Restatement Redux, Anita Bernstein

Vanderbilt Law Review
American products liability buffs, who often have a predilection for history, may remember 1994 as a year of proclaimed harmonization, codification, and restatement. In April 1994 the American Law Institute released the first Council Draft of its Restatement (Third) of Torts: Products Liability. According to the Institute, "[p]roducts liability is highest in priority for reformulation" within the law of torts generally, "for it is socially important and technically complicated."' During the same year, the Republican party announced a Contract With America that promised national reform of products liability; after the November election, the new congressional majority attended promptly to the …

Their Finest Hour: Lawyers, Legal Aid And Public Service In Illinois, Joseph A. Dailing
Northern Illinois University Law Review
This article details the history of the provision of free legal services for the poor. Advocates of the governmentally-funded Legal Service Corporations (LSC) have encountered numerous obstacles and endured ferocious attacks from opponents. At times it appeared that the entire LSC program was in jeopardy. The author recounts the establishment of the LSC program in Illinois, summarizes the LSC's many accomplishments, and outlines the challenges that the Illinois legal community will face in continuing to offer legal services to the impoverished of our state.

Back To The Briarpatch: An Argument In Favor Of Constitutional Meta-Analysis In State Action Determinations, Ronald J. Krotoszynski Jr.
Back To The Briarpatch: An Argument In Favor Of Constitutional Meta-Analysis In State Action Determinations, Ronald J. Krotoszynski Jr.
Michigan Law Review
Brer Rabbit, after claiming repeatedly that he would prefer almost anything to being thrown into the briarpatch, expressed glee once tossed there. In fact, Brer Rabbit wanted to be in the briarpatch because, like most rabbits, he could navigate the briarpatch with relative ease: the briarpatch was home.
Over the course of a century, the Supreme Court has developed a great degree of familiarity with the state action doctrine, a doctrinal briar patch. Like Brer Rabbit, the Court has disclaimed repeatedly any interest in being there.
In this article, I argue that the existing tests for establishing the presence of …

The study examines the economic importance of Los Alamos National Laboratory (LANL) to the economies of Los Alamos, Rio Arriba, and Santa Fe Counties and evaluates the potential consequences of defense-related downsizing. Prepared by the University of New Mexico Bureau of Business and Economic Research, the study was undertaken during a period of declining federal defense expenditures and growing concern regarding the future role of national laboratories. Using socioeconomic profiling, regional economic analysis, business and community surveys, and econometric modeling, the report assesses the region’s economic strengths and weaknesses, measures LANL’s direct, indirect, and induced economic impacts, and estimates the …

The report provides a comprehensive socioeconomic and economic‑impact assessment of Los Alamos National Laboratory (LANL) and its surrounding TriCounty region—Los Alamos, Rio Arriba, and Santa Fe Counties. The study examines regional demographic and economic conditions, evaluates structural strengths and weaknesses, and quantifies LANL’s direct, indirect, and induced economic contributions, including employment, payroll, business activity, and tax impacts. It also analyzes two defense‑downsizing scenarios, incorporating business surveys and early‑retiree data to assess regional adjustment capacity.

The Lawyer's Moral Obligation Of Justification, Monroe H. Freedman
Hofstra Law Faculty Scholarship
In his eloquent apologia, Defending,' Professor Michael Tigar joins other celebrated criminal defense lawyers, like Clarence Darrow and Edward Bennett Williams, who made a particular effort to explain publicly their essential role in the American system of justice. This role includes representing not just the despised but the despicable, not just the damned but the damnable. Perhaps the only lawyer who was able to earn a universally good reputation as a zealous defense lawyer by representing only an innocent defendant was Atticus Finch-and he, of course, was fictitious.
