Social Welfare Policy In The American States: The Case Of Afdc., Sung Chul Kim

This dissertation is divided into two main parts. The first part presents an intergovernmental model of the Aid to Families with Dependent Children program, focusing on program benefits and eligibility criteria. The second part explores the impact of state political institutions--the governor, the state legislature, and the state bureaucracy--on AFDC policy outcomes. There has been a great deal of research on the structure and operations of intergovernmental programs in the United States (Beam et. al. 1983; Dilger 1989). There have been relatively few research efforts, however, that attempt to differentiate the relative impact that federal, state, and local government officials …

This Article addresses the problems faced by immigrant workers on Long Island. Part I briefly examines the transition on Long Island from an economy based on manufacturing to one based on services, as well as the growth of the underground economy. Part II addresses the failure of government agencies, legal services centers, and unions to confront the problems faced by immigrant workers in this period of economic transition. Part III presents the Workplace Project model as an alternative to those institutions. Part IV offers a critique of the Project, focusing on the conflict between providing individual legal representation and organizing …

Legal change – like organic evolution – can occur at varying paces. Long periods of gradual evolution are sometimes punctuated by brief moments of rapid, irregular change. Recent developments in class action practice bear witness to this phenomenon: during the 1990s, evolution has given way to mutation. At least with respect to mass torts, the development of the class action had been slow and halting. Well into the 1980s, federal courts uniformly resisted attempts to certify such mass tort class actions, largely out of concern that the interests of the individual litigant would be submerged within any large-scale proceeding. Indicted on serious narcotics charges, Jose Lopez retained Barry Tarlow to “vigorously defend and try the case.” Tarlow was up to the task but warned Lopez that it was “his general policy not to represent clients in negotiations with the government concerning cooperation,” and that he did not plan to make any exception for Lopez. As Tarlow later explained, he found such negotiations “personally[,] morally and ethically offensive.” This arrangement suited Lopez just fine, until he wavered in his resolution. This Symposium marks an important milestone in legal scholarship and education: The spotlight falls on business lawyers for a change. Ten years ago, when one of us first wrote about what business lawyers really do, no one had devoted much attention to this part of the profession. In his broadside against lawyers, Derek Bok, then President of Harvard University and formerly dean of its law school, reserved his invective for litigators and the litigation process. This article explores the concept of peer review in the practice of law. The article begins with an introduction to law partners’ liability exposure for the acts or omissions of their law partners. The article explains how this exposure has traditionally been approached as vicarious liability and how the government is attempting to transform these issues into direct liability by using failure to monitor claims. Part I briefly reviews perspectives on the emergence, growth, and structure of law firms, then uses a matrix to show how firm culture and organizational structure affect internal and external controls on attorney conduct. In order to revisit the application of conflict of interest principles to legal services practice, this article employs a survey of legal services providers. In addition to setting a context for discussion by determining the nature of the conflicts most frequently encountered by legal services offices, the survey resulted in two significant findings. First, the legal services client who is denied representation due to a conflict of interest most often is left without any source of representation. Second, the conflicts that most frequently lead to the denial of representation of the indigent client often do not involve any actual prejudice …

The Federalization Of Oragnized Crime: Advantages Of Federal Prosecution, John C. Jeffries Jr., John Gleeson

Discussions about the federalization of crime traditionally have focused on substantive law: a crime will be handled in a state system or in the federal system depending on its definition. While it is true that federal and state crimes appear to have different coverage, federal criminal jurisdiction is fast becoming the rule rather than the exception. It follows that the federalization of crime is increasingly in the hands of federal prosecutors. Thus, informed debate on the respective state and federal roles in law enforcement should focus on the prosecutive function.

Economic Theory Applied To Civil Forfeiture: Efficiency And Deterrence Through Reallocation Of External Costs, Catherine Cerna

Punishment for drug crimes includes not only penal sanctions, but economic sanctions in the form of property forfeiture as well. Based on broad statutory language, the government appears to seize property in amounts disproportionate to the crime committed. The author contends that forfeiture lacking proportionality risks violating the Eighth Amendment's prohibition of "excessive fines" and distributes wealth in an economically inefficient manner.
The United States Supreme Court mandated an Eighth Amendment proportionality inquiry in civil forfeiture cases in the 1993 case of Austin v. United States. This Note proposes that courts imposing forfeiture abide by this mandate by engaging in …
