The "New" Law Of The Sea And The Law Of Armed Conflict At Sea, Horace B. Robertson Jr. Oct 1992

The "New" Law Of The Sea And The Law Of Armed Conflict At Sea, Horace B. Robertson Jr.

Newport Papers

The 1982 United Nations Convention on the Law of the Sea establishes a regime for the oceans that includes a number of "zones" in addition to the traditional divisions of internal waters, territorial sea, and high seas. Although explicitly applicable only in peacetime, these new zones have a spillover effect on the law of naval warfare, particularly in the relationships between belligerents and neutral States.

A Response To Mohan Limaye, Barbara Couture

Department of English: Faculty Publications

Mohan Limaye presents two important concerns in his insightful response to my article [“Categorizing Professional Discourse: Engineering, Administrative, and Technical/Professional Writing,” Journal of Business and Technical Communication 6:1 (January 1992), pp. 5–37]. I wish to comment on these points and also to submit a correction to the text of the article.

Perception/Action: An Holistic Approach, John M. Flach Oct 1992

Perception/Action: An Holistic Approach, John M. Flach

Psychology Faculty Publications

A general systems approach is taken to studying the emergent properties of the human perception/action system. Two task domains, the control of locomotion and the recognition of objects, are used to study human performance. The locomotion task involves the control of altitude. Experiments are described that will manipulate the type of texture, the speed of forward motion, and altitude. A general hypothesis is presented that performance in the altitude control task is a function of the signal-to-noise ratio within the flow field--where signal refers to optical activity resulting from change of altitude and noise refers to optical activity resulting from …

Deconstructing Los Angeles Or A Secret Fax From Magritte Regarding Postliterate Legal Reasoning: A Critique Of Legal Education, C. Garrison Lepow

University of Michigan Journal of Law Reform

This Article asks readers to imagine the shapes and colors of legal issues; it examines how people communicate and develop ideas through moving, metamorphosing images, especially computer graphics, and why methodology affects the eventual product of thought. Like dance, legal issues are described better through action than through words. Therefore, this Article challenges the principles of verbal reasoning upon which our legal system is based.

Equity In Public Education: School-Finance Reform In Michigan, William S. Koski Oct 1992

Equity In Public Education: School-Finance Reform In Michigan, William S. Koski

University of Michigan Journal of Law Reform

This Note argues that the only adequate compromise between the pressure to limit taxes and the need to provide both educational quality and equity is to institute a form of full-state funded education. Part I of this Note briefly defines equity in public education and discusses the importance of increasing equity. Part II discusses other values and concerns that arise in the school-finance debate, such as liberty, local control, efficiency, and quality of education. Part III considers several fundamental school-finance alternatives. Part IV provides a historical overview of Michigan school finance reform and a description of the current State School …

Causation In Fact In Omission Cases, David A. Fischer Oct 1992

Causation In Fact In Omission Cases, David A. Fischer

Faculty Publications

This article analyzes the difficulties involved in attributing cause in fact in omission cases, and suggests possible resolutions. Part II discusses the basic concept of causation, and the distinction between acts and omissions. Part III discusses the particular problems that arise in applying causation principles in omission cases. Part IV then analyzes these problems from both corrective justice and economic analysis perspectives. Finally, the article suggests an approach for solving these complex issues.

Architecture-Directed Refinement, Gruia-Catalin Roman, C. Donald Wilcox Oct 1992

Architecture-Directed Refinement, Gruia-Catalin Roman, C. Donald Wilcox

All Computer Science and Engineering Research

As critical computer systems continue to grow in complexity, the task of demonstrating that they are correct, that is, guaranteed to operate without failure, becomes more difficult. For this reason, research in software engineering has turned to formal methods, i.e. rigorous approaches to demonstrating the correctness of software systems. Unfortunately, the formal methods currently used for concurrent systems do no provide a mechanism for expressing and manipulating non-functional constraints formally. In this paper, we show that one class of non-functional constraints, the target architectures, can be expressed using formal notation (the UNITY proof logic). We then use a mixture of …

Experiences With The Pavane Program Visualization Environment, Kenneth C. Cox, Gruia-Catalin Roman Oct 1992

Experiences With The Pavane Program Visualization Environment, Kenneth C. Cox, Gruia-Catalin Roman

All Computer Science and Engineering Research

The Pavane system is an implementation of the declarative visualization model, which treats visualization as a mapping form the state of some entity (a program, an execution, a data set, etc.) to images. We briefly discuss the declarative visualization model and the implementation of Pavane. We then present some of the results that we have obtained with Pavane. These results are divided into three parts: a discussion of the development of visualizations focusing on the roles played by the various participants, a critique of declarative visualization in general and Pavane in particular, and a presentation of a number of common …

Hyperflow: A Visual Programming Language For Pen Computers, Takayuki Dan Kimura Oct 1992

Hyperflow: A Visual Programming Language For Pen Computers, Takayuki Dan Kimura

All Computer Science and Engineering Research

This paper presents the design philosophy of the Hyperflow visual programming language. It also gives an overview of its semantic model. The primary purpose of language is to provide a user interface for a pen-based multimedia computer system designed for school children. Yet it is versatile enough to be used as a system programming language. The concept of visually interactive process, vip in short, is introduced as the fundamental element of the semantics. Vips communicate with each other through exchange of signals, either discrete or continuous. Each vip communicates with the user through its own interface box by displaying on …

Process And Policy: Resource-Bounded Non-Demonstrative Reasoning, Ronald P. Loui Oct 1992

Process And Policy: Resource-Bounded Non-Demonstrative Reasoning, Ronald P. Loui

All Computer Science and Engineering Research

This paper investigates the appropriateness of formal dialectics as a basis for non-monotonic and defeasible reasoning that takes computational limits seriously. Rules that can come into conflict should be regarded as policies, which are inputs to deliberative processes. Dialectical protocols are appropriate for such deliberations when resources are bounded and search is serial. AI, it is claimed here, is now perfectly positioned to correct many misconceptions about reasoning that have resulted from mathematical logic's enormous success in this century: among them (1) that all reasons are demonstrative, (2) that rational belief is constrained, not constructed, (3) that process and disputation …

Performance Comparison Of Clocked And Asynchronous Pipelines, Mark A. Franklin, Tienyo Pan Oct 1992

Performance Comparison Of Clocked And Asynchronous Pipelines, Mark A. Franklin, Tienyo Pan

All Computer Science and Engineering Research

Clock (synchronous) and self-timed (asynchronous) represent the two principal methodologies associated with timing control and synchronization of digital systems. In this paper, clocked and the asynchronous instruction and arithmetic pipelines are modeled and compared. The approach, which yields the best performance is dependent on technology parameters, operating range and pipeline algorithm characteristics. Design curves are presented which permit selection of the best approach for a given application and technology environment.

Hyperflow: A Uniform Visual Language For Different Levels Of Programming, Takayuki Dan Kimura Oct 1992

Hyperflow: A Uniform Visual Language For Different Levels Of Programming, Takayuki Dan Kimura

All Computer Science and Engineering Research

We propose a visual language, Hyperflow, for system programming as well as for end user shell programming. Hyperflow is designed for a multimedia pen computer system for children. It is a dataflow-based graphical language similar to Show and Tell. In order to demonstrate the capability of Hyperflow, we solve the programming problem of implementing a help command for children to telephone their instructor or parents using voice communication hardware (modem, microphone, speaker, and a clock). The resulting program includes visual programs to implement device drivers for the modem and clock hardware.

In The Wake Of Thoreau: Four Morden Legal Philosophers And The Theory Of Nonviolent Civil Disobedience, Stephen R. Alton Oct 1992

In The Wake Of Thoreau: Four Morden Legal Philosophers And The Theory Of Nonviolent Civil Disobedience, Stephen R. Alton

Faculty Scholarship

This Article opens with a discussion of Thoreau's philosophy of civil disobedience and then examines the ideas of four modem legal philosophers, Joseph Raz, Kent Greenawalt, John Rawls, and Ronald Dworkin, on the subject. Next, the Article compares the respective thinking of all five men regarding the circumstances that would justify the use of civil disobedience. To facilitate the comparison as well as to make it more relevant to the reader, the Article examines five related contemporary illustrations involving situations in which the use of civil disobedience might arguably be morally justified. This Article concludes with some general thoughts on …

Mandatory Prelicensure Legal Internship: An Idea Whose Time Has Come Again, Stephen R. Alton Oct 1992

Mandatory Prelicensure Legal Internship: An Idea Whose Time Has Come Again, Stephen R. Alton

Faculty Scholarship

This Article explores the wisdom of imposing an internship requirement on aspiring lawyers as a prerequisite for licensure. It is my position that such a requirement can be beneficial to the new attorney, to the profession, and to the public and should thus be mandated for all those who seek admission to the practice of law. This Article begins by briefly examining the history in the United States of law-office, apprenticeship as a means of legal education. I then proceed to an examination of modern internship requirements in England and Canada. There follows a discussion of some of the more …
