An Argument For Universal Pediatric Hiv Testing, Counseling And Treatment, Colin Crawford Jan 1996

An Argument For Universal Pediatric Hiv Testing, Counseling And Treatment, Colin Crawford

Cardozo Journal of Equal Rights & Social Justice

The article argues that mandatory pediatric HIV testing, counseling, and treatment are essential to address a public health emergency, overriding constitutional concerns. The author, Colin Crawford, asserts that early detection and treatment significantly improve the lives of HIV-positive children, making it a compelling state interest that should take precedence over privacy and autonomy concerns.

Making Equality Law More Effective: Lessons From The German Experience, Ninon Colneric Jan 1996

Making Equality Law More Effective: Lessons From The German Experience, Ninon Colneric

Cardozo Journal of Equal Rights & Social Justice

The article examines the evolution and effectiveness of equality law in Germany, particularly focusing on gender equality. It highlights the significant influence of European Community (EC) law on German legislation and discusses the challenges in implementing these laws to achieve substantial gender equality. The analysis reveals that while progress has been made, there are persistent issues in effectively enforcing these laws.

Reach And Substance Of The Principle Of Equal Treatment In Social Security Law Under European Community And German Constitutional Law, Ursula Rust Jan 1996

Reach And Substance Of The Principle Of Equal Treatment In Social Security Law Under European Community And German Constitutional Law, Ursula Rust

Cardozo Journal of Equal Rights & Social Justice

The article examines the principle of equal treatment in social security law under European Community (EC) law and German constitutional law, highlighting their differences in scope and application. While both legal systems prohibit sex-based discrimination, EC law, primarily through Directive 79/7, applies narrowly to specific risks and allows significant exceptions, particularly for survivor and family benefits. In contrast, German constitutional law provides broader protections under the Basic Law, which directly binds the legislature and judiciary to ensure equal rights, though it also struggles with addressing indirect discrimination effectively.

Response To Professor Woodhouse, Janet L. Dolgin Jan 1996

Response To Professor Woodhouse, Janet L. Dolgin

Hofstra Law Faculty Scholarship

In her Afterword to Solomon's Dilemma: Exploring Parental Rights, Professor Barbara Bennett Woodhouse asserts that I advocate judicial reliance on the notion of intent to determine parenthood in certain cases occasioned by reproductive technology. I do not, and in the paper to which Professor Woodhouse referred did not, advocate such a position. In my paper, I did analyze the implications of such reliance by a number of courts. Professor Woodhouse confused my analysis with advocacy. In so doing, Professor Woodhouse weakened the effects and potential benefits of both analysis and advocacy. Analysis does not necessarily imply advocacy, though obviously analysis …

An Investigation Into Motor Pools And Their Applicability To A Biologically Inspired Model Of Ballistic Voluntary Motor Action, Mark Paul Norman Jan 1996

An Investigation Into Motor Pools And Their Applicability To A Biologically Inspired Model Of Ballistic Voluntary Motor Action, Mark Paul Norman

School of Engineering, Computing and Mathematics Theses

This study investigates the properties of motor pools in the human motor control system. The simulations carried out as part of this study used two biologically inspired neuronal models to simulate networks with properties similar to those observed in the human motor system (Burke, 1991). The Synchronous neuronal model developed as part of this study explicitly models the input/output spike train and frequency relationship of each neuron. The motor pool simulations were carried out using the INSIGHT TOO simulation software developed as part of this study. INSIGHT TOO is a flexible neural design tool that allows the visual interactive design …

Why Has The Best Interest Standard Survived?: The Historic And Social Context, Janet L. Dolgin Jan 1996

Why Has The Best Interest Standard Survived?: The Historic And Social Context, Janet L. Dolgin

Hofstra Law Faculty Scholarship

For almost two centuries, American family law has asserted that it places children and their welfare at the heart of custody and parentage determinations. That statement, institutionalized in the United States as the "best-interest" standard (or principle),has become almost impossible to attack. However, the best-interest standard is widely criticized for providing little concrete guidance to courts asked to settle disputes involving children's custody. The standard, as applied, grants courts remarkable flexibility. As a result, reliance on the standard ensures widely discrepant, even contradictory, results in custody cases, depending on the presiding judge. The standard, presumed to determine and protect the …

The Effects Of Thyroid Hormone On Myosin Heavy Chain A-7 Production In Xenopus Laevis Tail And Leg Muscles, Andrew R. Noble Jan 1996

The Effects Of Thyroid Hormone On Myosin Heavy Chain A-7 Production In Xenopus Laevis Tail And Leg Muscles, Andrew R. Noble

Honors Theses

The present research examines the expression of myosin heavy chain genes in muscle fibers in Xenopus laevis. Characteristically different muscle fibers are expressed before and after metamorphosis. The embryonic myosin proteins that are synthesized during the tadpole stages are replaced with adult myosin heavy chains at metamorphosis. At least one of the adult myosin genes, called A-7, is expressed only in the adult animals, not in tadpoles. The controlling factor or trigger for the expression of this adult gene still remains unknown. There are a number of possible explanations for the A-7 regulation at metamorphosis, including changes in particular hormone …

Modeling Diseased Oyster Populations. Ii. Triggering Mechanisms For Perkinsus Marinus Epizootics, Eric N. Powell, John M. Klinck, Eileen E. Hofmann Jan 1996

Modeling Diseased Oyster Populations. Ii. Triggering Mechanisms For Perkinsus Marinus Epizootics, Eric N. Powell, John M. Klinck, Eileen E. Hofmann

CCPO Publications

Densities of Crassostrea virginica remain high enough to support substantial fisheries throughout the Gulf of Mexico despite high mortality rates produced by the endoparasite Perkinsus marinus. The infrequency of epizootics in these populations suggests that controls exist on the disease intensification process. The progression of epizootics in oyster populations, the factors that trigger epizootics, and the factors that terminate epizootics once started were investigated with a coupled oyster population—P. marinus model.

The time development of a simulated epizootic was triggered by environmental conditions that occurred and disappeared as much as t8 months prior to the onset of mortality in …

Bioremediation Treatability Studies For Soils Containing Herbicides, Chemicals, And Petroleum Products, Loring F. Nies, Matthew B. Mesarch

JTRP Technical Reports

Leaking underground storage tanks are widespread throughout the United States. It is estimated that there are 1.4 million underground gasoline storage tanks in the United States, with as many as 75,000 to 100,000 that may be leaking. In Indiana alone, more than 3,500 of the 15,000 registered underground storage tank facilities have reported leaks. Conventional remediation methods often involve pump-and-treat schemes for contaminated water, and excavation and burial of contaminated soil in hazardous waste landfills. These methods increase the risk of exposure to pollutants for workers and local residents. Furthermore, these methods merely involve the transfer of pollutants from one …
