Circuit Court Opinions
Defendants-appellants, Allied Vision, Ltd. and New Line Cinema Corporation, appeal from an order of the United States District Court for the Southern District of New York (Motley, J.) granting a preliminary injunction in favor of plaintiff-appellee Stephen King in connection with King's claims under the Lanham Act and New York law. King, who is the author of such best-selling horror thrillers as The Shining, Carrie and Salem's Lot, contended that Allied and New Line falsely designated him as the originator of the motion picture "The Lawnmower Man," which was produced by Allied and distributed in North America by New …

Law Quadrangle (formerly Law Quad Notes)
In Images of Free Press, 1991 University of Chicago Press, Dean Lee C. Bolinger, presents what Floyd Abrams has called a "subtley reasoned and powerfully argued attack on much of the received wisdom about First Amendment theory and law." In this excert, Bollinger considers the principle of press autonomy initiated by the country's seminal libel case, New York Times v. Sullivan. The case was brought by L. B. Sullivan, an elected commissioner of Montgomer, Alabama, who while unnamed in the challenged articles, said his reputation had been damaged by published errors. The Court found for the New York Times. Bollinger …

Consideration And Estoppel: Problem And Panacea, Bruce Macdougall
Consideration And Estoppel: Problem And Panacea, Bruce Macdougall
Dalhousie Law Journal
In his book, The History of the Common Law of Contract, A.W.B. Simpson demonstrates that consideration originally seems to have meant the "matter of inducement" - the "why" of entering a promise.' He writes: "The essence of the doctrine of consideration, then, is the adoption by the common law of the idea that the legal effect of a promise should depend upon the factor or factors which motivated the promise. To decide whether a promise to do X is binding, you need to know why the promise was made."2 In modem terms, according to Simpson, a promise which lacks any …
Two Mechanisms For Growth Inhibition By Elevated Transport Of Sugar Phosphates In Escherichia Coli, Robert J. Kadner, G. Patrick Murphy, Craig Stephens
Two Mechanisms For Growth Inhibition By Elevated Transport Of Sugar Phosphates In Escherichia Coli, Robert J. Kadner, G. Patrick Murphy, Craig Stephens
Biology
The Escherichia coli uhp T gene encodes an active transport system for sugar phosphates. When the uhp T gene was carried on a multicopy plasmid, amplified levels of transport activity occurred, and growth of these strains was inhibited upon the addition of various sugar phosphates. Two different mechanisms for this growth inhibition were distinguished. Exposure to glucose-6-phosphate, fructose-6-phosphate or mannose-6-phosphate, which enter directly into the glycolytic pathway, resulted in cessation of growth and substantial loss of viability. Cell killing was correlated with the production of the toxic metabolite, methylglyoxal. In contrast, addition of 2-deoxyglucose-6-phosphate, galactose-6-phosphate, glucosamine-6-phosphate or arabinose-5-phosphate, which do …
Review Of Field Guide To Wildflowers Of Nebraska And The Great Plains, Roadside Wildflowers Of The Southern Great Plains, Wildflowers Of The Northern Great Plains, And Wildflowers Of The Tallgrass Prairie: The Upper Midwest., Kathleen H. Keeler
Great Plains Quarterly (through 2013)
These four flower books represent a blossoming of attractive popular books describing prairie plants. Each of these four books has a slightly different goal. In terms of area covered, Farrar focuses on Nebraska, Vance, Jowsey and Mclean consider plants of the northern Great Plains, Freeman and Schofield aim at roadside wildflowers of the southern Plains, and Runkel and Roosa on wildflowers of the northern tallgrass prairie. The types of plants included vary also. Farrar includes both common and rare Nebraska wildflowers but no shrubs or trees, Vance et al. include common native wildflowers, visible introduced species, and some woody plants. …
