The substance of modem criminal law and the procedures through which that law is enforced are a subject of current debate. On the one hand, some call into question the use of criminal sanctions as a means of enforcing schemes of regulation meant to guarantee public welfare. By the same token, violent crime and crime that is otherwise malum in se has caused increasing levels of fear and concomitant calls for more vigorous enforcement of the criminal law. Estranged Fruit: The Reconstruction Amendments, Moral Slavery, And The Rearticulation Of Lesbian And Gay Identity, E. Nathaniel Gates

David A.J. Richards has composed a thoughtful and suggestive narrative that centers on the excavation of the antislavery constitutionalism forged by a small, but arguably influential, group of antebellum abolitionist feminists. Central to his narrative, and to the constitutional theses of the abolitionist feminists, is the concept of "moral slavery" which, on Richards' account, constitutes a crucial element of the hermeneutic background essential to a proper interpretation of the Reconstruction Amendments. The analogy between race and gender plays an increasingly important role in the interpretation of the Equal Protection Clause of the Fourteenth Amendment. However, interpretive arguments about the analogy make little or no reference to the abolitionist historical background of the Reconstruction Amendments in general and the Fourteenth Amendment in particular. This might make some sense if the only legitimate interpretive appeal to history were Raoul Berger's version of originalism, namely, the specific denoted things (including persons and practices) to which the relevant drafters and ratifiers of the pertinent constitutional text would or would not have applied the language in …

The Constraints Of A Typological Implicational Universal For Interrogatives On Second Language Acquisition, Dee Anne Bess

A typological implicational universal based on a diverse sample of the world's languages describes a hierarchy for interrogatives. The universal hierarchy states that in any given language, inversion in Yes-No questions (YNQs) implies inversion in information questions (WHQs in English), which, in turns implies the fronting of the information word pronoun to sentence-initial position.
Several researchers have proposed that typological implicational universals such as this one for interrogatives may constrain not only the primary languages on which they are based, but also the interlanguages of second language learners.

Should Students Have Constitutional Rights? Keeping Order In The Public Schools, Anne Proffitt Dupre

This Article focuses on how the Supreme Court's conception of the public school as either an institution of social reproduction or reconstruction, a conflict Professor Dupre maintains is deeply rooted in intellectual history, has affected the power that public schools have been afforded in matters of discipline and order. Professor Dupre argues that the Court -- by allowing the reconstruction model to influence its opinion for almost thirty years -- paved the way for the decline in school order and educational quality. Discussions concerning global change typically concentrate on future climatic changes promulgated by changes in atmospheric chemistry, most notably increases in the so-called greenhouse gases such as CO2, CH4, and and N2O. Although the energy exchange characteristics of the Earth’s surface are an important component of climate models, the idea that changes in the terrestrial surface could also be a causal factor in climatic changes has not received much attention. Sensitivity studies with GCM’s suggested that regional climate can be dramatically changed by severe deforestation. Dickinson and Henderson-Sellers (1988) simulated the Amazon basin with complete forest cover, and then replaced with …

Stepparent Adoption And Involuntary Termination Of Parental Rights: When Petitioners Come To Court With Unclean Hands, Karl A. W. Demarce

Missouri courts have repeatedly been presented with situations where the petitioners for involuntary termination of parental rights and stepparent adoption have actively interfered with the non-custodial parent's relationship and visitation rights with the child, prior to bringing the action. This Note contends that where the custodial parent and his/her new spouse have significantly interfered with the non-custodial parent's relationship with the child, the equitable maxim of "unclean hands" should be invoked and the doors of the juvenile court closed to the petitioners seeking a termination of parental rights and stepparent adoption.6 Although adoption is a purely statutory action, it clearly …

On The Orbital Period Of The New Cataclysmic Variable Euve J2115-586, Stephane Vennes, Dayal T. Wickramasinghe, John R. Thorstensen, Damian J. Christian, Michael S. Bessell

We have obtained phase-resolved spectroscopy (3660-6040 Å) of the recently discovered cataclysmic variable EUVE J21 15-586 using the 74-inch telescope at Mount Stromlo Observatory. The radial velocity is modulated over a period of 110.8 min with a possible one-cycle-per-day alias of 102.8 min, and a semiamplitude of ≍270 km s-1 at Hβ and ≍390 km s-1 at He II λ4686. The spectroscopic appearance (H I Balmer, Ca II, He I, He II emission lines), the orbital period, and the velocity amplitude indicate that this cataclysmic variable is probably an AM Her type; the absence of cyclotron humps indicates …

Note: On The Degree Of Lp Approximation With Positive Linear Operators, J. J. Swetits, B. Wood
Mathematics & Statistics Faculty Publications
The degree of approximation in Lp-spaces by positive linear operators is estimated in terms of the integral modulus of smoothness. It is shown that the conjectured optimal degree of approximation is not attained in the class of functions having a second derivative belonging to Lp.

A Lopez Legacy?: The Federalism Debate Renewed, But Not Resolved, Debbie Ellis
Northern Illinois University Law Review
This casenote examines the Supreme Court's landmark ruling in United States v. Lopez, in which the Court struck down a Congressional enactment under the Commerce Clause for the first time in modern history. The note traces Commerce Clause jurisprudence back to the days of the Founding Fathers and analyzes the Lopez opinion in an historic context. It also provides an overview of how the lower federal courts have dealt with appeals based on the Lopez ruling and concludes that the federalism debate, which underlies the Court's 5-4 decision, has been renewed but not resolved.
