Locus Of Control Orientation Of Male Alcoholics In A Chemical Dependency Treatment Program, Barbara Nelle Vesely Jul 1992

Locus Of Control Orientation Of Male Alcoholics In A Chemical Dependency Treatment Program, Barbara Nelle Vesely

Theses and Dissertations

The present study was designed to investigate the relationship between locus of control and alcoholism. The questions which this study sought to address included a comparison of locus of control in inpatient and outpatient white male treatment groups with a nonalcoholic control group. In addition changes in locus of control during alcohol treatment were also assessed.

A total of 129 white men were placed into one of three groups. Thirty-one men from the community who scored within the nonalcoholic range on the Michigan Alcoholism Screening Test (MAST) made up the control group. Two groups of men in treatment for alcoholism …

Constitutional Criminal Law, Peggy Natale, Anthony J. Natale Jul 1992

Constitutional Criminal Law, Peggy Natale, Anthony J. Natale

Mercer Law Review

Last year, the Eleventh Circuit examined some interesting constitutional issues that affect defendants in criminal cases. What follows are the most significant of those constitutional issue cases, and an additional criminal case of first impression to the Eleventh Circuit Court of Appeals. The authors have made no effort to provide an exhaustive digest of all the court's opinions for the 1991 year.

  • First Amendment
  • Fourth Amendment
  • Fifth Amendment
  • Sixth Amendment
  • Case of First Impression

Antitrust, Carl W. Mullis Iii Jul 1992

Antitrust, Carl W. Mullis Iii

Mercer Law Review

In 1991, the Eleventh Circuit ruled on eight full-blown federal antitrust decisions. Although the courts below found for defendants in each of these cases, the Eleventh Circuit found primarily for plaintiffs in three of the cases, for defendants in four of the cases, and for both plaintiffs and defendants in one case. Several of the cases are significant in that they either explore new areas in the antitrust law or have the potential for nationwide influence. Most of the cases simply build on previous holdings of the Eleventh Circuit and are well reasoned. One or two cases, however, contain some …

Evidence, Marc T. Treadwell Jul 1992

Evidence, Marc T. Treadwell

Mercer Law Review

For the past several years, the State Bar of Georgia has lobbied vigorously for the adoption of a new Georgia Evidence Code based upon the Federal Rules of Evidence. Few would dispute that the existing Georgia Evidence Code, which really is not a code at all but rather an amorphous amalgam of disjointed statutes and thousands of judicial decisions, is in need of revision. Apparently, however, there is considerable dispute regarding exactly what changes should be made.

The proposed Georgia Rules of Evidence is the product of an intensive study by the State Bar of the deficiencies of the existing …

More specifically, the cases addressed include noteworthy decisions under the National Labor Relations Act ("NLRA"), the Labor-Management Relations Act ("LMRA"), the Labor-Management Reporting and Disclosure Act of 1959 ("LMRDA"), the Fair Labor Standards Act of 1938 ("FLSA"), and the Employee Retirement Income Security Act of 1974 ("ERISA").

Trial Practice And Procedure, Benton J. Mathis Jr., Leigh C. Lawson Jul 1992

Trial Practice And Procedure, Benton J. Mathis Jr., Leigh C. Lawson

Mercer Law Review

This Article surveys the 1991 decisions of the Eleventh Circuit Court of Appeals that made a significant impact upon the area of trial practice and procedure. One of the most important developments in this area of law occurred in the case Wright v. Preferred Research, Inc. In Wright the Eleventh Circuit examined closely Federal Rule of Civil Procedure 58 and, in a case of first impression, held that when a district court amends a judgment, Rule 58 did not require that a separate document, setting out the terms of the remitted judgment, be entered before the time for the appeal …

Harris V. Thigpen: Segregating Hiv-Positive Inmates In The Alabama Correctional System, Thomas E. Best Jul 1992

Harris V. Thigpen: Segregating Hiv-Positive Inmates In The Alabama Correctional System, Thomas E. Best

Mercer Law Review

In Harris v. Thigpen, the Eleventh Circuit Court of Appeals largely upheld an Alabama statute which requires that all incoming prison inmates in correctional facilities be tested for sexually transmitted diseases, including the presence of the Human Immunodeficiency Virus disease ("HIV disease"). Carmen Harris, an inmate in the Alabama Correctional System whose tests showed the presence of HIV disease, brought this action challenging the mandatory testing and forced segregation from the general prison population of inmates who tested positive. On appeal, plaintiff brought three constitutional challenges and a statutory challenge: the inadequate medical care provided to HIV-positive inmates violated …

United States V. Elgersma: The Burden Of Proof In Criminal Forfeiture Proceedings Under 21 U.S.C. § 853, James D. Tolliver

Mercer Law Review

In United States v. Elgersma, the Eleventh Circuit Court of Appeals decided the issue of what burden of proof applies to a criminal forfeiture proceeding under section 853 of the Comprehensive Crime Control Act of 19842 ("section 853"). After examining the legislative history of section

853 and case law- from its own and other circuits, the court held that criminal forfeiture is a criminal charge requiring the government to prove the guilt of the accused beyond a reasonable doubt. A majority of the court rejected Judge Anderson's concurring opinion in which he argued that criminal forfeiture is an element …

Westin V. Mcdaniel: An Interesting Twist On Younger Abstention, Robert T. Prior Jul 1992

Westin V. Mcdaniel: An Interesting Twist On Younger Abstention, Robert T. Prior

Mercer Law Review

In Westin v. McDaniel, the District Court for the Middle District of Georgia granted a preliminary injunction prohibiting the State of Georgia from prosecuting a criminal defense attorney for hindering an undercover police officer. Judge Fitzpatrick ruled that the traditional notions of federalism and comity, which normally preclude a federal court from intervening in state criminal proceedings, were inapplicable because no state case was pending against the attorney when the federal action was brought. He further ruled that even if those principles were applicable, federal intervention was still appropriate because the prosecuting attorney acted in "bad faith" in seeking an …

A Road Less Traveled To A Federal Era, John Paul Jones Jul 1992

A Road Less Traveled To A Federal Era, John Paul Jones

Law Faculty Publications

Professor Jones examines efforts to ratify the federal Equal Rights Amendment which ended unsuccessfully in 1982. He argues that efforts to use the federal courts to fill in the gaps in protection of rights based on gender are likely to fall far short of what the Amendment would have provided, and that a renewed attempt at ratification would likely meet the same fate as the earlier one. He suggests a third alternative, U.S. ratification of the Convention on the Elimination of All Forms of Discrimination against Women, as the most feasible means of achieving the goals of the ERA without …

Pushing The Boundaries Of Education: The Implications Of A Youth Development Approach To Education Policies, Structures And Collabnrations, Karen J. Pittman, Michele Cahill

School K-12

In recent years there have been an extraordinary number of proposals for comprehensive and intensive changes in school structure, finance, and administration, one indication that this is a time of unprecedent change for schools. One of the forces driving this intense focus on school change is the growing national concern about youth issues and problems. This paper notes the myriad of add-on programs that compete for space in the school day and takes the position that, rather than being seen as merely additive, education and services should be viewed as interactive, and essential to the formation of new effective strategies for …

Bioethics And The Family: The Cautionary View From Family Law, Carl E. Schneider Jul 1992

Bioethics And The Family: The Cautionary View From Family Law, Carl E. Schneider

Articles

For many years, the field of bioethics has been specially concerned with how the authority to make medical decisions should be allocated between doctor and patient. Today the patient's power-indeed, the patient's right-is widely acknowledged, at least in principle. But this development can hardly be the last word in our thinking about how medical decisions should be made. For one thing, sometimes patients cannot speak for themselves. For another, patients· make medical decisions in contexts that significantly include more participants than just the patient and doctor. Now, as this conference demonstrates, bioethics is beginning to ask what role the patient's …

Mathematical Modeling Of Incompressible Flow Through A Collapsible Tube, Jennifer L. Lowdermilk Jul 1992

Mathematical Modeling Of Incompressible Flow Through A Collapsible Tube, Jennifer L. Lowdermilk

Theses

An in-depth examination of eight articles pertaining to collapsible tube phenomenon is provided. Experimental models and mathematical models are explored. Two mathematical models are developed by the author, each of which attempt to reproduce experimental data provided by Lyon [37]. Respective models produce sets of coupled differential equations, and Advanced Continuous Simulation Language (ACSL) is utilized to solve these equations. Neither of the author's models provides total numerical reproductions of the experimental data under consideration. However, general trends are obtained which correspond to those observed in Lyon's data. General responses to variations in system parameters are provided for both models.

Trial By Jury Or Judge: Transcending Empiricism, Kevin M. Clermont, Theodore Eisenberg Jul 1992

Trial By Jury Or Judge: Transcending Empiricism, Kevin M. Clermont, Theodore Eisenberg

Cornell Law Faculty Publications

Pity the civil jury, seen by some as the sickest organ of a sick system. Yet the jury has always been controversial. One might suppose that, with so much at stake for so long, we would all know a lot about the ways juries differ from judges in their behavior. In fact, we know remarkably little. This Article provides the first large-scale comparison of plaintiff win rates and recoveries in civil cases tried before juries and judges. In two of the most controversial areas of modern tort law--product liability and medical malpractice--the win rates substantially differ from other cases' win …

The Corporate Officer's Independent Duty As A Tonic For The Anemic Law Of Executive Compensation, Douglas C. Michael Jul 1992

The Corporate Officer's Independent Duty As A Tonic For The Anemic Law Of Executive Compensation, Douglas C. Michael

Law Faculty Scholarly Articles

History repeats itself in the law as in other arenas. In the law of executive compensation, such a repetition may be imminent. Ever since the advent of the large industrial corporation in the United States, there has been periodic outrage at payments made to its top executives. This repetition suggests that the law has failed to keep pace with the observed problems. Part I of this Article describes the current and historic uproar over executive compensation in large corporations in the United States. Part II provides the economic background of the process of negotiating executive compensation. Part III analyzes the …

Federal Taxation, Steven C. Evans Jul 1992

Federal Taxation, Steven C. Evans

Mercer Law Review

The federal tax cases decided by the Eleventh Circuit during 1991 reversed one trend and continued another trend of 1990. The Eleventh Circuit decided a number of procedural tax cases during 1991. This trend is similar to the number of procedural cases decided in years prior to 1990, but is substantially more than the number of procedural cases decided by the Eleventh Circuit in 1990. Cases decided under the Employment Retirement Income Security Act of 1974 ("ERISA"), as amended, continued to constitute the majority of the substantive tax cases decided by the Eleventh Circuit during 1991.
