As the Supreme Court has turned federal sentencing upside down in Booker, it has left a host of open questions in the wake of that decision. The outcome of these questions is often difficult to predict, for lower courts and commentators alike, as the Court has failed to develop an overarching sentencing philosophy to replace the rehabilitation-focused one that animated sentencing for so long. If the Court were to reach consensus on that issue, it would be better able to speak coherently on unresolved sentencing matters. A Survey Of Black Student Perceptions And Attitudes On The Utilization Of Academic Retention Programs, Beora Willams

In this study I examine the perceptions and attitudes of black students attending a predominantly white institution (PWI) concerning student support services designed to assist them in achieving social and academic success. PWIs have established minority retention programs with an overall mission of recruiting and retaining black students; however, program use is minimal and black students continue to depart college prematurely. This research seeks to assess the perceptions and attitudes of black students to determine if program ambiguity, lack of faculty involvement or available mentoring, campus affiliation, racism, or time taken away from academic pursuits has a role in whether …

It Takes A Militia: A Communitarian Case For Compulsory Arms Bearing, Brannon P. Denning, Glenn Harlan Reynolds
William & Mary Bill of Rights Journal
During the last year, both Communitarianism and private militias have received a considerable amount of attention in the popular press and in law reviews; nevertheless, few observers have discussed the similarities between these two seemingly dissimilar movements. In this Essay, the authors demonstrate that Communitarians and militias actually have more in common than it might at first appear. Summarizing the Communitarian agenda, the authors note that Communitarians speak a language that would be readily understood by the Framers, who saw militias as an important vehicle through which civic virtue could be transmitted. These were purportedly among the last words of the tycoon John Jacob Astor as, clad in formal evening attire, he tenderly placed his wife into a lifeboat and, a gentleman to the last, prepared to meet his watery grave aboard the Titanic after it struck an iceberg in the frosty North Atlantic ocean on April 15, 1912. Individual and human rights in this country have evolved from national movements and national standards. The Fourteenth Amendment's application of rights to the states was a landmark in human rights, guaranteeing all citizens, no matter their state of residence, a baseline of protection. The Federal Constitution was the protector-“states' rights” was the code phrase for discrimination. But in the American crucible of cultural diversity a national standard for “community” may result in the lowest common denominator or a definition based on averaging. Many people in the San Francisco Bay Area have noticed that their quality of life has deteriorated in recent years. Citizens are becoming increasingly aware of problems such as traffic congestion; cost and supply of housing; loss of open space and agricultural land; environmental concerns; deterioration of infrastructure; and economic uncertainties.
All of these problems have significant effects on the physical and social welfare of our communities. Many of them are interrelated, and the result of haphazard regional growth patterns. Over the past 20 years California’s coastal management program has succeeded in making previously inaccessible stretches of California coastline available to the public. New stairways from coastal bluffs to the beaches below have been constructed, and coastal parks, trails and public recreational facilities have been created to enable larger numbers of California residents and visitors to access some of the world’s finest stretches of sandy beaches and reefs, tidepools, scenic views and surf. Today, roughly half of the state’s 1,100 mile stretch of coastline is in public ownership and, with the exception of military bases and public utility properties, nearly …
