Are The Visual Acuity Requirements For Pilots In The Airline Industry Justifiable?, William C. Gladish

The purpose of this review is to investigate and determine whether the airline industry is justified or unjustified in requiring a more stringent vision criterion than the Federal Aviation Administration. The new law established by the Americans with Disabilities Act of 1990 is applicable to this issue. This Act requires airlines to show that the selection criteria are job-related and consistent with a business necessity. This paper assumes that all such vision criteria would fall into three areas: safety, performance, and investment risk. One of the most important changes in Congress in decades was the extensive congressional reforms of the 1970s, which moved the congressional budget process into the focus of congressional policy-making and shifted decision-making away from committees. This overwhelming attention to the federal budget allowed party leaders to emerge as central decision makers. History has shown that one of the most important elements in a successful combat operation is the quality of the commander. The success of Operation Desert Storm confirmed that American commander, General Norman Schwarzkopf, was no mediocre leader. By extension, the war also paid tribute, albeit a silent one, to a man who is arguably the greatest military leader the United States has ever produced—Robert E. Lee. When testimony about the religiosity of a victim is elicited, a jury will likely become aware of the religious affiliation of the victim. Any revelation to a jury of the religiosity of a victim can be an aid to the jury in assessing the punishment to be given to the defendant, since being religious and talking with people about religion is deemed a communal good. However, prescribing a harsher punishment to a defendant because of the religious affiliation of a victim is a form of religious discrimination which is unconstitutional. Practical Reason: The Commercial Speech Paradigm, Edward J. Eberle

Law Faculty Scholarship

First Amendment jurisprudence incorporates a continual struggle to balance coflicting interests. Free speech values must be weighed against communitarian interests in a rational manner. The article examines the foundationalist approach to this task, and finds it incapable of providing a unified First Amendment theory. Through examination of the treatment of commercial speech, the article arrives at a more coherent approach through the application of practical reasoning. The proposed methodology allows for principled analysis and decisions which yield an internally consistent body of law.

Archaeological research depends on the temporal structural of archaeological deposits. Temporal structure includes deposit age and the sequencing or the relative temporal order of one deposit to another. Another aspect is the temporal scale and resolution, or the degree of contemporaneity shared by deposits, Archaeology is also concerned with ethnographic time, that domain in which formation events occur, i.e., the temporal characteristics of activities with respect to the piece of land on which those activities occur. This chapter explores the issue of temporal resolution or deposit grain is it relates to the tempo of use witnessed by a locale.

Aviation Safety As A Function Of Pilot Experience: Rationale Or Rationalization?, Bill D. Bell, Charles L. Robertson, Gregory S. Wagner

This study tests the effectiveness of an experience model in predicting aviation safety behavior. The elements comprising the model include: (a) flight hours, (b) ratings and flight characteristics, (c) career status, and (d) malfunction history. Data were derived from a random sample of U.S. pilots in the fall of 1990 by means of a survey instrument. Significant variance in aviation safety is not explained by the model. The key predictor of safety behavior is the career status (i.e., certificate duration) of the pilot. Flight hours, ratings, and malfunction history are negatively and non-significantly associated with aviation safety. The research: (a) …

A Comparison Between Airline Cost Structure Pre- And Post-Deregulation, Atef Ghobrial

Journal of Aviation/Aerospace Education & Research

This study compares the pre- and post-deregulation changes in the cost structure of two carrier groups: majors and nationals. A dummy-variable model was estimated, using data from 1970 to 1988. The results suggest that while the percentage of total cost incurred in maintenance decreased, costs of promotion, sales, and advertisement increased. It also appears that the percentage of some cost components differs among the two carrier groups; the percentage of total cost incurred in aircraft-traffic servicing seems to be higher for the nationals than for majors.

Eleven teachers from eight different states were chosen as 1991 winners of the General Aviation Manufacturers Association (GAMA) annual Award for Excellence in Aviation Education. The award honors grade school and high school teachers who bring general aviation into the classroom, either as a specific topic of discussion or as a teaching tool. Most of the winning projects included activities spread over an entire semester or school year. We discuss topics in the theory of nonlinear stochastic control, estimation, and decision via a probabilistic approach using measure transformations and martingale theory. First, we investigate the problem of estimating a diffusion process using coordinate transformations and measure transformations, both locally and globally; this is the analog of nonlinear coordinate and state feedback transformations used to obtain exact linearization in nonlinear deterministic control problems. Our results are new in that we use a probabilistic approach rather than a purely geometric one, and also in that we derive representations when the processes are defined locally rather than just globally.
