This Article discusses the current predominance of natural rights theory in the area of intellectual property and of patents in particular. Due to the alleged problems of international theft and pirating of patents, the recent GATT negotiations saw intellectual property law come to center stage in the debate over trade. These negotiations concluded that trade-related aspects of intellectual property law can no longer be left to the public policy of individual countries, but require new international minimum standards.

In this Article, Professor Jaszi suggests that there is a need to develop new, policy-grounded arguments against expansionist legislative and judicial tendencies in copyright that diminish the traditional public domain. In recent years, he contends, a new understanding of the purposes of a copyright system has emerged, which has changed the U.S. copyright discourse in support of increased proprietary rights. Three simulation studies were conducted in order to compare the accuracy of two algorithms for estimating missing observations in time series data. Each study was designed to test the algorithms under conditions which are likely to occur in applied behavioral research: (1) Study 1 examined the effects of model misspecification on the accuracy of estimation; (2) Study 2 examined the effects of systematically missing data (versus randomly missing data) on estimation accuracy; (3) and Study 3 explored the accuracy of the algorithms under conditions of nonnormality in the data series. Since James (1890) introduced the psychological importance of the self, researchers have continued to debate several issues concerning self-concept and self-esteem. This study examined the ratings of multiple domains of self-concept, the importance of those domains, ratings of general self-concept, and self-esteem of 691 students from a North East school district in grades 4, 8, and 12. Students were chosen to represent three developmental levels: preadolescence, early adolescence, and late adolescence. All students completed the Rosenberg Self-Esteem Scale, a form of the Harter Self-Perception Profile and its accompanying importance ratings. This research examined the impact of breast cancer on body image and sexual functioning. Twenty women who underwent a mastectomy, twenty-one women who underwent a lumpectomy, and twenty-one women without personal history of breast disease or surgery completed measures of life experiences, marital satisfaction, body satisfaction, and sexual functioning. Data was both retrospective and prospective. The prospective data was collected in the form of daily diary ratings of body satisfaction and sexual functioning, which all participants completed for one month. Contrary to expectation, body satisfaction and sexual functioning did not differ between groups. For all groups, body satisfaction increased over …

Dust, uplifted by wind from the continents, and transported through the atmosphere, leaves a geologic record across the earth; in loess deposits on the continents, red clays on the ocean floors and on the polar ice caps. If we can interpret the paleoclimatic and paleometeorology information preserved in these deposits, we can learn how continental climate and atmospheric circulation have varied over the course of time. Continental climate information is preserved in the composition of the dust. In certain experimental situations, the data observed are pseudo-proportional. By this, we observe the numerator, the number of responders, but the denominator, the total number, is random and, possibly, unobserved. In such situations, the data often exhibit "extra" variability due to the randomness of the denominator. Analysis of these data should account for this overdispersion. Several authors have proposed parametric approaches to this problem. Finney [Biometrika (1949) 36, 239-256] proposed the use of a mixture of the binomial and Poisson distributions. The provision of health care has traditionally been deemed a charitable function.' Therefore, hospitals and other health care institutions have been afforded the benefits of tax exemption. As a standard for determining which entities merit the tax exemption and which do not, the Internal Revenue Service ("IRS" or "Service") developed what has come to be known as the community benefit test. We show how it is possible to put different stability types such as Routh-Hurwitz and Schur-Cohn on common grounds by establishing direct links between them. In the process, we obtain natural and elegant extensions of both Pascal's rule and the binomial theorem, which prove useful in establishing our main results. In this paper, the direct and inverse nonstationary scattering problem for a hyperbolic system of n equations (n>3) on a semi-axis is studied. The coefficients of the system are uniquely determined according to scattering operator. The solution of the problem is generalized for an arbitrary natural number n applying the properties of separation of factors by means of operator transformations to some elements of the scattering operator and its inverse as well as reducing the scattering problem given on a semi-axis to the scattering problem on the whole-axis.

The object of the present paper is to prove various distortion theorems for the fractional calculus of functions in the class T_{n}\left(\lambda,\alpha\right) consisting of analytic and univalent functions with negative coefficients. Furthermore, a distortion theorem for a fractional integral operator of functions in the class T_{n}\left(\lambda,\alpha\right) is shown.

Definitive airway management is one of the most important aspects of the care of ill or injured patients with a decrease in the level of consciousness. The effect of poor airway management can lead to aspiration, hypoxia, suffocation and death. Definitive airway management is the gold standard of care in patients with a Glasgow Coma Scale (GCS) of less than or equal to eight. My work focuses on the reality and life of mental objects. The unseen masquerade as the seen, not only in our mind's eye but as an immediate visual experience.

To realize this I apply volumetric form to models of thought and present them in a variety of environments. The forms are derived from the fields of science and mathematics, specifically geometry and topology. Topology or "rubber-sheet geometry," is the study of shapes whose essential attributes are unchanged by continuous deformation. The shapes are not defined by measurements of distance and angle, but by whether they can be transformed when bent, …

Jefferson Powell's recent book, The Moral Tradition of American Constitutionalism, was the point of departure for a series of short papers and conversations held in March of 1996 at the Notre Dame Law School.

The conversation began with a presentation by Professor Joseph Vining. His remarks were followed by a free-flowing conversation, loosely orchestrated by Professor Robinson, among the participants. After a break, the conversation was restarted with a presentation by Professor Maura Ryan, followed once again by a loosely orchestrated conversation. We turn first to Joseph Vining.

Not long ago, the welfare reform debate took a provocative turn. New Jersey welfare recipients challenged the state's Family Cap rule, which denied additional cash aid to parents who conceive children while on welfare. Welfare rights activists argued that the rule "with[held] benefits to see if [this would] alter human behavior." They insisted that the innovative, but stern, Family Cap rules were effectively experiments on welfare recipients without their consent.

This is a powerful argument. After all, consent enjoys talismanic—if not sacramental—status in modem life and thought; it is our "master concept." But why? Why should consenting mean so much …

Simple Approximation For Thermal Diffusion In Ionized Gas Mixtures, John D. Ramshaw

A simple approximation for thermal diffusion in gas mixtures was recently proposed [1]. This approximation was based upon relations valid for rigid spheres. It is therefore appropriate for molecules with steep repulsive potentials, but not for ionized species interacting via the Coulomb potential. Here we formulate an analogous approximation for ionized species and free electrons. The resulting thermal diffusion coefficients differ in sign from those for hard molecules.

The self-consistent effective binary diffusion (SCEBD) approximation for multicomponent diffusion in gas mixtures is reconsidered and reformulated. The new formulation is based on the fact that a suitable rearrangement of the Stefan-Maxwell equations provides an exact expression for the complementary mean velocity a_i for species i as a weighted average of the velocities of all the other species. The coefficients in a_i are normalized friction coefficients which are simply related to the true binary diffusion coefficients. A simple factorized bilinear approximation to the friction coefficients then yields approximate species diffusion fluxes identical in form to those of a …

A tapestry from the Ica Valley of Peru (A.D. 900-1476), in the collection of the Virginia Museum of Fine Arts, Richmond, Virginia, is the subject of this study. This thesis is an attempt to demonstrate that the tapestry is an example of a textile form known as a "sampler." Woven as a learning tool and template by an apprentice and an expert weaver within the style and reflecting the iconography of Ica art.

Bankruptcy law is developing rapidly in the countries of Central and Eastern Europe (CEE) that have recently escaped the domination of the Union of Soviet Socialist Republics (USSR). The communist governments fell in those countries that were separate from the USSR in 1989, and those countries that were a part of the USSR gained their independence and acquired new non-communist governments in 1989 (the Baltic states) and 1991 (Ukraine, Belarus, Moldova, and Russia).
