Voices In The Storm: Confederate Rhetoric, 1861-1865., Karen Elizabeth Fritz Jan 1995

Voices In The Storm: Confederate Rhetoric, 1861-1865., Karen Elizabeth Fritz

LSU Historical Dissertations and Theses

From 1861 to 1865, as white southerners waged their unsuccessful struggle for independence, they experienced shattering calamities. With the Civil War mostly fought on southern soil, Confederates witnessed the destruction of their environment, the deaths of their friends and family members, and the demise of their slave labor system. This study concerns the effects of this experience on the southern mindset. In short, this is an examination of discovery and transformation through ordeal. The Confederacy has been the subject of many a historical study. However, this interpretation approaches the subject from a slightly different perspective. Departing from the traditional reliance …

Encoding Imperialism: Homelessness In American Naturalism, 1890-1918., Janet M. Whyde Jan 1995

Encoding Imperialism: Homelessness In American Naturalism, 1890-1918., Janet M. Whyde

LSU Historical Dissertations and Theses

Homelessness occurs with uncommon regularity in the works of American naturalists, and in each case, the result of a character's homelessness results in a crisis of social identity and self definition. This pattern recurs in the works of the canonically identified naturalists, such as Stephen Crane, Frank Norris, and Theodore Dreiser, as well as other writers who have only been tangentially associated with naturalism--Edith Wharton and Paul Laurence Dunbar, for example. In this study, I analyze the relationship between homelessness as it is represented in the novels and the political debate over the United States's imperialist aspirations at the turn …

Redefining Maroon Heritage In The New World Studies, E. Kofi Agorsah Jan 1995

Redefining Maroon Heritage In The New World Studies, E. Kofi Agorsah

Black Studies Faculty Publications and Presentations

Evidence from recent archaeological studies appear to suggest a redefinition of the heritage of runaway slave communities, referred to by the name Maroons and other terms. Now properly defined as the pioneer freedom fighters, it is also becoming clear that their heritage is a single constant strand in that of the New World. Contrary to previous views and descriptions which appear to indicate that these communities derived only from African slave escapees, historical and archaeological evidence from the Caribbean, and the Americas now reveal that the heritage of Maroon communities stemmed from the united force forged by between native American …

Change In Seventh-Day Adventist Theology: A Study Of The Problem Of Doctrinal Development, Rolf J. Pöhler Jan 1995

Change In Seventh-Day Adventist Theology: A Study Of The Problem Of Doctrinal Development, Rolf J. Pöhler

Dissertations

Problem. Like other churches, Seventh-day Adventists face the challenge of harmonizing the essential immutability of revelation in Christ and what seem to be significant doctrinal modifications. This study provides the first in-depth treatment of the intricate problem of doctrinal development from a Seventh-day Adventist perspective.

Method. Chapter 1 defines the problem, chapter 2 offers a historical-genetic survey of proposed solutions, while chapter 3 presents a systematic-typological analysis of possible responses to doctrinal change in Christian theology.

Chapter 4 investigates the extent, nature, and direction of Seventh-day Adventist doctrinal developments in the light of the religious background of the church and …

Introduction To Another Voice: Educational Life- Writing As Responsible Text, Elizabeth K. Johnson, Lucy F. Townsend Jan 1995

Introduction To Another Voice: Educational Life- Writing As Responsible Text, Elizabeth K. Johnson, Lucy F. Townsend

Mid-Western Educational Researcher

Good educational biography serves to humanize both historical actors and the past itself. It gives readers a sense of real people involved with real issues in a complex world. If done with sensitivity and skill, educational biography provides us with knowledge, insight and understanding, elements that are always in short supply (Beauchamp, 1980, p. 4).

Book Review: Rethinking The American Constitutional Tradition: National Dimensions In The Formulation Of State Constitutions, Christian G. Fritz Jan 1995

Book Review: Rethinking The American Constitutional Tradition: National Dimensions In The Formulation Of State Constitutions, Christian G. Fritz

Faculty Scholarship

Founding the Far West is an important scholarly contribution to nineteenth-century American history. However, its analysis of how California, Oregon, and Nevada became states identifies a dynamic that fails to capture the tradition of American constitution-making. Only when state constitution-making is more widely studied can the dimensions of that tradition be understood in ways that will integrate the meaning of the state constitutional experience. So too, the recent interest in state constitutions as documents having an independent source of constitutional authority may curb the ingrained habit of studying American constitutional law from "the top down" and encourage scholars to bring …

Voluntary Environmental Disclosure By Australian Listed Mineral Mining Companies : An Application Of Stakeholder Theory, Y. B. Hutomo

Theses: Doctorates and Masters

The purpose of this study was to examine the extent of voluntary environmental disclosure in relation to firm-specific characteristics of listed mineral mining firms within the stakeholder theory framework developed by Ullmann (1985). Three indices, word index, unweighted index and weighted index, were applied to measure the extent of total environmental disclosure and categories of total disclosure, which were environmental policy and strategy, public recognition of environmental activities, prevention or repair of environmental damage and environmental liabilities. A sample of 104 mineral firms was selected from the Australian Graduate . School of Management Annual Report Microfiche File for 1993. The• …

The Woman In The Dock Is A Monster: An Investigation Of Female Criminality In The Hearings Of The Perth Supreme Court, 1890-1914, Debra A. Fletcher Jan 1995

The Woman In The Dock Is A Monster: An Investigation Of Female Criminality In The Hearings Of The Perth Supreme Court, 1890-1914, Debra A. Fletcher

Theses: Doctorates and Masters

Published scholarly works on female criminal activity are limited both by their meagreness and lack of supporting empirical basis, being grounded in stereotypes and assumptions. Accurate studies based on the collection and analysis of data are required to address this paucity and to provide an historical for contemporary studies. It is, however, an accepted fact that historically women commit significantly less crimes than men and their criminal activity is generally of a far less violent nature. However, when women do physically harm others, the act most often involves family members and utilises domestic tools in the commission of the crimes. …

Enriching The Legal Ethics Curriculum: From Requirement To Desire, Heidi Li Feldman Jan 1995

Enriching The Legal Ethics Curriculum: From Requirement To Desire, Heidi Li Feldman

Georgetown Law Faculty Publications and Other Works

The problem has become all too familiar: Acting at least in part from noble motives, the American Bar Association ("ABA") requires all law students at ABA-accredited law schools to take a course in "professional responsibility." Every accredited school offers a course or courses that enable students to fulfill this requirement. Under these circumstances, the professional responsibility course can easily assume the character of high school drivers' education or health classes: It often becomes an obligatory exercise, in which students think they must woodenly learn the maxims of the ABA Code of Conduct or Rules of Professional Responsibility. Faced with this …

Enthusiasm And Charismatic Manifestations In Sabbatarian Adventism With Applications For The Seventh-Day Adventist Church Of The Late Twentieth Church, James Michael Wilson

Doctor of Ministry Projects

Task

It was the purpose of this study to discover what charismatic manifestations were extant among the Sabbatarian Adventists and to determine why those manifestations deceased. This information was then analyzed in the light of the Seventh-day Adventist Church of the late twentieth century in order to find ways of stimulating spirituality and a healthy approach to the Holy Spirit and charismatic manifestations.

Method

The historical section of this project focused on the charismatic manifestations and enthusiasm of the Sabbatarian Adventists between the Great Disappointment of 1844 and the development in formal organization in 1861. The types of experiences of …

Paul's Earliest Statement Concerning The Christian Church: A Review And Evaluation Of Research Into Paul's Association Of The Term Ἐκκλησία To Ἐν Χριστῷ In 1 Thessalonians, Roberto Pereyra

Dissertations

The purpose of the dissertation is to develop a deeper understanding of Paul's earliest statement concerning the Christian Church as expressed in the context of 1 Thessalonians. This understanding is gained through a review and evaluation of research into Paul's association of the term ἐκκλησία to the ἐν Χριστῷ motif in the context of 1 Thessalonians.

Chapter 1 reviews literature on the topic and introduces the study. Chapter 2 examines introductory issues of 1 Thessalonians such as authorship, date and place of writing, recipients, general situation, and purpose. Chapter 3 deals with the authenticity of 1 Thess 2:13-16, aliterary question …

Microevolution And The Genetic Structure Of Parasite Populations, Steven A. Nadler Jan 1995

Microevolution And The Genetic Structure Of Parasite Populations, Steven A. Nadler

Harold W. Manter Laboratory of Parasitology: Faculty Publications

The development of polymerase chain reaction-based methods for assessing the genotypes of small individual organisms will promote groundbreaking investigations of the genetic architecture of parasite populations. Both quantitative genetic models and general knowledge of parasite natural history are useful for making general predictions about the distribution of genetic variation over geographic space. However, designing experimental studies to assess relationships between specific life history variables and patterns of genetic structure in natural populations will be challenging. Traditional biochemical-genetic methods have already been used to study a limited number of parasite populations, and inferred patterns of genetic structure are distinctly different between …

Promoting The Nation: The Rise Of Ethno-Nationalism And Early Modern Drama, David Elwood Phillips Jan 1995

Promoting The Nation: The Rise Of Ethno-Nationalism And Early Modern Drama, David Elwood Phillips

UNLV Retrospective Theses & Dissertations

Most political scientists locate the rise of ethno-nationalism in the late sixteenth and early seventeenth centuries. English ethno-nationalism is developed throughout that period through a xenophobic identification of racial, religious, and national others. This study examines how Thomas Kyd, Christopher Marlowe, Willian Shakespeare, Ben Jonson, and Thomas Middleton promote English ethno-nationalism through the use of stereotypes, especially the collection of stereotypes known as the Black Legend of Spain. Chapter one outlines the theory and psychology of ethno-nationalism, laying the foundation for subsequent chapters devoted to specific plays, including Kyd's The Spanish Tragedy, Marlowe's The Jew of the Malta, Shakespeare's The …

Ten Arguments For The Abolition Of Regulatory Takings Doctrine, J. Peter Byrne Jan 1995

Ten Arguments For The Abolition Of Regulatory Takings Doctrine, J. Peter Byrne

Georgetown Law Faculty Publications and Other Works

The Takings Clause of the Fifth Amendment prohibits the federal government from "taking" property for a public purpose without paying just compensation. The Supreme Court has come to interpret the clause to require that the government compensate real property owners in some unclear class of cases when regulation of the property has resulted in severe economic losses. The proposition that regulation alone, without appropriation, occupation, or use by the government, can work a taking is known as the "regulatory takings" doctrine.

Federal Criminal Law: The Need, Not For Revised Constitutional Theory Or New Congressional Statutes, But The Exercise Of Responsible Prosecutive Discretion, G. Robert Blakey Jan 1995

Federal Criminal Law: The Need, Not For Revised Constitutional Theory Or New Congressional Statutes, But The Exercise Of Responsible Prosecutive Discretion, G. Robert Blakey

Journal Articles

My basic point is that major aspects of systems of legal justice deal with antisocial behavior. That an aspect of these systems may be categorized as “criminal,” “civil,” “state,” “federal,” or “international,” is relevant principally to a question of legal theory or governmental organization, which is fundamentally secondary to the character of the behavior itself. In short, we have to look at the behavior first–and only then ask questions of legal theory or governmental organization.

We should not be talking about “federalization.” That is a constitutional question to which we now have a fairly clear constitutional answer. Little or no …

Four Responses To Prof. Dharampal's "Bharatiya Chitta Manas And Kala", Francis X. Clooney Jan 1995

Four Responses To Prof. Dharampal's "Bharatiya Chitta Manas And Kala", Francis X. Clooney

Journal of Hindu-Christian Studies

For decades Prof. Dharampal has been well-known and respected for his research on eighteenth-century India; his analyses of a wide range of social, cultural, political economic and technological issues have been respected and valued during this time. Bharatiya Chitta manas and Kala -- perhaps, "The Indian Sense of Consciousness, Mind and Time" -- is both a continuation of his earlier work and a new venture in reflection on larger and more elusive religious and cultural issues.

Deprived Of "Fatal Liberty": The Rhetoric Of Child Saving And The Reality Of Juvenile Incarceration, J. Herbie Difonzo Jan 1995

Deprived Of "Fatal Liberty": The Rhetoric Of Child Saving And The Reality Of Juvenile Incarceration, J. Herbie Difonzo

Hofstra Law Faculty Scholarship

This article documents an earlier episode in our tortuous history of dealing with deviant norms and different children to illustrate the role played by judicial rhetoric in concealing correctional prejudice and following a dominant cultural blueprint. Using a term familiar to our child-saving predecessors, it is a tale of "incorrigibility." The first section of this article introduces the problem and glances at the historiographical treatment of child saving. The second section limns a picture of childhood in early nineteenth-century America, and argues that the idea of family autonomy was largely a myth. Particularly in the lives of lower-class youth, primarily …

The Pueblo Region As A Linguistic Area: Diffusion Among The Indigenous Languages Of The Southwest United States., Catherine Bereznak Jan 1995

The Pueblo Region As A Linguistic Area: Diffusion Among The Indigenous Languages Of The Southwest United States., Catherine Bereznak

LSU Historical Dissertations and Theses

The goal of this dissertation is to investigate whether the Pueblo region of the Southwest United States is a legitimate linguistic area (LA). The Pueblo region has long been recognized as a cohesive culture area, but an in-depth examination of the Pueblo region as a linguistic area has not previously been done. Because a linguistic area is by definition an area in which linguistic features have spread through diffusion, traits which are widespread for other reasons (e.g., genetic inheritance or independent parallel development) must be eliminated as evidence for a Pueblo LA. The methodological approach which I adopt emphasizes the …
