Funding Fairness: Public Investment, Proprietary Rights And Access To Health Care Technology, William M. Sage Nov 1996

Funding Fairness: Public Investment, Proprietary Rights And Access To Health Care Technology, William M. Sage

Faculty Scholarship

In her accompanying Article, "Public Research and Private Development: Patents and Technology Transfer in Government-Sponsored Research," Professor Rebecca Eisenberg suggests that federal technology transfer policies should be reexamined in light of actual experience with patented technologies. Indeed, the relationship among federal research funding, patent law, and medical innovation has become more complicated in the years since the passage of the Bayh-Dole Act. Rising health care spending despite slowing overall economic growth has fostered the development of private sector managed care, has led to cutbacks in government support for both research and clinical services, and has increased the percentage of uninsured …

Dissertations

The intent of this investigation was to conduct an extensive study of the life and character of Elinor Gregg (1886-1970) in order to identify the contributions she made to professional nursing and to humanity. Nurse, educator, administrator, beloved relative, and friend, Elinor Gregg was an outstanding person whom nurses today might well emulate. Historical method provided the context for the study. Data were collected from the National Archives; National Library of Medicine Historical Section; Nursing Archives at Mugar Library, Boston University; Nursing Archives at Simmons College; National Headquarters of the American Red Cross; Archives of Colorado College; and Archives of …

New Histories Of The Private Law Of Slavery, Mark Tushnet Nov 1996

New Histories Of The Private Law Of Slavery, Mark Tushnet

Cardozo Law Review

The new scholarship on the private law of slavery, exemplified by the articles in this Symposium, differs from earlier scholarship in its focus on the law in lower courts, as in Ariela Gross's article, and on the law in action, as in Thomas Russell's. The prior generation of scholarship, including my own, focused almost exclusively on appellate decisions and commentary by pro and antislavery lawyers. The new scholarship resembles its predecessor, however, in using legal materials to explore aspects of the ideology of slavery. For example, Gross develops a highly nuanced account of the image of the good master from …

Finding Sojourner’S Truth: Race, Gender, And The Institution Of Property, Cheryl I. Harris Nov 1996

Finding Sojourner’S Truth: Race, Gender, And The Institution Of Property, Cheryl I. Harris

Cardozo Law Review

This Article begins with the signature speech of Sojourner Truth, one of a handful of Black women of the nineteenth century who became an important figure in the abolitionist movement, a national figure in her own time, and an icon of both historical and contemporary feminism. As the emblematic Black woman of her time and as a Black woman that both suffered under and transcended slavery, Sojourner Truth was and is a critically situated subject through which to examine the crosscutting constructions of race and gender forged under slavery.

A New Image Of The Slave Auction: An Empirical Look At The Role Of Law In Slave Sales And A Conceptual Reevaluation Of Slave Property, Thomas D. Russell Nov 1996

A New Image Of The Slave Auction: An Empirical Look At The Role Of Law In Slave Sales And A Conceptual Reevaluation Of Slave Property, Thomas D. Russell

Cardozo Law Review

The slave auction is among the most powerful images in the history of the United States. Depictions of slave auctions vary, but of the recurring compositional elements, the most fearful and moving is the separation by sale of a young child from his or her mother. The slave auction image starkly represents the inhumanity of American slavery, the racism of the United States, and the contradictions of American liberalism.

The Gens De Couleur Of Louisiana: Comparative Slave Law In Microcosm, Hans W. Baade Nov 1996

The Gens De Couleur Of Louisiana: Comparative Slave Law In Microcosm, Hans W. Baade

Cardozo Law Review

That slavery can be nothing but bad is a universally accepted proposition; it has therefore been contrary to international law for quite some time. Yet there remains the following debate: were there systems of slavery in the past that were "better" than others-better, that is, for the slaves? It is worth recalling that according to the only surviving account of the history of Roman law written in antiquity, Gnaeus Flavius, the son of a freedman, utilized his position as the High Priest's scribe to make public the original register of the forms of action which had hitherto been kept secret. …

Comment On The First Slave (And Why He Matters) By Jonathan Bush, Peter Kolchin Nov 1996

Comment On The First Slave (And Why He Matters) By Jonathan Bush, Peter Kolchin

Cardozo Law Review

In his Article The First Slave (And Why He Matters), Professor Jonathan Bush returns to a persistent question in the history of the colonial Chesapeake: the status of blacks in the seventeenth century. He frames this question, however, in a new way. Rather than seeking to determine whether or not blacks were slaves before the codification of slave law-a largely unanswerable question that revolves, at least in part, around what one means by "slaves"-he asks, how could the English have imposed slavery on blacks in America when slavery was non-existent in England and under English law? In response, he …

Killing Egyptian Prisoners Of War: Does The Phrase "Lest We Forget" Apply To Israeli War Criminals?, Scott R. Morris Nov 1996

Killing Egyptian Prisoners Of War: Does The Phrase "Lest We Forget" Apply To Israeli War Criminals?, Scott R. Morris

Vanderbilt Journal of Transnational Law

This Article offers an analysis of Israel's response, or lack thereof, to the 1995 admission by Israeli war hero General Ayre Biro that he participated in the slaughter of forty-nine unarmed Egyptian prisoners of war in 1956 during Israel's struggle for independence. While in the past Israel has actively pursued the prosecution of war criminals who committed atrocities against its own people under the battle cry "lest we forget," the country has recently shown a strong reluctance to take action against General Biro for his execution of Egyptian prisoners of war. Specifically, Israel reasons that its statute of limitations for …

Managing Strains In The Coalition: What To Do About Saddam?, Stephen C. Pelletiere Dr. Nov 1996

Managing Strains In The Coalition: What To Do About Saddam?, Stephen C. Pelletiere Dr.

Books, Monographs & Collaborative Studies

For 5 years U.S. policy has managed to steer a coalition of states which share broad interests in regional stability and free trade. Yet below these common interests, the United States has walked a tightrope stretched between competing objectives vis-à-vis Iraq, e.g., undermining Saddam while preserving Iraq as a counterweight to Iran; protecting the Kurds while not promoting their independence. Time, however, has a habit of eroding international coalitions and exposing seams in the details of policy. Iraq's September 1996 actions in the Kurdish north found such a seam in coalition objectives, or, to return to the original metaphor, shook …

Is Consultation Effective? A Review Of Outcome Research, Susan M. Sheridan, Marshall Welch, Scott F. Orme Nov 1996

Is Consultation Effective? A Review Of Outcome Research, Susan M. Sheridan, Marshall Welch, Scott F. Orme

Department of Educational Psychology: Faculty Publications

This review summarizes the findings of consultation and teaming research from 1985 to 1995. It analyzes and critiques various methodological features of the research and draws conclusions regarding the current state of consultation and teaming outcome studies. Specific questions addressed in this review include (a) how much empirically based outcome research has been conducted since 1985, (b) what the common methodological features incorporated into the current consultation research are, and (c) what conclusions regarding the current status of outcome research in consultation can be drawn. Behavioral consultation studies were most prevalent (compared to mental health consultation, organizational development consultation, teaming, …

Human Herpesvirus Type 8 Dna Sequences In Cell-Free Plasma And Mononuclear Cells Of Kaposi's Sarcoma Patients, William J. Harrington, Omar Bagasra, Carlos E. Sosa, Lisa E. Bobroski, Marianna Baum, Xue Lan Wen, Lisa Cabral, Gerald E. Byrne, Roger J. Pomerantz, Charles Wood Nov 1996

Human Herpesvirus Type 8 Dna Sequences In Cell-Free Plasma And Mononuclear Cells Of Kaposi's Sarcoma Patients, William J. Harrington, Omar Bagasra, Carlos E. Sosa, Lisa E. Bobroski, Marianna Baum, Xue Lan Wen, Lisa Cabral, Gerald E. Byrne, Roger J. Pomerantz, Charles Wood

Nebraska Center for Virology: Faculty Publications

Human herpesvirus (HHV) type 8 bas been detected in both classical and AIDS-related Kaposi's sarcoma, body-cavity lymphomas, and other types of tumors. HHV-8 has also been detected in DNA from peripheral blood mononuclear cells (PBMC) of some Kaposi's sarcoma patients and more readily in B cell fractions derived from panned cell subpopulations. Two patients were followed using several methods: in situ hybridization, solution-based polymerase chain reaction (PCR), and in situ PCR. HHV-8 was intermittently detected in plasma and detection correlated with detection in PBMC. In situ PCR demonstrated HHV-8 sequences in both peripheral blood B lymphocytes and, to a lesser …

Catalyzed Additions To Alkene Double Bonds: (I) Fumarase-Catalyzed Hydration Of Alkene Double Bonds (Ii) Alumina-Catalyzed Hydrochlorination Of Alkene Double Bonds, Charles Francavilla Nov 1996

Catalyzed Additions To Alkene Double Bonds: (I) Fumarase-Catalyzed Hydration Of Alkene Double Bonds (Ii) Alumina-Catalyzed Hydrochlorination Of Alkene Double Bonds, Charles Francavilla

Theses

The stereospecific hydration of (5)-malate to fumarate, catalyzed by fumarase, was extensively analyzed by NMR. The NMR techniques employed were one dimensional 2H and NOE Difference, and two dimensional ^^H COSY. Various potentional substrates were tried for fumarase-promoted hydration with no sucesss. It was concluded that mesaconate is possibly the largest molecule that can fit into the active site of fumarase in the correct orientation for hydration to occur. Thionyl chloride and appropriately prepared alumina was found to promote the addition of HC1 to norbornadiene ( I ), resulting in71%(+l%) exo-5-chloronorbornene ( II ) and 29% 3-chloronortricyclene ( HI ) …

Moral Discourse, Bioethics, And The Law, Carl E. Schneider Nov 1996

Moral Discourse, Bioethics, And The Law, Carl E. Schneider

Articles

Dan Callahan follows a distinguished tradition when he uses the phrase "moral discourse" to describe the law's work. The frequency with which that image is deployed suggests its resonance and even rightness: When we think about the way society considers moral issues and develops moral positions, it can be useful to imagine the law as one of many social institutions that contribute to a social discussion. Nevertheless, this image is misleading. At least for our (graying and balding) genera- tions, the law is regarded as a worthy participant in American moral discourse preeminently because of its part in the civil …

Remote Network Monitor (Rnm), Bindu R. Sharma Nov 1996

Remote Network Monitor (Rnm), Bindu R. Sharma

Master's Projects

Continuous monitoring of multiple hosts on a network is an important task in network administration. There is a wide spread use of networks in corporations; however, there is a serious shortage of skilled network administration personnel. Therefore, it has become very important to involve end-users in routine monitoring tasks to off-load some network administration work. Building tools for end-users imposes additional requirements on system designers that include greater ease of use and extensive help facilities.

This work was conducted to develop a Remote Network Monitoring (RNM) system to be used for monitoring multiple nodes on a network. RNM system demonstrates …

The Development Of A Project Management System In A Customizable Visual Programming Environment, Robert J. Heldt Jr.

Master's Projects

This thesis project addresses the use of a visual programming environment to develop a customizable project management system. AppWare was chosen as the development environment because it allows an application to be customized by someone with minimal programming knowledge.

AppWare is a visual programming environment that allows applications to be created by connecting objects and functions. The user of AppWare draws the application and the logic. The AppWare environment allows anyone with general programming knowledge to create or modify an application without investing a significant amount of learning time. Applications generated by AppWare can run on the Macintosh operating system …
