Environmental Reform In An Era Of Political Discontent, Walter R. Burkley
Environmental Reform In An Era Of Political Discontent, Walter R. Burkley
Vanderbilt Law Review
When Congress sought in 1995 to restructure the federal environmental regulatory schemes, it looked like a good fight to pick.' Congress, Republican-controlled for the first time in decades, was armed with an apparent mandate to shrink the federal government. Moreover, Americans were concerned about jobs and the economy. Environmental regulation, so the argument goes, impedes competitiveness, which in turn leads to loss of jobs. In addition, if history is any guide, environmental concerns tend to suffer in times when the economic interest of individuals is the driving political force. Given these dual concerns over the economy and the size of …

Lobbying In The Nonprofit Sector: A Study Of Practice And Values, Larry A. Buzas
Lobbying In The Nonprofit Sector: A Study Of Practice And Values, Larry A. Buzas
Dissertations
Executive directors of nonprofit organizations were interviewed to determine their lobbying practices. Direct lobbying and grassroots lobbying, as defined by P. A. 94-455 were studied. Independent variables include: (a) formal organizational support, (b) organizational affiliation, (c) organizational characteristics, and (d) the executive directors' perceptions and demographic characteristics.
Data were collected during semi-standardized interviews. A random sample of 50 executive directors of nonprofit organizations in Michigan was selected. The research shows that executive directors of nonprofit organizations do lobby policy makers at the local, state, and federal levels using the following techniques: (a) face-to-face visits, individually or with coalitions, including providing …

On The Wrong Side Of The Railroad Tracks: Public Access To The Hudson River, Matthew R. Atkinson
On The Wrong Side Of The Railroad Tracks: Public Access To The Hudson River, Matthew R. Atkinson
Pace Environmental Law Review
The expansion of commuter rail and intercity high-speed rail along the shore of the Hudson River has limited, and will continue to limit and formalize public access to the river. The public trust and other legal doctrines that protect public access to the river call into question the legality and policy of such limitations on access. This article reviews New York's plans that adversely affect access, the justifications for limitations on access, and the countervailing legal doctrines in favor of enhanced public access to the river. This article concludes that railroad operations are legally subordinate to public access and recommends …
Taking And Giving: Police Power, Public Value, And Private Right, Gerald Torres
Taking And Giving: Police Power, Public Value, And Private Right, Gerald Torres
Cornell Law Faculty Publications
This lecture is divided into three parts. First, I will outline a critique of efficiency as it has functioned as the metanarrative underlying our basic current understanding of social institutions. A metanarrative is merely a legitimating background story rooted in the claim that it is the "story that can reveal the meaning of all stories." The claim I am making is that the standards of efficiency in common usage have operated in this way in questions of social policy. For government institutions, this is summed up in the popular claim of politicians that they will "run government like a business." …
