Active Employment Standard: Much-Needed Clarification For Determining Liability For Use Of A Weapon During The Commission Of A Drug-Related Crime, The, Tiffany Gulley Becker

In Bailey v. United States, the Supreme Court reduced the confusion caused by an era of contradiction among the circuits regarding the standard necessary to maintain a conviction for "us[ing]" a firearm "during and in relation to" a drug trafficking crime. In its seeming departure from an earlier authorization of a broad definition of "use," the Supreme Court altered its course and provided a new and clearer test for criminal liability under this section. In so doing, the Court settled the ultimate question debated so intensely in the circuit courts of appeal and emerged with a more workable standard.

People are articles of commerce, or so the United States Supreme Court held in 1941, emphasizing that the issue was "settled beyond question." At the time, Justice Jackson expressed some discomfort with the theory that "the migrations of a human being... [are] commerce." The Court, however, has not wavered from this analytical position. Indeed, like many legal constructs, it has inspired little reflection. My hope is to search for what Toni Morrison describes as "the shadows of the presence from which the text has fled."" Life After Adarand: The Future Is Not So Clear, Charles J. Dykhouse

African-American scholar and statesman W.E.B. DuBois "predicted in 1908 that the question of this century would be the 'color-line,' meaning the relations between the white and African-American races." The Supreme Court of the United States has now decided in Adarand that any such program, whether federal, state, or local, must be analyzed with strict scrutiny to determine if it violates the Equal Protection Clause. In so doing, the Court dramatically changed the landscape of affirmative action programs in this country.

Everything You Wanted To Know About Missouri's Public Policy Exception But Didn't Know You Should Ask, Joseph H. Knittig

In a wrongful discharge action based on the public policy exception to the employment-at-will doctrine courts created a sleeper claim favoring terminated at will employees.' Generally, Missouri courts categorically constrain the public policy exception in a narrow and clear cut fashion. However, some Missouri courts pushed and rubbed at the bright lines of those categories and created a hazy area of unpredictability in the exception. In addition, federal courts interpreting the Missouri public policy exception introduced a significant pre-emption dispute which Missouri state courts have yet to address.

Remotely Possible? Simple Remote Access To The Network, Margaret Sylvia

Remote access to the library is possible without a magic wand. we have seen increased use of the library in recent years, either because of, or despite, the possibility of remote access. One reason may be that some full-text material is still only available inside the library. Remote access was first implemented in the St. Mary's University Academic Library in 1991, shortly after the installation of the first network in the library. Various options for remote access are compared and contrasted, including the EA/2 solution.

Asbestos Induces Apoptosis Of Human And Rabbit Pleural Mesothelial Cells Via Reactive Oxygen Species, V. Courtney Broaddus, Lin Yang, Louis M. Scavo, Joel D. Ernst, Alice M. Boylan

Mesothelial cells, the progenitor cell of the asbestos-induced tumor mesothelioma, are particularly sensitive to the toxic effects of asbestos, although the molecular mechanisms by which asbestos induces injury in mesothelial cells are not known. We asked whether asbestos induced apoptosis in mesothelial cells and whether reactive oxygen species were important. Pleural mesothelial cells (rabbit or human) were exposed to asbestos (crocidolite, amosite, or chrysotile) or control particles at moderate doses (1–10 μg/cm2) over 24 h and evaluated for oligonucleosomal DNA fragmentation, loss of membrane phospholipid asymmetry, and nuclear condensation. Repetition Blindness And Bilingual Memory: Token Individuation For Translation Equivalents, Jeanette Altaribba, Emily G. Soltano

The repetition blindness effect (RB) occurs when individuals are unable to recall a repeated word relative to a nonrepeated word in a sentence or string of words presented in a rapid serial visual presentation task. This effect was explored across languages (English and Spanish) in an attempt to provide evidence for RB at a conceptual level using noncognate translation equivalents (e.g.,nephew-sobrino). In the first experiment, RB was found when a word was repeated in an English sentence but not when the two repetitions were in different languages. Commercial law is "the whole body of substantive jurisprudence ... applicable to the rights, intercourse, and relations of persons engaged in commerce, trade, or mercantile pursuits." Of course, an article on commercial law that used this statement to define its coverage would be completely unsuitable for a survey. The Author instead relied on Georgia's Commercial Code to determine the body of law to review in this Article and, accordingly, structured it in a similar fashion.

While the nation's economy is expected to grow slowly over the next two years, Nebraska's economic health will remain vigorous. The confluence of strong agricultural income and overall strength in Nebraska's nonfarm economy will yield solid advances in employment as well as rapid growth in income and sales. Employment Gobs) will advance 1.8 percent in both 1997 and 1998. Nonfarm personal income will advance 6.7 percent in 1997 and 5.4 percent in 1998. Oxygen Plasma Asher Contamination: An Analysis Of Sources And Remedies, R. A. Synowicki, Jeffrey S. Hale, William A. Mcgahan, Natale J. Ianno, John A. Woollam

Department of Electrical and Computer Engineering: Faculty Publications

The low Earth orbit (LEO) environment is commonly simulated using oxygen plasma ashers to determine the effects of LEO on spacecraft materials. However, plasma ashers can also contaminate samples during plasma exposure, making them less than ideal for space simulation. This study results from attempts to minimize or eliminate contamination. Optical methods of variable angle spectroscopic ellipsometry and reflectance spectrophotometry were used to quantify contaminant stoichiometry and deposition rate. Auger electron spectroscopy identified deposited contaminants and their surface coverage. Contamination results from etching of the rubber chamber seals by the plasma.
