Digitizers and scanners have begun to replace traditional devices for measuring three dimensional objects. However, there is a shortage of relevant research to compare digitizer tools with other measuring devices. The objective of this study was to compare the measurement reliability of a sonic digitizer to a traditional measuring tool, the tape measure, for measuring a complex, three-dimensional object. It was hypothesized that:

  1. H1 Data from measurements with the digitizer vary less than data from measurements with a tape measure at the 0.05 level of significance.

For a long period, it was strongly believed that industrialization was necessary for economic development, and little attention was paid to the possible effects of rapid industrialization on society and environment. Japan was not an exception for this regard. After the Second World War, Japan's economy developed very rapidly, however, this rapid economic growth didn't bring only good side of the story but also the bad side of story. Judicial Boilerplate Language As Torts Decisional Litany: Four Problem Areas In North Carolina, Charles E. Daye

This article discusses four selected examples from the tort law of North Carolina. These examples isolate instances in which the result of a case might not have warranted the language used or when the language of the cases was picked up and carried forward in subsequent cases without adequate analysis. Perhaps attorneys can point out these problems to the courts, and perhaps the courts might choose to make helpful clarifications.

Part I of this article examines the contributory negligence doctrine and its history in the United States and North Carolina. Part II describes some of the criticism levelled at the contributory negligence doctrine. Part III examines the comparative negligence doctrine, including a-description of the types of comparative negligence systems, a history of the doctrine, and a look at the history of comparative negligence bills in the North Carolina General Assembly, concentrating on the several comparative negligence bills introduced in the 1980s and one of the principal arguments made against the bills. Attribution theory has been reformulated repeatedly over the past 40 years. Seven of the major theories of attribution are discussed in this paper, as well as five attribution assessment instruments. A brief overview of learning strategy instruction is provided also. Based on a review of eleven major school psychology training textbooks and the past five and one half years of major school psychology journals, it was hypothesized that educational professionals have little knowledge, experience, and skills in attribution assessment and intervention. 1996 marks the fiftieth anniversary of the commencement of the trial of Nazi physicians at Nuremberg, a trial that has been variously designated as the "Doctors' Trial" and the "Medical Case." In addition to documenting atrocities committed by physicians and scientists during WWII, the most significant contribution of the trial has come to be known as the "Nuremberg Code," a judicial codification of 10 prerequisites for the moral and legal use of human beings in experiments. Two experiments were conducted to examine the effects of patterns of follicular development on fertility in beef cows. In Experiment 1, effects of persistent follicles (PF) on recovery of embryos, fertilization, and embryonic development were examined. PF cows (n = 20) received a low dose of progesterone, intravagianally on Days 4-13 after pretreatment estrus (Day 0) and two injections of 20 mg prostaglandin (PG) F{dollar}\\sb{lcub}2\\alpha{rcub}{dollar}, on Day 6. Cows with growing follicle (GF; n = 22) received only PGF{dollar}\\sb{lcub}2\\alpha{rcub}{dollar} on Day 6. Follicular development was monitored by ultrasonography. Mean estradiol-17{dollar}\\beta{dollar} (E{dollar}\\sb2{dollar}) in plasma during six days before estrus was higher …

This Article provides a framework for reconciling the tension between tort doctrine and economic theory, and for addressing the general failure of economically oriented theories to come to grips with doctrine at a detailed level. My claim is that tort doctrine should be viewed as a response to the incompleteness of markets, or more generally the problem of missing markets. Because of market incompleteness, some of the benefits as well as costs associated with activities will be shifted or "externalized" to third parties. Tort doctrine reflects sensitivity to the externalization of benefits and costs. It can therefore be understood only …

Important scientific discoveries in the field of human genetics have been reported in the nation's major newspapers since the beginning of the decade, and these discoveries have given rise to a multi-billion dollar industry. Mr. Malinowski and Professor O'Rourke explore the impact of federal policy on the field and the resulting industry. They argue that federal policy in support of genetics research and development has not been followed by the introduction of regulatory and health policy necessary for the efficient and responsible commercialization of the industiy's products. Against Market Rationality: Moral Critiques Of Economic Analysis In Legal Theory, Jane B. Baron, Jeffrey L. Dunoff

Sometimes, apparently unrelated bodies of thought turn out to contain and express common themes. To our surprise, we found a set of common themes and concerns running through three bodies of theory that might otherwise appear unconnected: environmental ethics, civic republicanism, and commodification. In very different contexts, authors in all three areas seemed to ask some very similar questions. Collected together, these questions comprise a novel critique of the economic analysis of law-a "moral" critique that is quite different from technical and distributional critiques that have been offered in the past.

In this speech to be given on November 15, 1996, as the American contribution to the week-long conference on administrative law sponsored by the Fundaci6n Estudios de Derecho Administrativo in Caracas, Venezuela, Professor Peter L. Strauss addresses the history and developing political character of rulemaking in federal law over the fifty years since enactment of the Administrative Procedure Act. As a framework, Professor Strauss sets forth a hierarchy of institutional rulemaking, from constitution through informal advising. In early October 1995, Walter Gellhorn helped to open a National Archives display commemorating the fiftieth birthday of the Administrative Procedure Act ("APA"). That Act had begun to take shape just prior to World War II, when Gellhorn had directed the Attorney General's Committee on Administrative Procedure. Created in response to a political spasm of legislative activity that produced a "reform" bill President Roosevelt vetoed, Gellhorn's committee engaged in a thorough and careful survey of administrative agencies and their procedures. Intraspecific Life History Variation In Sceloporus Undulatus: A Factor Analysis, Geoffrey R. Smith, John W. Rowe, Royce E. Ballinger

Transactions of the Nebraska Academy of Sciences and Affiliated Societies

We examined life history variation in the lizard, Sceloporus undulatus, across its range. Data from published studies on 14 populations of S. undulatus were analyzed using factor analysis. Four factors were generated from the data. Factor 1 reflected the influence of body size on lizard life histories and explained 31% ofthe variance in S. undulatus life histories. Factor 2 represented the negative relationship of relative clutch mass and number of clutches per year and explained 17% of the variance. The third factor had strong positive loadings of egg mass, age at maturity, and adult survivorship, with a weaker negative …

A New Genus Of Prairie Dog (Sciuridae, Rodentia) From The Miocene (Barstovian Of Montana And Clarendonian Of Nebraska) And The Classification Of Nearctic Ground Squirrels (Marmotini), William W. Korth

Transactions of the Nebraska Academy of Sciences and Affiliated Societies

A new genus of sciurid, Cynomyoides, is named. The new genus includes a new species from the late Clarendonian of Nebraska, C. vatis (type species), and an unnamed species from the early Barstovian of Montana. The dental and mandibular morphology of Cynomyoides is reminiscent of that of the latest Tertiary to Recent prairie dog Cynomys and is believed to be part of the lineage leading to Cynomys. The recognition of a Miocene genus of prairie dog extends the known record of these ground squirrels well back into the Tertiary and makes it much less likely that Cynomys was …

During the Spring Semester of 1995-96, a large introductory- level geology class, Life of the Past, was re-structured from a traditional lecture format into a format that incorporated journaling, group work, cooperative learning, group presentations, self-assessment, and lectures. Some minor adjustments were made at the half-way point because of suggestions made on mid-semester evaluations. Based on a questionnaire distributed to randomly-selected former students, the overall class performance, and the final class evaluation, the new format was judged highly successful.
