This thesis documents how the impact of court decisions will define the terms of The Americans With Disabilities Act.

Research on The Americans With Disabilities Act (ADA) shows the lack of clearly defined terms in the regulations. Terms like essential functions, reasonable accommodation, and undue hardship may have different meanings for each individual business.

The Americans With Disabilities Act is not a group rights piece of legislation. Individuals having a like disability may have dissimilar needs of accommodation. All muscular dystrophy patients, for example, do not have like symptoms or progression of the disease. At different stages each individual will …

Return To Hot Wheels: The Fcc, Program-Length Commercials, And The Children's Television Act Of 1990, Allen K. Rostron

During the 1970s, the FCC closely examined the commercial content of children's television programming. However, in the 1980s, it declined to adopt any specific advertising or programming standards to replace those of the abandoned National Association of Broadcasters' code. The result, according to critics, was "program-length commercials," advertising for toys and other children's products contained in children's programs.

The Children's Television Act of 1990 directed the FCC to address this problem, but the agency failed to respond to the concern of Congress that children's television had become the "video equivalent of a Toys-R-Us catalog." It rejected proposals submitted during the …

Electronic Commerce is a relatively new phenomenon in today's market place. Commerce or the buying and selling of goods and services can take many forms. In the early years of computerization. commercial activities revolved around the exchange of financial data between businesses and banks (Electronic Funds Transfer). Then businesses began exploring the transfer of data in an electronic format between individual businesses in the form of Electronic Data Interchange (EDI). Feminism For Men: Legal Ideology And The Construction Of Maleness, Nancy Levit

It may seem a little odd to suggest that feminist theory has overlooked men. Yet, in several important respects, apart from the role of culprit, men have been largely omitted from feminism. Feminist legal theorists have paid mild attention to the "Can men be feminists?" question but this issue is usually relegated to footnotes. The negative effect gender role stereotypes have on men is typically subsidiary to the main focus of feminist legal literature, which has concentrated on documenting the patterns of subordination of women and on questions of feminist ideology.

The Tales Of White Folk: Doctrine, Narrative, And The Reconstruction Of Racial Reality, Robert L. Hayman, Nancy Levit

Black America, some people said, was dying. And they wondered what they would hear in the souls of white folk when white America heard the news.

Part of the story was told in June 1995, by the Supreme Court. The session of the Court had not been convened explicitly or exclusively to determine the fate of black America. Still, it was clearly on the agenda, with no less than three major race-related disputes on the High Court's docket.

A Baseline Detection Method For Analyzing Transient Electrophysiological Events, C. George Carlson, Joseph W. Krieg

A baseline detection method has been developed that identifies and defines event transitions for whole-cell voltage or current ('transient') events that are produced by the activity of ion channel ensembles. The method utilizes a variety of iterative techniques that independently determine, for each event, several output parameters that are ultimately referrable to the mean and Variance of each pre-event baseline. Examination of miniature endplate potentials using the baseline detection method provided the following output parameters for each transient event: pre-event mean and variance; rise time; peak amplitude and duration; a determination of whether the decay phase was best fit by …

Anti-Essentialism, Relativism, And Human Rights , Tracy E. Higgins

Confronted with the challenge of cultural relativism, feminism faces divergent paths, neither of which seems to lead out of the woods of patriarchy. The first path, leading to simple tolerance of cultural difference, is too broad. To follow it would require feminists to ignore pervasive limits on women's freedom in the name of an autonomy that exists for women in theory only. The other path, leading to objective condemnation of cultural practices, is too narrow. To follow it would require feminists to dismiss the culturally distinct experiences of women as false consciousness. Yet to forge an alternative path is difficult, …
