This term was found the best time in order to collect the leaf samples At the experimental site pH ranged from 0.77 to 3.16%. Leaf N contents of some orchards were found to be below normal. Once More Into The Maze: United States V. Lopez, Tribal Self-Determination, And Federal Conspiracy Jurisdiction In Indian Country, Richard W. Garnett Jan 1996

Once More Into The Maze: United States V. Lopez, Tribal Self-Determination, And Federal Conspiracy Jurisdiction In Indian Country, Richard W. Garnett

Journal Articles

From the Introduction

This Article may not tie up this loose end to everyone's satisfaction, but it should contribute to a better understanding of federal criminal jurisdiction in Indian Country, through detailed examination of the relevant caselaw, animated by reflection on first principles. Part II lays out a few, very general, "big ideas" concerning the crucial connection between jurisdiction - especially criminal jurisdiction - and community self-determination. Part III provides specific background, and introduces the complicated rubric of federal criminal jurisdiction in general, and of jurisdiction in Indian Country in particular. Part IV examines the possible bases, or "hooks," for …

On Teaching Legal Ethics In The Law Office, Thomas L. Shaffer Jan 1996

On Teaching Legal Ethics In The Law Office, Thomas L. Shaffer

Journal Articles

Edward J. Murphy, my teacher, colleague, and friend, was as devoted as anyone at Notre Dame could be, to a Christian law school on this campus. He announced a personal and institutional claim, and he expressed his hope as well, when he told our graduating law class, in 1994, that this is "a school which publicly and without apology proclaims its religious roots."

And he was as interested as anyone could be in identifying those religious roots, and exploring the implications of them for the practice of law at the end of the twentieth century in the United States of …

The Missing Chinese Environmental Law Statutory Interpretation Cases, John Copeland Nagle Jan 1996

The Missing Chinese Environmental Law Statutory Interpretation Cases, John Copeland Nagle

Journal Articles

Environmental law and theories of statutory interpretation have developed side by side in the United States during the past twenty-five years. Many of the leading environmental law cases are also statutory interpretation cases. China is different. China has enacted many environmental statutes, often patterned after foreign laws such as those in the United States, but there are no Chinese environmental law statutory interpretation cases.

This article examines why there are no such cases, and what we may learn from that fact. I am indebted to the work of Professor Stewart, whose engaging article in this symposium issue combines three of …

Religious Expression In The Public Square – The Building Blocks For An Intermediate Position, Kent Greenawalt Jan 1996

Religious Expression In The Public Square – The Building Blocks For An Intermediate Position, Kent Greenawalt

Faculty Scholarship

The problem of religious expression in the public square is not primarily legal in a narrow sense. We are not talking about whether people are allowed to voice certain kinds of opinions or to vote on certain kinds of grounds. The problem is about how citizens and officials in liberal democracies should act. My own position on this problem is an intermediate one, in a sense I shall shortly explain. Its plausibility depends on some sense of the strengths and weaknesses of positions at each end of the spectrum. I shall begin with a thumbnail sketch of these.

Rationality And The Foundations Of Positive Political Theory, Mathew D. Mccubbins, Michael F. Thies Jan 1996

Rationality And The Foundations Of Positive Political Theory, Mathew D. Mccubbins, Michael F. Thies

Faculty Scholarship

In this paper, we discuss and debunk the four most common critiques of the rational choice research program (which we prefer to call Positive Political Theory) by explaining and advocating its foundations: the rationality assumption, component analysis (abstraction), strategic behavior, and theory building, in turn. We argue that the rationality assumption and component analysis, properly understood, can be seen to underlie all social science, despite the protestations of critics. We then discuss the two ways that PPT most clearly contributes to political science (i.e., what distinguishes it from other research programs), namely the introduction of strategic behavior (people do not …

Pictorial Graphic Organizers, Navigation, And Hypermedia: Converging Constructivist And Cognitive Theories., Cheryl Ann Krawchuk

Graduate Theses, Dissertations, and Problem Reports (ETD)

This study examined differences in cognitive structure, content knowledge, navigational difficulties, and personal interviews between organizer and non-organizer students in a hypermedia environment. This information was used to ascertain the feasibility of using the pictorial graphic organizer as a tool to help alleviate navigational difficulties in a learner-controlled hypermedia environment without imposing structure on the student. Sixty-nine students from an undergraduate course completed a computer questionnaire as well as a pre content knowledge test and a Pathfinder network. They were then exposed to a hypermedia program with the organizer group using a program that contained a pictorial graphic organizer and …

Seeking The Chameleon: The Influence Of Native Rhetoric And The Oral Tradition On Native American Literature, Christine S. Brown Jan 1996

Seeking The Chameleon: The Influence Of Native Rhetoric And The Oral Tradition On Native American Literature, Christine S. Brown

EWU Masters Thesis Collection

This project seeks to explore the impact of rhetoric and the oral tradition on Native American literature by demonstrating that unique features are evident as a direct result of this influence. Characteristics which have functioned to preserve their culture (e.g.; the morphogenetic nature of Native mythology, the reverence for the Storyteller, and the "Chinese box" structure of organization in storytelling itself, etc.) are illustrated by the works of such Native authors as Leslie Marmon Silko and Paula Allen Gunn. The manner in which Native authors have utilized modem technology and the "rhetorical or dialogic style" of writing is emphasized to …

Study And Analysis Of The Water Quality Of The Blackstone River Watershed, Shahriar Mahbub Alam Jan 1996

Study And Analysis Of The Water Quality Of The Blackstone River Watershed, Shahriar Mahbub Alam

Open Access Dissertations

Wet weather water quality of the Blackstone River was analyzed. Three wet weather events were successfully captured for the wet weather program: Storm 1 (September 22-24, 1992), Storm 2 (November 2-5, 1992) and Storm 3 (October 12-14, 1993). Grab samples were collected at specific time intervals throughout the Blackstone River watershed. The concentrations and EMC's (event mean concentration) for different constituents were determined. Two types of violations were compared for fecal coliform in the Blackstone River: log mean > 200 md/100 ml and 10% of samples exceeding 400 md/100 ml. Acute and chronic criteria were compared with the concentrations measured for …

The Cult Of Finality: Rethinking Collateral Estoppel In The Postmodern Age, Laura Dooley Jan 1996

The Cult Of Finality: Rethinking Collateral Estoppel In The Postmodern Age, Laura Dooley

Scholarly Works

What is a fact, and who gets to say what a fact is? These questions lurk beneath and animate the doctrine of collateral estoppel, or (as we modem types say) issue preclusion, in the law of civil procedure. But neither courts nor scholars have faced these basic questions head-on in considering the efficacy of a doctrine that literally exports findings of fact from one case to other unrelated cases. Instead, discussions about collateral estoppel have focused on the "fairness" of applying the doctrine, particularly in terms of the party to be bound by the predetermined fact and whether it had …
