Perhaps the leading contemporary critic of placing consent at the center of contract law has been Ian Macneil. In his book The New Social Contract as well as in a series of complex and richly textured articles spanning nearly two decades, Macneil has eloquently presented and defended his now well-known relational theory of contract. It is a tribute to the important core of previously neglected truth in Macneil's theory that, for all its complexity, the theory can be summarized succinctly.

We studied electroabsorption in GaAs/ AlGaAs Multiple Quantum Well (MQW) structures. The waveguide used for this study was designed as a phase modulator with an active layer containing six 75 Å GaAs quantum wells and 80 Å Al.35Ga.55As barriers.

Electroabsorption in MQW structures is dependent on, among other things, the light polarization, the orientation of the crystal optical axes, and the direction of the applied electric field.

In the first study we measured the spectral dependence of the quadratic electro-optic coefficient for TM polarized light (s33 near the absorption band edge. The light hole exciton …

Direct Actions For Emotional Harm: Is Compromise Possible?, Julie A. Davies

Washington Law Review

While most courts and commentators acknowledge that emotional injury resulting from negligence may merit compensation, they share the conviction that some limits must be placed on such claims. They identify two basic policy rationales as the justifications for limiting claims for emotional harm: (1) the desire to ensure that a defendant's liability for negligence is not disproportionate to his or her fault, and (2) the desire to prevent litigation of trivial or fraudulent claims. This Article argues that the two rules most frequently applied by courts to effectuate limitations on recovery—the "zone-of-danger" rule and the "foreseeability-plus-serious-injury" rule—suffer from serious deficiencies. …

Over a million new U.S. enterprises are formed each year. Virtually all the country's net new jobs come from these and other new ventures. Yet 60% of new ventures still fail within two years. The purpose of this study was to isolate the most dominant leadership success characteristics of a typical early stage, high-growth potential venture. Thus discovered, these factors could properly focus the enterprise's tactics on improving its probability of fulfilling its original success related objectives as well as enhancing new job creation and in turn, economic wealth. The National Environmental Policy Act (NEPA) establishes the Nation's environmental policy and creates a set of procedures necessary to fulfill that policy. The Agency for International Development (A.I.D.) narrowly interprets the application of NEPA's procedures and has adopted a less rigorous set of environmental evaluation procedures. This Comment examines A.I.D.'s procedures, notes their deficiencies, and suggests that Congress should amend NEPA to require A.I.D. and all agencies to utilize NEPA procedures.

Washington's Judicial Invalidation Of Unambiguous Exclusion Clauses In Multiple Causation Insurance Cases, Lawrence Alan Wans

Washington Law Review

The Washington Supreme Court has restricted the use of unambiguous exclusion clauses that limit homeowners' insurance coverage in multiple causation cases. This Comment discusses the court's "proximate cause" analysis, judicial treatment of policy exclusions, and the insured's expectations of coverage. The Comment argues that the Washington approach to multiple causation cases should be narrowly construed in Washington and rejected in other jurisdictions, because its consequences may harm insurers and insureds alike.

Rights Of Washington Junior Lienors In Nonjudicial Foreclosure—Washington Mutual Savings Bank V. United States, 115 Wash. 2d 52, 793 P.2d 969, Clarified, Reconsideration Denied, 800 P.2d 1124 (Wash. 1990), John D. Sullivan

In Washington Mutual Savings Bank v. United State, the Washington Supreme Court extended the anti-deficiency provisions of the Deed of Trust Act to all non-foreclosing junior lienors. Because this decision makes all junior obligations uncollectible following a nonjudicial foreclosure, it may have a chilling effect on lenders and a serious impact on the availability of home equity loans. This Note examines the Washington Mutual decision and suggests that the court should have determined instead that a deficiency is allowed, but should be computed after applying any surplus value in the property sold against junior obligations. We have previously shown that peripheral lymph node (PLN) B lymphocytes of adult DBA/ 25 mice failed to make an antibody responseto type 2 antigen TNP-Ficoll, but exhibited a good antibody response to type 1 antigen TNP-BruceNa abortus. In the present study we wanted to find out whether the unresponsivenessof PLN B cells to TNP-Ficoll is due to defectsin the early activation and proliferation stage or in the final differentiation stageof B cells. After five years of national programmatic use of Norplant® contraceptive implants, in 1992 the National Population and Family Planning Board (BKKBN) plans to implement a follow-up Use-Dynamics Study of implant users in West Java and West Sumatra Provinces, Indonesia. A Diagnostic Study was implemented in 1991 to prepare for that study prior to final approval, and to get some early insights into implant program operations in advance of final results from the main study.
