Haling Foreign Subsidiary Corporations Into Court Under The 1934 Act: Jurisdictional Bases And Forum Non Conveniens, Glenn R. Sarno
Law and Contemporary Problems
The general theories and legal standards for obtaining personal jurisdiction over a nonresident foreign entity under section 27 of the 1934 Securities Exchange Act are examined. The theories of obtaining jurisdiction over a foreign subsidiary corporation that has a parent present in the US for jurisdictional purposes are used as an example.

Civil Liability For Primary Securities Distributions In The United States And The United Kingdom, Robert E. Kohn
Law and Contemporary Problems
Company law in the UK and securities regulation in the US have developed over the past six decades in response to rapidly changing economic, political and social circumstances. The main features of the regulation of primary securities distributions are identified in the two countries, and their treatment of civil liability is compared.

A Not So Distant Mirror: Federalism And The Role Of Natural Law In The United States, The Republic Of Ireland, And The European Community, Paul W. Butler, David L. Gregory
A Not So Distant Mirror: Federalism And The Role Of Natural Law In The United States, The Republic Of Ireland, And The European Community, Paul W. Butler, David L. Gregory
Vanderbilt Journal of Transnational Law
In this Article, Mr. Butler and Professor Gregory discuss the themes of federalism and natural law by examining United States, Republic of Ireland, and European Community cases regarding reproductive freedom, sexual preference, and divorce. The authors find a parallel between Ireland's difficulty in reconciling its Catholic values with the more secular human rights views of the European Community and the religious and social tension caused by federalism in the United States. While courts in both Ireland and the United States have used natural law to justify the level of substantive due process they accord privacy rights, the authors note that …
Maritime Jurisdiction And The Secession Of States: The Case Of Quebec, Jonathan L. Charney
Maritime Jurisdiction And The Secession Of States: The Case Of Quebec, Jonathan L. Charney
Vanderbilt Journal of Transnational Law
In this Article, Professor Charney discusses the maritime boundary delimitation issues that result from the creation of a new state through secession. While the author uses Quebec's maritime boundary concerns as an exemplar, the issues discussed are not unique to Quebec. The author notes that one cannot predict the ultimate resolution of maritime boundary disputes precisely, but certain factors will often affect the outcome. These factors include the geographical configuration of the disputed area, the viability of pre-secession boundaries, historic water claims, the doctrine of uti possidetis, and basic equity. The author concludes that maritime boundaries are so vital to …

Localization Of Cis-Acting Sequences In The Latency-Related Promoter Of Bovine Herpesvirus 1 Which Are Regulated By Neuronal Cell Type Factors And Immediate Early Genes, A. C. Bratanich, Clinton J. Jones
School of Veterinary and Biomedical Sciences: Faculty Publications
Bovine herpesvirus 1 (BHV-1) establishes a latent infection in sensory ganglionic neurons of cattle. During a latent infection, a single latency-related (LR) transcript is expressed. This observation suggested that DNA sequences in the LR promoter are positively regulated by neural cell type factors. The regulation of the LR gene was examined in neural cells as well as nonneural cells in transient assays. A 258-bp XbaI-SphI fragment from the LR promoter cis activated the herpes simplex virus type 1 thymidine kinase promoter in rat pheochromocytoma (PC-12) cells and differentiated human (HCNIA) neurons. In contrast, cis activation was not …

Dynamics Of The Parasite Assemblage Of Pimephales Promelas In Nebraska, Mary Ann Mcdowell, Michael T. Ferdig, John J. Janovy Jr.
John J. Janovy, Jr. Publications
Present theory states that in species-poor assemblages interactions among species are negligible and assemblage structure is a result of host/parasite interactions. A corollary to this theory is that parasite species assemblages should behave as accumulations of multiple-kind items drawn from a population in which only the relative probability of drawing each kind varies. This study was designed to test this prediction by comparing descriptor values, including diversity indices, species density values, equitability, and prevalence to those obtained from data produced by a Monte Carlo simulation model. The parasite assemblage consisted of 7 parasite species or types found in the fathead …

Parasites Of The Extinct Shasta Ground Sloth, Nothrotheriops Shastensis, In Rampart Cave, Arizona, Gerald D. Schmidt, Donald W. Duszynski, Paul S. Martin
Harold W. Manter Laboratory of Parasitology: Faculty Publications
Of 7 dissected dung balls of the extinct Shasta ground sloth (Edentata) from Rampart Cave, Arizona, 4 (57%) were found to contain nematode juveniles, helminth eggs, and/or coccidian oocysts. One dung ball was radiocarbon dated at 10,500 ± 180 yr, about the time of ground sloth extinction. It is supposed that the parasites also are extinct. Agamofilaria oxyura n. sp. is proposed for first-stage juveniles of an oxyurid. These juveniles measured 13-20 x 126-198 (16.8 x 159) μm. Strongyloides shastensis n. sp. is reported as first-stage juveniles, some of which clearly are molting. These juvenile worms were 23-27 …

Resource Tracking In North American Telorchis Spp. (Digenea: Plagiorchiformes: Telorchidae), Alison Radtke, Deborah A. Mclennan, Daniel R. Brooks
Harold W. Manter Laboratory of Parasitology: Faculty Publications
We examine the evolution of host specificity for species of Telorchis, using the methods developed by researchers studying phytophagous insect-plant systems. Optimization of "generalist" compared with "specialist" onto the phylogeny for Telorchis revealed ambiguous patterns, depending on how the two terms were defined. Regardless of that definition, most of the evolutionary diversification of this group has been carried out within eucryptodiran turtles, the ancestral host group. From that plesiomorphic background, there appears to have been two episodes of specialization by way of a host switch into caudates (ancestor of T. stunkardi + T. sirenis) and snakes (T. …
Spes Unica—Path To Glory: The Canonization Of Louise De Marillac, Betty Ann Mcneil D.C.
Spes Unica—Path To Glory: The Canonization Of Louise De Marillac, Betty Ann Mcneil D.C.
Vincentian Studies
The preservation of Louise de Marillac’s relics, the process of her canonization, the miracles attributed to her, and the celebrations of her canonization are described in detail. The Daughters of Charity’s General Council began the process leading to her canonization in 1882. In 1895, her cause for beatification was introduced. Louise was beatified in 1920 and canonized in 1934. Three miraculous cures occurred before her beatification and at least two occurred between her beatification and canonization.

Notable Vincentians (6): Paul Bedjan, John E. Rybolt C.M., Ph.D.
Vincentian Studies
Paul Bedjan was a nineteenth-century Vincentian who had been born in the Chaldean (East Syrian) tradition. He abandoned the rite when he entered the Congregation but continued to support Chaldeans through fund raising and publishing. He worked in present-day Iran and Europe. He founded the Catholic Press of Urmya; the press was destroyed in 1883, but he published thirty-five works from that year until 1912. Aside from a Chaldean breviary and a Chaldean missal, these included publications on theology, piety, and literature, among other topics. He is best known for the breviary and for seven volumes on the martyrs and …
Reflections On Service To The Poor, James Cormack C.M.
Reflections On Service To The Poor, James Cormack C.M.
Vincentian Studies
James Cormack reflects on the Vincentian charism from his own experience. Vincentian service is a call from God’s love to return that love. It requires seeing Christ crucified in persons who are poor. It takes faith but also deepens faith. As Cormack sees them, the main qualities of the charism are compassion, courage, weakness, a commitment to smallness, and a change of heart. Weakness is necessary because we must recognize that we, too, need help and that the strength to serve comes from God. A commitment to smallness entails being satisfied with doing ordinary things; if we desire personal fulfillment …

The Taming Of The Shrew: The Liberal Attempt To Mainstream Radical Feminist Theory, Jeanne L. Schroeder
The Taming Of The Shrew: The Liberal Attempt To Mainstream Radical Feminist Theory, Jeanne L. Schroeder
Articles
The article critically examines the opposing views of Cass Sunstein and Catharine MacKinnon on pornography and its legal implications, highlighting their divergent definitions and approaches. Sunstein advocates for a narrow, violence-focused antipornography legislation, while MacKinnon pushes for a broader definition that encompasses gender subordination. The analysis reveals how Sunstein's critique of MacKinnon unintentionally weakens feminist challenges to masculinism by separating sexuality from power dynamics. MacKinnon's theory, rooted in a premodern Christian view of sexuality, posits that pornography constructs women as objects, reinforcing gender inequality. The article underscores the tension between legal reform and the deeper structural changes needed to address …

The Surveillance Of Annual Ryegrass Toxicity In Western Australia October 1991 To May 1992, W D. Roberts
Agriculture reports
Between October 1991 and January 1992 (1991 Annual Ryegrass Toxicity(ARGT) season) 89 farms reported a total of 102 outbreaks of ARGT to the Department of Agriculture Western Australia. This second annual report provides summary information on these occurrences. The main body of the report focuses on mortality records collected by Departmental advisory staff when farmers sought information on ARGT during this period.

Agriculture reports
This workshop grew out of a conversation between Maurice Barnes, a Trayning farmer and member of the Research Advisory Committee of the Dryland Research Institute, and Steve Porritt, the officer in charge of the Dryland Research Institute at Merredin. Maurice was interested in the idea of posing the question 'What would agriculture be like if we had known as much about this landscape in 1829 as we know now?', to a group of farmers and others interested in the central wheatbelt and its future. Maurice saw this question as a first step toward achieving some shared vision for the future …
