Criminal Procedure Bonds And Recognizances: Provide For Increased Bail And For Filing Of Separate Police Reports For Incidents Of Family Violence, Karl M. Braun

HB 448 provides for increased bail when an offense involves an act of family violence. If the offense involves serious injury and the arresting officer believes further violence is possible, it is bailable only before a judicial officer. HB 449 provides that a separate report shall be filed whenever a law enforcement officer responds to an incident involving family violence, and outlines the required contents of that report. Penal Institutions Probation: Provide Confinement Requirement Of Ninety Days For Certain Probationers To Be Fulfilled At Special Alternative Incarceration Boot Camps, Melodie Belcher

The Act provides that probationers who are not less than seventeen years old and not more than thirty years old, and who are sentenced to at least one year on probation, may be required to complete a period of ninety days of confinement in a special alternative incarceration boot camp. This will apply only to probationers not suffering any mental or physical handicaps which would prevent them from engaging in strenuous activity. Charisma, Empathy, And The Experience Of Telepathy, James M. Donovan

Law Faculty Scholarly Articles

A critique is offered of the preference of parapsychology for physical explanatory models for telepathy. Discussion shows this trend emerging from the combined effects of historical accident. An alternative explanatory model is offered which draws upon the rich but underutilized psychological foundations of parapsychology. Emphasizing telepathy's original definition as a communication event, two other phenomena are held to fall into the same class of events: charisma and empathy. Concepts traditionally used to understand charisma and empathy are shown to be equally suited for modeling telepathy. Experimental, theoretical, and especially philosophical implications of this "possible world" model are addressed throughout.

Direct Liability For Hazardous Substance Cleanups Under Cercla: A Comprehensive Approach, Michael P. Healy

In enacting the Comprehensive Environmental Response, Compensation & Liability Act (CERCLA), Congress intended to impose liability for hazardous substance cleanups on all parties responsible for a site's use and contamination. However, in implementing the CERCLA liability scheme, courts have issued opinions offering unclear and misguided explanations of their decisions. The author suggests that, to properly assure CERCLA's proper operation, the basis for the imposition of liability must be clarified. To this end, the author examines the prescribed liability for individuals, parent corporations and secured creditors and explains the appropriate grounds for the responsibility of each.
