Above All, Do No Harm: The Application Of The Exon-Florio Amendment To Dual-Use Technologies, Gerald T. Nowak

Michigan Journal of International Law

In support of this proposition, this Note will first examine the legislative history and executive enforcement of the Exon-Florio Amendment, followed by a discussion of the goals of Exon-Florio and the applicability of Exon-Florio to dual-use technologies. Then, after an examination of the attitudes and experience of the European Community with regards to such protectionism, specifically in France and the United Kingdom, this Note will argue that vigorous enforcement of the Exon-Florio Amendment, and a fortiori passage of the Technology Preservation Act, is likely to result in less, not more, domestic production of dual-use technologies. Transportation Research Center: Accident Analysis of Ice Control Operations

This widely publicized study by Marquette University was the first of its kind in North America to document, with statistical validity, the direct benefits of deicing operations. It was patterned after a German study of the Technical University at Darmstadt during the late 1980s.

The Marquette study was conducted during the winter of 1990-1991 in four states: New York, Illinois, Minnesota and Wisconsin. It covered a network of 520 miles of randomly selected twolane undivided highways and 50 miles of multi-lane divided freeways in the four states. The sections included were primarily rural or sub-urban.

Studies of the work of American trial courts--particularly the federal courts in the nineteenth century--are extremely rare. One exception is Federal Justice in California: The Court of Ogden Hoffman, 1851-1891 (1991)--an archival study of the forty year tenure of the first judge of the Northern District of California. Federal Justice is both an institutional study of that court and a biography of its first judge, Ogden Hoffman. Federal Justice rests upon an analysis of over 19,000 case files generated by the first forty years of that courts existence and provides a general summary of the dockets and workload of the …

In 1992, the San Antonio Museum of Art hosted a panel which addressed a number of issues, including: what arts institutions can do to better represent the cultures of the communities they serve; what the United States is doing to protect Native American art and culture; what the international community is doing to address the flow of art and cultural objects across national boundaries; and what should be the plan to protect and to promote multiculturalism in the arts for the next 500 years. In a representative democracy, government must protect the rights of its citizens to express ideas, to voice grievances, and to seek to influence government. The first Amendment safeguards these fundamental political rights from government intrusion. In a free market economy, government must protect trade and commerce from activities and influences that lead to increased concentrations of economic power or that otherwise tend to restrain competition. The antitrust laws, specifically the Sherman Act, seek to safeguard the competitive process from restrictive trade practices. Conflict arises when efforts to influence government threaten to undermine competition.

With only a small risk of overstatement, one could say that sanctions in civil litigation exploded during the 1980s, with the 1983 amendment to Federal Rule of Civil Procedure 11 acting as the principal catalyst. From 1938 until the 1983 amendment, only two dozen or so cases on Rule 11 were reported, with courts rarely imposing sanctions. Although a few cases were notable by virtue of sanction size, prestige of the firm sanctioned, or publicity attending the underlying case, the legal profession largely regarded Rule 11 as a dead letter. The nature of time series designs often leads to missing data, due to its requirement of taking a large number of repeated observations on a single experimental unit. There are many methods available for estimating missing observations; some have been borrowed or adapted from univariate methods, while others have been developed specifically for the time series problem. This study compares the effects of four different methods of data estimation on time series analysis. Review of literature suggests that studies of coping strategies used by international students in their cross cultural adjustment were needed. Using interview and qualitative methodology, this study investigated the coping strategies of 24 international students from Taiwan at a small university on the northeast coast of the United States of America. A personally administered questionnaire was developed and used to obtain the demographic information and the cross-cultural adjustment experience. Women's and men's use of care and justice considerations in response to moral dilemmas was investigated. Participants were 63 men and 127 women ranging in age from 17 to 64. Each was presented with one of two dilemmas dealing with either abortion or drug use, as it affected either a daughter or a son, and asked to respond to the dilemma both in an open-ended format and in a Likert scale format. Maternal interaction style (often conceived as sensitivity) and security of attachment have long been considered to have an important relationship (Ainsworth et al., 1978; Grossmann et al., 1985; Belsky Rovine, and Taylor,1984; Isabella and Belsky,1991). However, the construct of maternal sensitivity is not consistently defined or measured in the literature. Using videotaped data of 33 mother-infant dyads, we identified the relevant components of maternal sensitivity as related to attachment outcomes. This project investigated the multidimensional self-concepts of gifted and regular education fifth grade children. Potential differences in the ratings of Global, Physical, Social and Academic self-concept domains were investigated. Ratings of the importance of the specific domains were also examined. Participants consisted of 37 integrated gifted and 251 regular education classmates enrolled m the fifth grade of a suburban school district. Many household products contain chemicals that are considered hazardous. These products become hazardous waste when discarded, posing potential harm to both human health and the natural environment. With increasing frequency, local governments are being pressured by residents to provide special household hazardous waste management programs. Planners are often the most qualified personnel to construct such programs. At a minimum, planners are requested to assist other staff members or act as the state’s liaison to the community. Increasing the planner’s knowledge of hazardous waste mitigation is essential to addressing the household hazardous waste problem.
