Johnson V. Morton Thiokol And Handbook Disclaimers: Allowing Employers To Have Their Cake And Eat It Too, Todd M. Shaughnessy

Utah recently joined the growing number ofjurisdictions that recognize limitations on employers' absolute right to terminate employees. This recognition signals a departure from the traditional rule that allowed an employer to terminate an employee for "no cause, good cause, or even cause morally wrong without fear of liability." In particular, the Utah Supreme Court recognized an implied contract exception to the employment-at-will rule. According to the implied contract exception, an employer's promissory representations, including those found in employee handbooks, may be used to limit the employer's absolute discretion to terminate an employment relationship.

Cause in fact is fundamental to imposing liability in many kinds of civil and criminal actions. The term refers to the causal link between an act or omission and resulting damage or injury. Lawyers, judges, and scholars frequently think of cause in fact as a purely factual question, unaffected by policy issues, that can be resolved adequately under normal burden of proof rules. In contrast, proximate or legal cause rules are explicitly intended to implement policy decisions concerning how far to extend the scope of liability. Much has been written in recent years about the rise in racial hostility on college campuses, about "hate speech" codes and educational measures adopted by many public universities in response to the hostilities, and about the issues of free speech and "political correctness" raised thereby. The debate is unlikely to be quieted by the United States Supreme Court's decision in R.AV. v. City of St. Paul, which raises new doubts about the constitutionality of a great many campus antiharassment policies. Some scholars have approached these issues painfully, reluctantly choosing between dearly held principles of equality and freedom of expression. In …

The Ferrymen Of Elysium: Nostratic Eschatology And The Homeric Phaeacians, Erwin F. Cook

Belief that the Homeric Phaeacians belong to the afterlife is old; but its supporters have always found themselves in the minority. Friedrich Welcker, who first argued the point in 1833, held that the Phaeacians were ferrymen of the dead, and that Scheria was set in or near Elysium. Wilamowitz accepted Welcker's identification of the Phaeacians, and maintained that Arete and Alcinous were modeled on the underworld rulers Persephone and Hades. Rehearsal of the arguments advanced by these scholars reveals that the evidence has been incompletely and on occasion incorrectly applied; however, a modified version of their theory is still viable …

The futility of using a general-purpose metric to characterise 'the' complexity of a program has been argued to support the design of specific metrics for the different stages of the software life-cycle. An analysis of the module testing activity is performed, providing evidence of the absurdity of all-purpose metrics, as well as a methodical means with which to measure testing complexity. Several standard metrics are seen to serve as component measures for the intricacies of testing. The methodology is applied to compare traditional and adaptive means of testing. Justice In The Black Hawk War: The Trial Of Thomas Jose, Albert Winkler

During Utah’s Black Hawk War 1865-1868 there were some instances of whites murdering Indians, and these people were never brought to trial. In 1866, Thomas Jose was brought to trial for killing an Indian, and he was convicted for murder. Even though his punishment was relatively mild, the justice system was made to work in defense of the Indians.

Of all the currents of change that have swept the humanities during the last half-century, the most far-reaching revolve around language. Philosophy, history, and literary criticism, among other language-based disciplines, have developed what is often presented as a largely unprecedented self-consciousness about representation. The message to scholars in nonlanguage-based disciplines is clear: to be taken seriously, one can no longer view language as a transparent window to an objective reality but must confront the foundational political and ideological baggage of the medium itself, as well as its constant slippage in the hands of the producer.

Many who value the contributions of religion to American life have contended that American public life is hostile to religion. They perceive many of the Supreme Court's Religion Clause opinions as hostile to religion, and circulate anecdotes about the antireligious hostility of public life. Studies also suggest that some of the principle actors in American public life systematically marginalize religious viewpoints relative to secular ones. Nevertheless, others are baffled by the suggestion that public life discriminates against religion. These people note that religion is deeply (if controversially) involved in much of contemporary American politics, and dismiss anecdotes about such hostility …

Axillary buds of intact pea seedlings (Pisum sativum L. cv Alaska) do not grow and are said to be dormant. Decapitation of the terminal bud promotes the growth of these axillary buds, which then develop in the same manner as terminal buds. We previously showed that unique sets of proteins are expressed in dormant and growing buds. Here we describe the cloning, sequencing, and expression of a cDNA clone (pGB8) that is homologous to ribosomal protein L27 from rat. RNA corresponding to this clone increases 13-fold 3 h after decapitation, reaches a maximum enhancement of about 35-fold after 12 h, …

The relationship among perceptions of child-parent attachment, current adult attachment style, psychological symptoms, and interpersonal problems was investigated. Subjects were 94 female undergraduate students at a large urban university in Richmond, Virginia. The modal age of the subjects was 22 years. Subjects were administered a packet comprised of six pencil-and-paper measures: Parental Caregiving Measure, Bartholomew Adult Attachment Style Questionnaire, Social Avoidance and Distress Scale, Fear of Negative Evaluation Scale, Automatic Thoughts Questionnaire-Revised, and Inventory of Interpersonal Problems. The results indicated that the set of child-parent attachment and adult attachment style variables significantly predicted fear of negative evaluation, social avoidance and …

The present report describes the characteristics and regulatory properties of phosphatidylinositol (Ptdlns) 4-kinase activity in rat exocrine pancreas. The membrane associated Ptdlns 4-kinase displayed a broad pH profile with optimal activity at neutral to alkaline pH. Carbachol (CCh) elicits a concentration- and time-dependent increase in Ptdlns 4-kinase activity in homogenates derived from agonist-stimulated acini. This effect was blocked by N-methylscopolamine and mimicked by muscarine. The enzyme had an apparent Km for Ptdlns and ATP of 4 and 60 uM, respectively. CCh caused no discernible change in the Km for either Ptdlns or ATP, but did produce a modest increase in …
