Studies On Naturally Acquired Immunity To African Ticks. Ii. Observations On Cattle Exposed To Rhipicephalus Appendiculatus Under Varying Periods Of Repeated Infestations, Olusegun O. Dipeolu, Abdul O. Mongi, Suliman Essuman, Abimboia O. Amoo, Joseph N. Ndungu

All Peer-Reviewed Publications

Groups of Friesian cattle were infested repetedly with Rhipicephalus appendiculatus at weekly intervals (eight infestations) and at intervals of 3 weeks (seven infestations) and 6 weeks (seven infestations). The engorgement weight of adults, nymphs and larvae decreased significantly initially, from the second infestation, but rose significantly at later infestations. This rise was more dramatic with larval instars than with any other. A new method for quantifying the resistance status of animals was introduced; this method showed that the resistance acquired by cattle during 6-weekly reinfestations was more stable than that acquired by cattle during weekly and 3-weekly reinfestations. The criteria …

Book Review Of Dangerous Supplements: Resistance And Renewal In Jurisprudence, Richard F. Devlin Frsc Jan 1992

Book Review Of Dangerous Supplements: Resistance And Renewal In Jurisprudence, Richard F. Devlin Frsc

Articles, Book Chapters, & Popular Press

Dangerous Supplements: Resistance and Renewal in Jurisprudence (1991 ), edited by Peter Fitzpatrick, is the first instalment in a new series, Law and Social Theory, being published by the progressive British publisher Pluto Press. As someone who had been subjected to an intensely positivistic- perhaps even authoritarian- jurisprudential, undergraduate education in Belfast, both the title and the dustcover intrigued me. The latter portrays a towering, seemingly unassailable, citadel with "jurisprudence" inscribed upon it, being bombarded by paper planes with the insignia of critical theory, semiotics, feminism, postmodernism and "new ideas." This image led me to wonder whether the book would …

From Decentralization To Centralization: Members' Changing Expectations For House Leaders, Daniel J. Palazzolo Jan 1992

From Decentralization To Centralization: Members' Changing Expectations For House Leaders, Daniel J. Palazzolo

Political Science Faculty Publications

Before the reforms of the 1970s, at least since the revolt against Speaker Joseph G. Cannon in 1910, party leaders of the House of Representatives performed tasks designed to mediate party interests both within and outside of the House. Within the House, their most important functions included organizing the party, scheduling bills, building coalitions, distributing and collecting information, and maintaining party harmony (Ripley 1967). Meanwhile, committee chairs exercised the most discretion over specific policy issues. Outside of the House, the Speaker acted as a mediator between the majority party and the, president, especially if the president was of the same …

Where Have You Gone, Karl Llewellyn - Should Congress Turn Its Lonely Eyes To You, Stephen F. Ross

Faculty Scholarship

The purpose of this paper is to explore what, if anything, Congress should do about the canons of statutory construction to prevent judges who are more conservative (or perhaps, in a future era, more progressive) than the majority of the legislature from employing those canons to distort or frustrate legislative policy preferences.

Beyond The Privacy Principle, Kendall Thomas

In Bowers v. Hardwick, the U.S. Supreme Court was asked to ad-dress the constitutionality of a Georgia criminal statute prohibiting certain private sexual practices by consenting adults. The Georgia citizens who brought the suit sought a judgment regarding the constitutionality of the statute on its face, but the Court resolutely avoided consideration of that issue. The Court took the view that the only federal question properly before it was the constitutional validity of the law as applied to private, sexual activity by consenting adults of the same gender, or what it called "homosexual sodomy." Having thus limited the scope …

Real Jurors' Understanding Of The Law In Real Cases, Alan Reifman, Spencer M. Gusick, Phoebe C. Ellsworth Jan 1992

Real Jurors' Understanding Of The Law In Real Cases, Alan Reifman, Spencer M. Gusick, Phoebe C. Ellsworth

Articles

A survey of 224 Michigan citizens called for jury duty over a 2-month period was conducted to assess the jurors' comprehension of the law they had been given in the judges' instructions. Citizens who served as jurors were compared with a base line of those who were called for duty but not selected to serve, and with those who served on different kinds of cases. Consistent with previous studies of mock jurors, this study found that actual jurors understand fewer than half of the instructions they receive at trial. Subjects who received judges' instructions performed significantly better than uninstructed subjects …

Settling For A Judge: A Comment On Clermont And Eisenberg, Samuel R. Gross Jan 1992

Settling For A Judge: A Comment On Clermont And Eisenberg, Samuel R. Gross

Articles

Trial by Jury or Judge: Transcending Empiricism,1 by Kevin Clermont and Theodore Eisenberg, is not only an important article, it is unique. To most Americans, trial means trial by jury. In fact, over half of all federal trials are conducted without juries2 (including 31% of trials in cases in which the parties have the right to choose a jury3), and the proportion of bench trials in state courts is even higher.4 And yet, while there is a large literature on the outcomes of jury trials and the factors that affect them,5 nobody else has systematically compared trials by jury to …

The Tragedy Of The Commons, Part Two, James E. Krier Jan 1992

The Tragedy Of The Commons, Part Two, James E. Krier

Articles

This symposium is about the idea of "free market environmentalism" in general and the book Free Market Environmentalism, by Terry Anderson and Donald Leal,1 in particular. While I focus chiefly on Anderson and Leal's book, the discussion will necessarily involve the general idea of free market environmentalism as well. The conceit of my tide, which obviously derives from Garrett Hardin's celebrated essay on The Tragedy of the Commons,2 is this: Superficial differences aside, Hardin's essay and Anderson and Leal's book address the same fundamental problem of coordinating human behavior as it affects environmental quality. But both the essay and the …

Reforming The Law Of Gratuitous Transfers: The New Uniform Probate Code, John H. Langbein, Lawrence W. Waggoner Jan 1992

Reforming The Law Of Gratuitous Transfers: The New Uniform Probate Code, John H. Langbein, Lawrence W. Waggoner

Articles

In the mid-1980s the Uniform Law Commission undertook a landmark revision of the American law of gratuitous transfers. These reforms culminated in a drastically revised Uniform Probate Code ("UPC"). The revisions inspired the Albany Law Review to organize this symposium issue for the purpose of examining the 1990 UPC. In this introductory paper, we point to the main themes of the reform movement, discuss some of the traits and constraints of the uniform law process, and comment on some of the suggestions and insights that appear in the symposium articles.

Translation As A Mode Of Thought, James Boyd White Jan 1992

Translation As A Mode Of Thought, James Boyd White

Articles

I think that Clark Cunningham's article, The Lawyer as Translator, is a wonderful piece of work, full of life and interest and originality. I especially admire: his ability to make vivid to the reader the ways in which languages do truly differ, and differ beyond our efforts to bridge them-as he shows when he imagines an attempt to translate our most common professional terms into Chinese; his recoguition of the kind of force that our languages have over our minds, both as we see the world and as we tell stories about it; his sense that what we think of …

Identifying The Best Interests Of The Child In Protection Proceedings: Nine Guidelines For The Child Advocate., Donald N. Duquette Jan 1992

Identifying The Best Interests Of The Child In Protection Proceedings: Nine Guidelines For The Child Advocate., Donald N. Duquette

Articles

Increasingly, judges appoint court appointed special advocates (CASAs) to represent children in child abuse and neglect proceedings. Like lawyers, CASAs are charged with looking out for the "best interests" of the child. Unfortunately, although the phrase "best interests" sounds noble, it provides little practical guidance for the child advocate.

Foreword: Report Of The New York State Judicial Commission On Minorities, James C. Goodale Jan 1992

Foreword: Report Of The New York State Judicial Commission On Minorities, James C. Goodale

Fordham Urban Law Journal

Unfortunately, racism is still incredibly present in the New York State Court System, as found by the New York State Commission on Judicial Minorities. The Commission based its findings on academic research and anecdotal evidence. The commission cites examples like use of racist terminology by court employees as well as segregated locker rooms. To remedy this issue, the Commission recommends (1) the expanded hiring of minorities and (2) promotion decisions that do not discriminate against minorities.
