Although recent debates would suggest that narrative scholarship is brand new,4 lawyers, judges, and law professors, like all humankind, have always offered stories for illustration or support or to make a point in an indirect, and often more effective, way. Learned Hand's story about telling Justice Holmes to "do justice" is one widely-used example, offered by many writers in addition to Judge Bork and Professor Chayes. Its popularity is easy to understand. Civil Forfeiture And The War On Drugs: Lessons From Economics And History, Donald J. Boudreaux, A. C. Pritchard

San Diego Law Review

This Article uses economic analysis to show how civil forfeiture’s role in the war on drugs creates contrary incentives for law enforcement officials and encourages abuses. The Article then reviews the history of civil forfeiture and the Supreme Court’s forfeiture jurisprudence, which seems incoherent. The Authors warn that the judiciary should be skeptical of civil forfeiture and its importance to the war on drugs. The Article proposes a constitutional framework, grounded in economics and history, to limit forfeiture abuses.

Doctrinal Classification And Economic Negligence, Jay M. Feinman

This Article discusses the nature of doctrinal classifications and some of the problems rising in third-party cases due to the distinction between tort and contract. These cases can best be understood by recognizing an emerging field of law known as economic negligence. Economic negligence concerns the liability of a contracting party to a third person for negligent performance of a contract. The Author concludes by explaining how the recognition of this field of law addresses the problems that arise from the traditional classification.

Constitutional Architecture: The First Amendment And The Single Family House, John Nivala

This Article argues that the exterior design of a private single-family house is a First Amendment-protected expression for the inhabitants. The exterior design of the single-family house speaks on behalf of the inhabitants, expressing who they are and how they choose to live. The Article explores the genesis of aesthetic regulation and its threat to First Amendment values. Any municipality that applies aesthetic standards to regulate this expression must justify the regulation by establishing a substantial governmental interest. The interest must be advanced by the application of narrowly and clearly defined standards.

National Extension program information systems focused on Federal needs have been plagued by severe data acquisition problems. These problems may re-occur in a new national program information system which is to include Extension. This new system is being developed in response to the Government Performance and Results Act. To overcome potential data acquisition problems, state and Federal program staffs must collaborate in building mutually relevant, valid, complete, databases for national Extension programs. Habitat Affinities Of Bats From Northeastern Nevada, Mark A. Ports, Peter V. Bradley

Bat surveys were completed in 6 habitat types in eastern Nevada between 1980 and 1994. Twelve species of bats and 578 individuals were identified from 33 trap localities in 144 trap nights. There were weak correlations between bat species richness and January maximum temperatures (0.728, P < 0.05) and mean annual days with 0° C or lower (−0.704, P < 0.05). Bat species richness exhibited no correlation with annual normal precipitation, January minimum temperatures, July minimum temperatures, and July maximum temperatures. It appears that bat species richness is highest in portions of northeastern Nevada typified by sedimentary deposits (limestone, dolomite). Igneous mountain ranges (basalt, volcanic ash) generally had moderate bat species richness, and metamorphic ranges (quartzite) typically had low bat species richness. Notable range extensions include Antrozous pallidus (from central Nye County north to the Nevada-Idaho border, approximately 450 km), Tadarida brasiliensis (approximately 350 km north), and Pipistrellus hesperus (approximately 350 km north). Also, the presence of Lasionycteris noctivagans, Lasiurus cinereus, and Corynorhinus townsendii was confirmed.

Consumption Of Diffuse Knapweed By Two Species Of Polyphagous Grasshoppers (Orthoptera: Acrididae) In Southern Idaho, Dennis J. Fielding, M. A. Brusven, L. P. Kish

Consumption of diffuse knapweed (Centaurea diffusa Lam.) by 2 polyphagous grasshopper species, Melanoplus sanguinipes (F.) and Oedaleonotus enigma (Scudder), was studied using microhistological analysis of grasshopper crop contents. Grasshoppers were confined to cages containing C. diffusa and Sisymbrium altissimum L., a member of the mustard family known to be readily eaten by these 2 grasshopper species. Preference indices for knapweed were lower than for S. altissimum in 4 of 5 trials. An uncaged population of M. sanguinipes on a knapweed-infested site consumed only small amounts of knapweed until late summer when most other plants were senescent. Results suggested that …

We surveyed historic collecting localities in south central Arizona during July, August, and September 1993–94 to determine the presence of 3 little-known Sonoran Desert anurans, Bufo retiformis, Gastrophryne olivacea, and Pternohyla fodiens. All 3 species were present at most historic localities visited under appropriate conditions (following rainfall in July and August). Pternohyla fodiens was restricted to San Simon Wash and associated tributaries in south central Pima County. Gastrophryne olivacea ranged from Vekol Valley in extreme southern Maricopa County south to the Mexican border, and southeast near Tucson and Nogales in Pima and Santa Cruz counties. The Effects Of Chromated Copper-Arsenate (Cca) Pressure-Treated Wood On Local Sediments And Benthos In A Freshwater Lake, William A. Romeo

This study looked at the sediment and benthic organism effects of exposure to a Chromated Copper-Arsenate (CCA) treated wood bulkhead in a lake environment with respect to 1) the leaching and accumulation of chromium, copper and arsenic in the nearby sediments, 2) accumulation of these metals in local benthic organisms and 3) the effects of these metals on the local benthic community structure. Sediment samples, taken at regular distances away from a CCA bulkhead and three reference areas in a freshwater lake in Wayne, NJ, were sieved to remove the fine particle fraction (<70µm) which was then analyzed for the metals of concern. Benthic organisms were sampled at the same locations, enumerated, identified, dried and also analyzed for the metals in question. Analysis of sediment metal concentrations revealed high levels of copper at all sampling locations. This was attributed to the annual addition and accumulation Of CuS04 added to the lake. There …

Many cooling systems of metal cutting and both their advantages and disadvantages have been reviewed. The cutting forces' relationships, stress distribution, energy consumption and heat generation of orthogonal processes are discussed. A two-dimensional finite element model has been developed to design and analyze a new proposed cooling device, which comes from the idea of "A Novel Cooling Device" proposed by Billatos et al. First, a thermal calculation is completed to compare the temperature difference between two different shapes of coiled pipe. The time-depth of the Romance language family (ca. 2,000 years) yields an abundance of similarities among languages descended from Latin: Spanish, French, Italian, and so forth. The time-depth of Lehi is not much greater (2,600 years), yet no similar abundance of accepted linguistic evidence for Lehi’s presence in the Americas has emerged. Is this because of a lack of evidence or a lack of looking? We cannot know until we look. Positivist historiography has always maintained an impermeable boundary between history and literature. But positivism is itself a historical sediment whose time is now past. Recent literary theory and historiography emphasize the continuities between history and literature. Under the domination of historiography by a positivist epistemology (from about 1880 to 1960), history attempted to free itself from its literary heritage. More recently theorists from a number of disciplines have recognized that history, both ancient and modern, has been informed by literary motifs, themes, and strategies. Nuptial, Pre-, And Postnuptial Activity Of The Thatching Ant, Formica Obscuripes Forel, In Colorado, John R. Conway

Great Basin Naturalist

Observations and excavations of thatching ant nests from 1990 to 1994 at 2560 m in Colorado provided information on the numbers and behavior of males and winged and wingless queens. Nuptial activity was compared to that reported by other investigators at lower altitudes. Reproductives were observed from 24 June to 15 August. Activity was greatest in 1993 when reproductives were on 10 of 98 mounds in the area. Mating and swarming occurred on rabbitbrush 4 m from 1 nest 2–6 July. The number of wingless queens in 4 excavated nests varied from 0 to 198.

Productivity, Food Habits, And Associated Variables Of Barn Owls Utilizing Nest Boxes In North Central Utah, Sandra J. Looman, Dennis L. Shirley, Clayton M. White

Productivity and food habits of the Barn Owl (Tyto alba) utilizing nest boxes in Juab, Utah, and Salt Lake counties, Utah, During 1979–1984 were examined. Average clutch size was 5.8 eggs for the 6-yr period; mean number fledged was 3.9 young per successful nest. While severe weather during the 1981–82 winter did not result in significant decrease in productivity during the 1982 breeding season, it may have resulted in a significant overproduction of female young. Barn Owls in north central Utah fed almost exclusively on mammalian species, particularly Microtus spp. Difference in clutch size between areas and years …

Temporal And Spatial Distribution Of Highway Mortality Of Mule Deer On Newly Constructed Roads At Jordanelle Reservoir, Utah, Laura A. Romin, John A. Bissonette

In this paper we evaluated traffic characteristics and vegetation and topographic features associated with mule deer kills on 3 highways (US 40, SR 32, SR 248) in northeastern Utah. We also compared number, and sex and age composition of roadkills to that of the living population observed during spotlight counts. From 15 October 1991 to 14 October 1993 we documented 397 deer roadkills: 51.6% were does, 18.9% bucks, 21.7% fawns, and 7.8% could not be classified. Sixty-seven percent of adult kills were ≤2.5 yr of age. Kill composition compared closely to spotlight counts. Of 1515 spotlight deer, 65.2% were does, …
