Advice For The New Law Professor: A View From The Trenches, Susan J. Becker Jan 1992

Advice For The New Law Professor: A View From The Trenches, Susan J. Becker

Law Faculty Articles and Essays

A decade ago, Professor Douglas Whaley published an essay that offers comfort and advice to those commencing the metamorphosis from practitioners, judicial clerks, and students into professors of law. The purpose of this article is twofold: to offer a confirmation from the trenches of many of Professor Whaley's observations and to supplement his suggestions with some of my own.

Conducting Informal Discovery Of A Party's Former Employees: Legal And Ethical Concerns And Constraints, Susan J. Becker Jan 1992

Conducting Informal Discovery Of A Party's Former Employees: Legal And Ethical Concerns And Constraints, Susan J. Becker

Law Faculty Articles and Essays

This Article identifies and critiques existing sources of confusion in the law and proposes revised and alternative discovery procedures to provide equal access to information possessed by ex-employees, while simultaneously safeguarding the integrity of that information. Its primary emphasis is on federal jurisprudence, although important points of consensus and departure between state and federal law are noted, as appropriate. Part I explains the issues that arise in informal discovery, and the difficulties with clearly resolving those issues given the conflicting state of the law. Part II discusses application of the attorney-client privilege to communications between corporate counsel and former employees, …

On Defining Academic Scholarship, Stephen J. Werber Jan 1992

On Defining Academic Scholarship, Stephen J. Werber

Law Faculty Articles and Essays

In 1970, I left the world of a litigation attorney and joined that of academia. One of the first survival lessons that I learned was that, in order to gain tenure and ultimately achieve the pinnacle of full professor, I had to establish myself as a scholar. This, I learned, meant that I had to publish. Perusal of the Personnel Policies of our University, which are similar to those of many others, indicated that a key to a successful career was that I produce "an outstanding record as a scholar." The closest definition to the term in the personnel policies …

American Constitutional Conventions: The Judicially Unenforceable Rules That Combine With Judicial Doctrine And Public Opinion To Regulate Political Behavior, James G. Wilson Jan 1992

American Constitutional Conventions: The Judicially Unenforceable Rules That Combine With Judicial Doctrine And Public Opinion To Regulate Political Behavior, James G. Wilson

Law Faculty Articles and Essays

The concept of nonjusticiability, reflected primarily through the “political question” and the “standing” doctrines, fails to give the Supreme Court (and the rest of us) adequate guidance on how to resolve many constitutional disputes, such as impeachment procedures and standards, congressional expulsions, the scope of federal court jurisdiction, and the use of force abroad. These two doctrines put the Supreme Court on the horns of a false dichotomy. The Court tends to withdraw completely from an issue and from enforcing a textual passage, such as the Republican Guarantee Clause, whenever it makes a determination of nonjusticiability. Conversely, once the Court …

All-Optical Synchronisation And Frequency Division Of Mode-Locked Pulses, P. Phelan, Gerald Farrell, Joe Hegarty Jan 1992

All-Optical Synchronisation And Frequency Division Of Mode-Locked Pulses, P. Phelan, Gerald Farrell, Joe Hegarty

Articles

We report all-optical synchronized multiplication by rational fractions of the modulation frequency of optical signals in self-pulsing two-section semiconductor laser diodes. The effect is based on the overlap of harmonics of the input signal with harmonics of the self-pulsation. We illustrate this new generic function with modelocked inputs rich in harmonics were fractions of 1,2, and 3 / 2 are generated, and we identify a number of applications for this effect.

Eminent Domain (Update), James E. Krier Jan 1992

Eminent Domain (Update), James E. Krier

Book Chapters

One of the most challenging and enduring puzzles in American constitutional law is how one distinguishes a compensable taking of power from a legitimate and noncompensable exercise of the police power. To suggest the Supreme Court’s approach to the question, Harry N. Scheiber, author of the Encyclopedia’s principal article on eminent domain, looked back and away from the Court to Chief Justice Lemuel Shaw of Massachusetts.

Sex Discrimination (Update 1), Christina B. Whitman Jan 1992

Sex Discrimination (Update 1), Christina B. Whitman

Book Chapters

During the 1980s and early 1990s intense disagreement has arisen over the appropriate strategy for eliminating sex discrimination. Some courts and commentators argue for gender-neutral rules that define categories in purely functional terms. Others, who point out that gender-neutral rules promise equality only for women who can meet a ‘‘male standard,’’ think that legal distinctions between the sexes are not only appropriate but necessary, at least in cases involving perceived biological differences. Still others refuse to think in terms of sameness and difference. They analyze each issue by asking whether the disputed rule furthers the domination of men and the …

John Donne's Verse Letters To Lucy Russell, Countess Of Bedford: Rhetorical Means To A Friendship., Joan Frances Faust Jan 1992

John Donne's Verse Letters To Lucy Russell, Countess Of Bedford: Rhetorical Means To A Friendship., Joan Frances Faust

LSU Historical Dissertations and Theses

John Donne's verse letters to Lucy Russell, Countess of Bedford, are more than static hyperbolic praise to a patroness interchangeable with any other patroness. Rather, they are viable and personal means by which Donne creates and sustains a friendship. Through the five verse letters examined in this dissertation, "Reason is the soules left hand," "You have refin'd mee," "T'Have written then," "To the Countesse of Bedford At New-yeares Tide," and "Honour is so sublime perfection," Donne rhetorically demonstrates his understanding of and ability to function within the various contexts of Bedford's life. Using the accepted view of the epistolary form …

Effects Of Job Applicant Past Performance And Interpersonal Attraction On Evaluator Attributions And Selection Decisions., Carl R. Phillips Jan 1992

Effects Of Job Applicant Past Performance And Interpersonal Attraction On Evaluator Attributions And Selection Decisions., Carl R. Phillips

LSU Historical Dissertations and Theses

The purpose of the present study was to examine the main and interactive effects of applicant past performance and interpersonal attraction on evaluator attributions and selection decisions; and the effects of evaluator attributions on selection decisions. One hundred seventy-two male and female students enrolled in undergraduate principles of management classes participated in the study. Subjects evaluated an application for an on-campus position and were asked to make selection decisions (i.e., rating applicant's chances of being selected for an interview and eventually receiving a job offer). The results indicated a main effect of applicant past performance (educational and work-related) on selection …

The Purification Of Mcrb And Mcrc Proteins In Mcrbc Restriction System Of Escherichia Coli K12 And Dna Sequencing Of The Region Downstream Of Mcrc., Ling Zheng Jan 1992

The Purification Of Mcrb And Mcrc Proteins In Mcrbc Restriction System Of Escherichia Coli K12 And Dna Sequencing Of The Region Downstream Of Mcrc., Ling Zheng

LSU Historical Dissertations and Theses

The McrBC restriction system of Escherichia coli K12 degrades methylcytosine-containing foreign DNA. Two genes mcrB and mcrC had been shown to be required for the McrBC restriction (Ross, et al., J. Bacteriol., 1989b). To explore the involvement of additional gene(s), a 1.7 kb fragment downstream of the mcrC was cloned and sequenced. Also mutants containing deletion in mcrBC or the downstream region were isolated by transposon excision. Genetic complementation studies confirmed that only DNA containing mcrB and mcrC gene on a high copy plasmid were needed to fully restored McrBC restriction. Deletion of the 1.7 kb fragment from or addition …

Plasticity-Damage Bounding Surface Model For Concrete Under Cyclic-Multiaxial Loading., Taher Mowafaq Abu-Lebdeh Jan 1992

Plasticity-Damage Bounding Surface Model For Concrete Under Cyclic-Multiaxial Loading., Taher Mowafaq Abu-Lebdeh

LSU Historical Dissertations and Theses

Concrete exhibits a significant strain-softening behavior beyond the peak stress, and moreover, the mechanism of inelastic deformation in concrete consists of both plastic slip and microcracking. Hence, a combined plasticity and damage mechanics model is proposed for modeling concrete behavior under both multiaxial monotonic and cyclic loadings. The model adopts a bounding surface concept for both plasticity and damage. The introduced plasticity bounding surface is a function of the maximum compressive strain experience by the material, while the damage bounding surface is a function of the accumulated damage parameter. By this definition, both surfaces shrink in size in the stress …

The Epidemiology Of The Soybean/Diaporthe Phaseolorum Var. Caulivora Pathosystem In Louisiana., Guy Boyd Padgett Jan 1992

The Epidemiology Of The Soybean/Diaporthe Phaseolorum Var. Caulivora Pathosystem In Louisiana., Guy Boyd Padgett

LSU Historical Dissertations and Theses

Field and greenhouse experiments were conducted during 1988-1991 to investigate the epidemiology of the soybean/Diaporthe phaseolorum var. caulivora (Dpc) pathosystem. The following points were addressed: (i) the effect of inoculation timing on soybean yield and disease severity, (ii) the efficacy of Dpc inoculum during the growing season, (iii) the possibility of alternative hosts for Dpc, and (iv) the relationship between threecornered alfalfa hopper injury and stem canker severity. Inoculation timing had a significant effect on the yield of Dpc susceptible or moderately susceptible soybean cultivars. Soybean yield was reduced most (83 to 93%) and disease severity was greatest (84 to …
