigation-incubation (CFI) has made possible the extensive characterization of soil microbial biomass carbon (C) (MBC). Defining the non-microbial C mineralized in soils following fumigation remains the major limitation of CFI. The mineralization of non-microbial C during CFI was examined by adding 14C-maize to soil before incubation. The decomposition of the 14C-maize during a 10-d incubation after fumigation was 22.5% that in non-fumigated control soils. Re-inoculation of the fumigated soil raised 14C-maize decomposition to 77% that of the unfumigated control. Anticonsumer Effects Of Union Mergers: An Antiitrust Solution, Robert H. Lande, Richard O. Zerbe Jr.

Should unions and corporations be treated identically under the antitrust laws? This article explores this provocative question by examining whether union mergers should be subject to the antitrust laws. Currently unions and corporations are treated very differently. Large corporate mergers are blocked if their effect "may be substantially to lessen competition, or to tend to create a monopoly". They are permitted if they are likely to be benign, procompetitive, or proconsumer.

Collective bargaining, by contrast, enjoys a broad exemption from the antitrust laws. If they follow appropriate procedures, unions - even unions that, when taken together, cover all workers within …

Investigating Behavioral Dynamics With A Fixed-Time Extinction Schedule And Linear Analysis, William L. Palya, Don Walter, Robert Kessel, Robert Lucke

This paper describes the behavioral adaptation observed for 16 pigeons responding to a step transition in the reinforcement rate in a repeated-trial design. Within each trial, following exposure for a fixed period to a variable-interval schedule, there was an unsignaled change in the schedule to extinction. The step transition allowed an experimental test of the applicability of a linear analysis to steady-state dynamic behavior. The computations required for this test yielded, as an intermediate result, transfer functions for each of the 16 birds from 1 mHz to 256 mHz. The transfer functions obtained show greater responsiveness to lower frequencies (i.e., …

Currently, teacher education is at the crossroads. Stimulated by a plethora of government reports and inquiries there are cries for reform, restructuring and change. As teacher educators we have grappled with the complexities, contradictions and tensions emanating from these reform efforts on two fronts. At the institutional level, we have suffered the alienating consequences of restructuring through budget cuts, staff sackings, 'efficiencies', and the casualisation of academic work. Louis Smith’s chapter on biographical method in Denzin and Lincoln’s 1994 text refers to the “reflective practitioner”, a term first used by Schön (1987). It reminds teacher educators that “Clearly it is one thing to be able to reflect-in-action and quite another to be able to reflect upon our reflection in action so as to produce a good verbal description of it; and it is still another thing to be able to reflect on the resulting description” (Schön, 1987 in Denzin and Lincoln, 1994: 293). This paper will describe a fourth year tutor program for pre-service teachers which subscribes to principles of collaborative theory building. Tutors, in a team teaching situation, learn to document prior beliefs and understandings, autobiographical accounts of prior learning and critical classroom incidents in order to analyse and articulate personal and public theories about teaching and learning. The value placed on cognitive and reflective practices is discussed with a view towards empowering the learner and adjusting pre-existing beliefs about teaching.

The teaching profession continues to have difficulty in codifying a body of knowledge on which to base pre-service teacher education programs. One problem is the gap between the student teachers’ theoretical beliefs and their practical experiences in classrooms. Student teachers often fail to implement their ideas and instead comply with the status quo in the classroom. Previous research has identified the student as dealing with this dilemma by developing a mind set which places theory in one compartment and practice in another. This article is based on a study in which I have been involved for the last four years, investigating the learning of final-year primary student teachers and their school-based teacher educators during the practicum. My investigation has confirmed findings from other research indicating that student teachers’ learning in the practicum is a complex process (Feiman-Nemser, 1985; Britzman, 1986; Goodman, 1986; Zeichner, 1986; Calderhead, 1991; Groundwater-Smith, 1993). Student teacher self-esteem was found to play a central role in the complexity of the learning process. I take my text from Professor Harris's rich discussion of Sojourner Truth's life narrative. I begin, as Professor Harris began, with Truth's assertion of parental right. When her five-year-old son, Peter, was sent by his owner from New York to Alabama, Truth agonized over the loss of contact between herself and her child. She feared that Peter would lose the opportunity, owed to him under New York law, of liberation at the age of twenty-one. Thomas Russell's wonderful paper A New Image of the Slave Auction is an example of how the best empirical work can result in conclusions that are so obviously "right" that they risk being mistaken as obvious. His paper serves as an important warning against a recurring problem in legal, as well as other scholarship: Picture thinking-in the sense of an unconscious (and as a result, unquestioning and uncritical) acceptance of familiar, traditional, comfortable imagery-so often blinds us.
