Institutions And Linguistic Conventions: The Pragmatism Of Lieber's Legal Hermeneutics, Guyora Binder
Institutions And Linguistic Conventions: The Pragmatism Of Lieber's Legal Hermeneutics, Guyora Binder
Journal Articles
This article presents Francis Lieber’s 1839 treatise “Legal and Political Hermeneutics” as a surprisingly modern and pragmatic account of interpretation. It first explicates the two most important influences on Liber’s thought, the romantic philology of Friedrich Schleiermacher, and the institutional positivism of Whig jurists Story and Kent. It shows that both of these sources frankly acknowledged that interpretation is an institutional practice, organized by the evolving aims and customs of the institutions within which it took place. Both tended to view the writing and reading of texts as the deployment of linguistic conventions. Both movements thereby viewed meaning for all …

Institutions And Linguistic Conventions: The Pragmatism Of Lieber's Legal Hermeneutics, Guyora Binder
Cardozo Law Review
Like many other forms of social thought, legal theory has, over the last quarter century, taken an "interpretive" turn. Recent and contemporary writing on legal hermeneutics may be credited with two sensible but unsurprising claims about legal language.
Lost In The Fifties: A Study Of Collected Memories, Janelle L. Wilson
Lost In The Fifties: A Study Of Collected Memories, Janelle L. Wilson
Dissertations
This is a study of ordinary people's recollections of the decade of the nineteen fifties. The theoretical concepts of collective memory and collected memories guide design and analysis. Unstructured interviews with 33 individuals who grew up in America in that decade were conducted. The snowball method identified potential informants. The data from these interviews, combined with secondary sources on that time period, served to reconstruct this decade. A number of themes emerged from the data; the decade was seen: as an apolitical time, as fun and innocent, as fearful with respect to atomic weaponry and Communists, as problematic for race …

Resiliency In Children: Identifying And Nurturing Coping Skills Through Outpatient Mental Health Services, Sharon Michel
Theses and Graduate Projects
Resiliency is the ability to adapt successfully despite living in adverse conditions. It involves negotiation between risk and protective factors. Researchers have found that resiliency is not necessarily constant but rather contextual. Therefore, characteristics of resiliency, once identified, can be nurtured and to some extent taught. This research study attempts to identify characteristics of resiliency in children who are brought to an outpatient mental health center for behavioral difficulties and assess whether treatment services nurture such characteristics Problem and competence scales were collected from the parents about their children at intake and again for this study. A comparison was made …

A Decision Model For Environmental Assessment Of Process Waste Products, Kyle F. Byard
A Decision Model For Environmental Assessment Of Process Waste Products, Kyle F. Byard
Theses and Dissertations
Environmental managers must compare the potential impacts of waste products when deciding upon courses of action. The estimation and comparison of these impacts is a subjective process, and few methods of comprehensive, quantitative comparison of waste products currently exist. The intent of this study is to develop a decision methodology to evaluate the environmental impacts of waste products and to score them for comparison. The method will follow established system design principles and incorporate significant characteristics of the waste material. Scores derived to represent the environmental impacts of materials will then he analyzed employing statistical and probabilistic methods to assess …

Sustainable Development In Sub-Saharan Africa: Strategies For Self-Help In Food Production, Case Study Of Kenya, Dieudonne Mayi
Sustainable Development In Sub-Saharan Africa: Strategies For Self-Help In Food Production, Case Study Of Kenya, Dieudonne Mayi
Dissertations and Theses
This thesis analyses the food crisis in sub-Saharan Africa in the 1980s and 1990s, identifies roots of the problem, and proposes strategies of sustainable development based on self-sufficiency in food production for domestic needs. The main goal of this research has been to devise development strategies centered on development of the food production sector. The thesis strongly suggests that countries of the region should consider developing the food production sector to experience any meaningful development, and to escape a dark future of food shortages and food dependency on developed economies. Investigation into Development Economics, Dependency, Underdevelopment, and Modernization theories has …
