Rights Of Washington Junior Lienors In Nonjudicial Foreclosure—Washington Mutual Savings Bank V. United States, 115 Wash. 2d 52, 793 P.2d 969, Clarified, Reconsideration Denied, 800 P.2d 1124 (Wash. 1990), John D. Sullivan Jan 1992

Rights Of Washington Junior Lienors In Nonjudicial Foreclosure—Washington Mutual Savings Bank V. United States, 115 Wash. 2d 52, 793 P.2d 969, Clarified, Reconsideration Denied, 800 P.2d 1124 (Wash. 1990), John D. Sullivan

Washington Law Review

In Washington Mutual Savings Bank v. United State, the Washington Supreme Court extended the anti-deficiency provisions of the Deed of Trust Act to all non-foreclosing junior lienors. Because this decision makes all junior obligations uncollectible following a nonjudicial foreclosure, it may have a chilling effect on lenders and a serious impact on the availability of home equity loans. This Note examines the Washington Mutual decision and suggests that the court should have determined instead that a deficiency is allowed, but should be computed after applying any surplus value in the property sold against junior obligations. This Note also recommends a …

An Early Childhood Study Of The Water Cycle, Jolynne Taylor Miner Jan 1992

An Early Childhood Study Of The Water Cycle, Jolynne Taylor Miner

UNLV Retrospective Theses & Dissertations

Young children's understanding of the water cycle was investigated. Sixty children were individually interviewed using the "Survey of Understanding of the Water Cycle." The answers were then scored according to a scale of Four Levels of UnderstanDing A t-test and chi-square test were run. Answers were carefully examined to determine how much young children understand about the water cycle, to see what misconceptions they have about the water cycle, and to compare children's understanding of the water cycle between those children who live in a desert region and those children who live in a mountainous region. The results indicate that …

Spelling In The Secondary School: A Review Of The Current Situation, Joan Rodrigues

Theses : Honours

The purpose of this study was to discover the strategies being employed by secondary school teachers to assist students with spelling difficulties. Teachers in the English and social studies departments of three Perth high schools were interviewed and asked to indicate the criteria they used to identify students with spelling problems and the teaching methods they employed to help those students overcome their problems. They were also asked to identify the causes of spelling difficulty. Staff at the local district offices and the Ministry of Education were interviewed to establish what support services were available for teachers who wished to …

A Case Study Of Professional Ballroom Dance Instructors, Diana Jonas-Dwyer

Theses : Honours

This study investigates factors that influence both full time and part time ballroom dance instructors engaged in competitive and non-competitive dance instruction. A case study approach has been adopted to describe three dance instructors. Two of these instructors are a married couple who are full time professional ballroom dance instructors who are also the proprietors of a Perth metropolitan dance studio. The third professional instructor is a part time employee. The case study approach is utilized to gain insight into the perceptions of the instructors as to the demands that are made upon them. Participant observation, interview and documents are …

Heterogeneous Macromolecular Composition Of Renal Basement Membranes In Health, Diabetes And Glomerulonephritis, Douglas K. Brees Jan 1992

Heterogeneous Macromolecular Composition Of Renal Basement Membranes In Health, Diabetes And Glomerulonephritis, Douglas K. Brees

MUSC Theses and Dissertations

Although basement membranes are ubiquitous structures throughout the body, basement membranes have distinct compositions that are specific to their location. This basement membrane heterogeneity may, in part, reflect functional differences among various basement membranes. We examined basement membrane heterogeneity in normal, healthy mouse kidneys to assess the similarities and differences between glomerular and tubular basement membrane composition. It was demonstrated that mouse glomerular and tubular basement membrane share similar compositions but differ with respect to specific amounts of some components. In diabetes mellitus and passive Heymann nephritis (PHN), damage to the glomerular barrier occurs and is accompanied by an increase …

Basic Public Speaking Principles: An Examination Of Twelve Popular Texts, Jon A. Hess, Judy C. Pearson

Basic Communication Course Annual

The importance of the basic course is reflected in the number of published articles focused on it. Aside from having an annually published journal (The Basic Communication Course Annual) devoted to it, articles concerning the basic course are sprinkled throughout many of the discipline's journals. However, Schneider (1991) pointed out that few studies have focused on the textbooks used. Since the textbook is generally the foundation upon which the course is built, it is an important object of study.

Although the term basic course may be used to identify a variety of courses (such as public speaking, interpersonal communication, hybrid …

Critical Thinking Is/As Communication, Warren Sandmann Jan 1992

Critical Thinking Is/As Communication, Warren Sandmann

Basic Communication Course Annual

This essay argues for the place of critical thinking in the basic communication course. Included in the argument is a discussion and critique of traditional modes of critical thinking, an analysis of an alternative approach to critical thinking, the grounding of this alternative approach in a classical communication model, a discussion of why the basic course in communication is the most appropriate home for the teaching of critical thinking, and a sample approach to teaching critical thinking in the basic course.

Practical Reason: The Commercial Speech Paradigm, Edward J. Eberle Jan 1992

Practical Reason: The Commercial Speech Paradigm, Edward J. Eberle

Law Faculty Scholarship

First Amendment jurisprudence incorporates a continual struggle to balance coflicting interests. Free speech values must be weighed against communitarian interests in a rational manner. The article examines the foundationalist approach to this task, and finds it incapable of providing a unified First Amendment theory. Through examination of the treatment of commercial speech, the article arrives at a more coherent approach through the application of practical reasoning. The proposed methodology allows for principled analysis and decisions which yield an internally consistent body of law.

Treaty-Based Rights And Remedies Of Individuals, Carlos Manuel Vázquez Jan 1992

Treaty-Based Rights And Remedies Of Individuals, Carlos Manuel Vázquez

Georgetown Law Faculty Publications and Other Works

Treaties are frequently described as contracts between nations. As instruments of international law, they establish obligations with which international law requires the parties to comply. In the United States, treaties also have the status of law in the domestic legal system. The Supremacy Clause declares treaties to be the "supreme Law of the Land" and instructs the courts to give them effect. The status of treaties as law in two distinct legal orders has given rise to unusual conceptual problems. In recent years, it has produced confusion among the courts regarding the enforceability of treaties in the courts by individuals. …

Fe Ii Fluorescence And Anomalous C Iv Doublet Intensities In Symbiotic Novae, A. G. Michalitsianos, Menas Kafatos, S. R. Meier Jan 1992

Fe Ii Fluorescence And Anomalous C Iv Doublet Intensities In Symbiotic Novae, A. G. Michalitsianos, Menas Kafatos, S. R. Meier

Mathematics, Physics, and Computer Science Faculty Articles and Research

Symbiotic stars frequently exhibit anomalous C IV λλ1548.2, 1550.8 doublet flux ratios, in which the intensity ratio of the blue and red doublet members is below the optically thick limit of unity. Three symbiotic stars (RR Tel, RX Pup, and AG Peg) have been investigated in detail with high-resolution spectra obtained from the International Ultraviolet Explorer (IUE) archives. We have examined the deficit of C IV λ1548.2 emission relative to λ1550.8 in context with the fluorescent pumping of the Fe II multiplet (45.01) λ1548.204 by the C IV λ1548.2 line. In RR Tel the C IV λ1548.2 flux is correlated …
