One Way To Be Born? Legislative Inaction And The Posthumous Child, Karin M. Mika

Law Faculty Articles and Essays

This article argues that the posthumous child and the rights and responsibilities relating to such a child are directly related to the fundamental right to procreate. It argues that legislation must necessarily incorporate that right in sorting out issues related to the posthumous child and deviate from the standard principles of contract laws which have been applied in the past. This article examines the history, case law, federal decisions, and current legislation pertaining to artificial insemination. It argues that such legislation is inadequate and that legislatures must act promptly to address the realities of the posthumous child.

Herod the Great, although remembered principally in Christian circles for his slaughter of the infants as stated in Matthew's gospel, also left his mark on the world's memory as an ambitious builder. Herod finally consolidated power in 37 B.C. and immediately began an extensive building program—one perhaps unequaled in the history of ancient Israel. Ehud Netzer declares that "Herod the Great's building projects in W Palestine constitute the most prominent in the country, for any single specific period or personality." Robbers, bandits, zealots, Sicarii, and other groups operating outside of normal legal channels were prominent features on the political landscape in and around the Roman province of Judea in the first century. To an extent, the Jewish insurgents who died at Masada can be viewed as robbers or bandits within the ancient meaning of those terms. Among the artifacts uncovered during the archaeological excavation at Masada was a terra-cotta pot with these words written on it: macaser kôhēn, "priestly tithe." It is reminiscent of a Herodian-period stone vessel fragment unearthed near the temple mount in Jerusalem, inscribed with the word qorban, "sacrifice." The Herodian vessel fragment also depicts two birds, perhaps indicating that it was used to present doves or pigeons in sacrifice at the temple as specified in Leviticus 12:8. Mishnah Macaser Sheni 4.10-11 mentions vessels inscribed with qorban or its abbreviation, q, and notes that among the …

During the last fifty years, the Judean Desert on the western shore of the Dead Sea has yielded a wealth of textual material from many locations, evidence that has illuminated our understanding of the history of Israel and Judaism in the two centuries preceding and the two centuries following Christ. All of these manuscripts are properly referred to as the Dead Sea Scrolls.

Ecosystem Management And The Everglades: A Legal And Institutional Analysis, Thomas T. Ankersen, Richard Hamann

Three dominant themes can be distilled from ongoing efforts to identify a set of generic principles to guide the management philosophy known as ""ecosystem management."" These include: (1) the notion of boundaries, both geographical and institutional; (2) scientific uncertainty; and (3) governance. This article analyzes the manner in which the present legal and institutional framework for environmental management addresses these themes.

Part II identifies the problems inherent in defining the appropriate management unit for ecosystem management and in delineating the unit's boundaries in the face of inherently complex and unstable ecological factors. Part II also considers the more insidious institutional …

A village rumor concerning the attempted theft of a uniform from the corpse of a Sri Lankan army soldier supplies the subject matter for this paper. In May 1993, soon after the assassination of President Ranasinghe Premadasa, a spectacular local funeral for a Low Country Sinhalese soldier killed in the civil war near Trincomalee provided a space for the display of state symbols, the voicing of patriotic rhetoric, and the exhibition of the precision and discipline of the national army. Military pageantry legitimated the use of force by the government, while the funeral ritual as a whole produced a catharsis …

Over the last decade, numerous experimental and numerical analyses have been conducted to investigate the stress distribution between the residual limb and prosthetic socket of persons with lower limb amputation. The objectives of these analyses have been to improve our understanding of the residual limb/prosthetic socket system, to evaluate the influence of prosthetic design parameters and alignment variations on the interface stress distribution, and to evaluate prosthetic fit. Now more than a hundred years old, the federal antitrust laws seek generally to promote and preserve business competition. Over the past twenty years, courts and regulatory agencies have applied this broad goal in a narrow economic sense, defining "competition" not as rivalry, for example, but as those forms of business activity most conducive to "consumer welfare." Consumer welfare, in this sense, is thought to be maximized when markets produce the greatest output of goods or services at the lowest prices with the widest range of consumer choice. Compassion In Dying V. Washington: A Resolution To The "Jurisprudence Of Doubt" Enshrouding Physician-Assisted Suicide?, Stephen J. Tyde Jr.

By affirming a district court decision holding Washington's criminal prohibition of assisted suicide unconstitutional, an en banc Ninth Circuit in Compassion in Dying v. Washington reversed a three judge panel decision and proffered the most reasoned and carefully drafted opinion yet in the battle surrounding terminally ill patients and their quest to legally pursue physician-assisted suicide. Three terminally ill patients, five physicians who treat terminally ill patients, and Compassion in Dying, an organization that provides counseling and assistance to mentally competent, terminally ill adults considering suicide, challenged the statute under the Due Process and Equal Protection Clauses of the Fourteenth …

Science plays a major part in environmental conflict. How that role is defined is determined by the human actors engaged in the conflict and the legal and institutional constructs that structure discourse. This article begins by tracing the authority invested in science to ideological assumptions about scientific methodology. Then, four common roles for science in environmental conflict (discoverer, mechanism of accountability, shield, and toql of persuasion), are described. These roles are increasingly unproductive in resolving environmental conflict, partly due to the misfit between the actual conduct of science and its ideal. Impact Of A Parasitic Plant On The Structure And Dynamics Of Salt Marsh Vegetation, Steven C. Pennings, Ragan M. Callaway

We investigated the effect of a native parasitic plant, Cuscuta salina, on the structure and dynamics of the plant community in a California salt marsh. Cuscuta was common in the middle marsh zones. The abundance of Cuscuta was positively correlated with the abundance of Limonium californicum at two sampling scales (0.25— and ≈\approx40—m2 quadrats). Sampling at the scale of individual plants indicated that the dominant plant in the marsh, Salicornia virginica, was preferred by Cuscuta as a host over Arthrocnemum subterminale, Limonium californicum, and Frankenia salina. The purpose of this study was to examine how undergraduate students interpret the items on a faculty evaluation instrument. Most research on faculty evaluation is quantitative (Marsh and Bailey 1993). Our first study was also quantitative. After we produced a profile of quantitative ratings of faculty by students across all departments in our university in an earlier study, we wanted to go beneath the numbers to their meaning. We designed the present qualitative study to investigate what the items on that form meant to students.
