Law And Inequality: Race, Gender…And, Of Course, Class, Carroll Serron, Frank W. Munger

This chapter discusses the concept of class in an important subfield, the sociology of law. Class, a pivotal institution of society, was central to the earliest studies of legal institutions and of law and inequality in particular. More recently, class has played a less important role. This chapter argues for the continuing importance of class and provides examples of its potential use in contemporary sociolegal research. The first part reviews early work that employed class and instrumental models of the state. Grounded, anti-formal models of law provided a contrasting view. Rights in American society present a paradox-critics increasingly assert that proliferation of rights is undermining Americans' sense of community, yet scholars continue to document Americans' reluctance to assert formal legal rights. We explore the meaning of rights in American society by describing the intersection between the evolving civil rights of a previously excluded minority, culminating in the, and the personal histories of two individuals who might potentially invoke or benefit from such rights. Tracing the life stories of "Sara Lane" and 'Jill Golding" from childhood through adolescence to adulthood and employment, we relate the everyday relevance or irrelevance of law …

This thesis explores the stories which revolve around folk legend Hugh Winder Nibley and what those stories mean to the people of Brigham Young University. Folklore reveals who we are and what is important to us. But, interestingly, folklore tends to reveal more about the person telling the story than about the subject of the story itself. A Rhetorical Situation: Contemporary Arguments On The Legalization Of Gambling In America, Jan Lewellyn Davidson

Lloyd Bitzer's (1992) definition of a rhetorical situation is applied to a historical review of the rhetoric surrounding the legalization of gambling in America. The Indian Gaming Regulatory Act of 1988 invites rhetoric from tribes, the gaming industry, elected government officials, anti-gambling coalitions, and states. Consistent rhetorical participation by these parties gives significance to gambling in America. A review of the rhetoric on legalized gaming illustrates the vacillating public opinion of legalized gambling in America. This study delineates Indians' poor living condition on reservations as the existing situation initiating rhetorical discourse. While all parties continue to debate their respective positions, …

Although many scholars have been in favor of providing first amendment protection for art, no one has offered a justification for its constitutional protection suited to art's singular capacities. Rather, commentators and courts have been inclined to place art under the rubric of general speech, which limits protection to ideas and content. Professor Hamilton argues that art offers significantly more than its content and deserves first amendment protection tailored to its particular potential. Art enables individuals to experience unfamiliar worlds and thereby to gain new perspectives on the prevailing status quo, including the government's. It performs this function without exposing …

Seeking The Chameleon: The Influence Of Native Rhetoric And The Oral Tradition On Native American Literature, Christine S. Brown

This project seeks to explore the impact of rhetoric and the oral tradition on Native American literature by demonstrating that unique features are evident as a direct result of this influence. Characteristics which have functioned to preserve their culture (e.g.; the morphogenetic nature of Native mythology, the reverence for the Storyteller, and the "Chinese box" structure of organization in storytelling itself, etc.) are illustrated by the works of such Native authors as Leslie Marmon Silko and Paula Allen Gunn. Unraveling An Ancient Peruvian Tapestry Sampler: A Study Of Weaver Education In The Ica Valley, Peru, Elizabeth Sara Lewis

Theses and Dissertations

A tapestry from the Ica Valley of Peru (A.D. 900-1476), in the collection of the Virginia Museum of Fine Arts, Richmond, Virginia, is the subject of this study. This thesis is an attempt to demonstrate that the tapestry is an example of a textile form known as a "sampler." Woven as a learning tool and template by an apprentice and an expert weaver within the style and reflecting the iconography of Ica art.

The Social Construction Of Identity In Criminal Cases: Cinema Verité And The Pedagogy Of Vincent Chin, Paula C. Johnson

This article will discuss the use of the film, Who Killed Vincent Chin?, as a method: (1) to analyze the relationship of social constructions of identity, particularly race, on the rules and discretionary application of criminal jurisprudence; (2) to provide an interactive pedagogical tool for law teachers, especially criminal law teachers, to examine the social contexts of criminal jurisprudence from multiple perspectives; and (3) to examine the ability of criminal law doctrine to address issues of race.

Analytical Perspectives On A Protohistoric Cache Of Ceramic Jars From The Lower Colorado Desert, James M. Bayman, Richard H. Hevly, Boma Johnson, Karl J. Reinhard, Richard Ryan

A cache of hermetically sealed ceramic jars found in the Lower Colorado Desert was examined using chronometric dating, pollen and macrofossil extraction, design analysis, and water retention experimentation. The cache apparently dates to the protohistoricfifteenth through seventeenth centuries. Findings from these studies contribute to knowledge in four problem areas: (1) ceramic jar function and use-history; (2) storage technology and caching behavior; (3) ceramic dating and chronology; and (4) symbolic iconography. Biotic remains from inside the jars document their use for transporting a variety of riverine and desert plants, before they were finally filled with flowers and seeds, and placed in …
