Better Planning And Coordination Are Needed Among Texas Econommic Development Programs, Texas Office Of The State Auditor

Documents from the State of Texas-Archive

The new statewide plan needs input that is representative of all businesses and industry groups in the State. To get some indication of business opinions about economic development programs, the State Auditor's Office surveyed 194 of the State's business taxpayers. Although the response rate (106 of 194, or 55 percent) was not adequate to allow projection of the results with confidence to the entire population, the results provided useful information about the opinions of Texas business taxpayers. The respondents indicated that few businesses (25 percent) were aware of economic development programs, and even fewer (13 percent) felt they had benefitted …

Lame Duck Theory Called Into Question, Lawrence Leonard Schack Apr 1994

Lame Duck Theory Called Into Question, Lawrence Leonard Schack

Master's Theses

The foundations of lame duck theory, the expression connoting the study of executive/legislative relations in association with tenure constraints, are composed of broad generalizations which are generally unchallenged by political scientists. Evidence in support of this assertion is scattered throughout relevant literature, most of which centers upon the national executive, the two-term limitation imposed by the Twenty Second Amendment, and the subsequent lack of influence our country's presidents wield as their "political capital dwindles" proportionate with the temporal progress of their second term. Interestingly, while a great deal of time and energy has been devoted to the discussion of the …

Leadership Development Learning In Community Settings, Anne C. Shepherd

Honors Theses

The Learning in Community Settings (LINCS) program at the University of Richmond is nearly two years old, and has been a catalyst for integrating community service into the University of Richmond curriculum. The program has grown exponentially, and now serves over 300 students, 15 faculty, and 50 community agencies. The program continues to expand and currently is planning programs of dissemination with the Bonner Scholar network and possibly with the Pew Partnership for Civic Change. This rapid growth and expansion has been both exciting and challenging. One of the challenges has been staying abreast of the program's growth. Assuring that …

Daubert V. Merrell Dow Pharmaceuticals, Inc.: Redefining The Bases For Admissibility Of Expert Scientific Testimony, Clifton T. Hutchinson, Danny S. Ashby

Cardozo Law Review

Daubert v. Merrell Dow Pharmaceuticals, Inc. is not only, or even primarily, a case about the viability of Frye v. United States and "general acceptance" as the criterion for evaluating expert testimony. Principally, it is a case about the preconditions of Federal Rule of Evidence 702, the sole provision in the Federal Rules that authorizes the use of expert testimony. The question as framed by petitioners in the course of argument was whether trial courts may screen scientific expert testimony under any real test. The Supreme Court answered this question strongly in the affirmative.

Petitioners' recurring theme was that Rule …

Girls Lean Back Everywhere: The Law Of Obscenity And The Assault On Genius By Edward De Grazia, Robert M. O'Neil Apr 1994

Girls Lean Back Everywhere: The Law Of Obscenity And The Assault On Genius By Edward De Grazia, Robert M. O'Neil

Cardozo Law Review

Such a headline from the 1990s reminds American readers that, however shameful may have been the treatment of obscenity and pornography in the United States during the past one hundred years, things could have been worse. Even so, the record here is hardly a source of pride-nor does the story have an altogether happy ending, if it has one at all. Yet it is a story that badly needs to be told, and never has it been better told than by Edward de Grazia in Girls Lean Back Everywhere.

The Continuing Evolution Of Criminal Constitutional Law In State Courts, S. Carran Daughtrey Apr 1994

The Continuing Evolution Of Criminal Constitutional Law In State Courts, S. Carran Daughtrey

Vanderbilt Law Review

Although early state constitutions were important and ambitious documents for their time, the development of state constitutional law stagnated after the drafting and adoption of the federal constitution., As the doctrine of federalism has resurfaced, however, states have begun to turn to their constitutions to grant more protection for their citizens. The states' criminal constitutional laws have changed significantly and continue to evolve today.

In the 1960s, the Warren Court expanded basic protections for criminal defendants by finding that the Fourteenth Amendment incorporates the Fourth, Fifth, and Sixth Amendments. The Court held that the Eighth Amendment prohibits cruel and unusual …

Stretching The "Terry" Doctrine To The Search For Evidence Of Crime: Canine Sniffs, State Constitutions, And The Reasonable Suspicion Standard, Kenneth L. Pollack Apr 1994

Stretching The "Terry" Doctrine To The Search For Evidence Of Crime: Canine Sniffs, State Constitutions, And The Reasonable Suspicion Standard, Kenneth L. Pollack

Vanderbilt Law Review

The Fourth Amendment, protects an individual's interest in freedom from unreasonable government intrusions into personal privacy. When a court finds an investigative technique to be a search within the Amendment's meaning, it effectively concludes that Fourth Amendment protection should apply. If the government activity constitutes a search, that activity must be reasonable. If the activity does not amount to a search, however, the government enjoys virtual freedom to conduct that activity as unreasonably as it pleases. For pure investigatory searches, the United States Supreme Court has found that the probable cause requirement strikes the proper balance in defining reasonableness. Unlike …

Enforcing Corrections-Related Court Orders In The District Of Columbia, Jonathan M. Smith Mar 1994

Enforcing Corrections-Related Court Orders In The District Of Columbia, Jonathan M. Smith

University of the District of Columbia Law Review

In 1909, a presidential commission made the following comment about the conditions that prevailed in the District of Columbia's jail: That men and women should be sent to these narrow and confined cells, the lazy to be fostered in laziness, the industrious to be deprived of every form of employment, in one promiscuous assembly, to corrupt and be corrupted by each other, to be fed like beasts and maintained at the public charge, with no prospect for improvement in condition, with the moral certainty that they will come out far worse than they went in, is a fact that has …
