This work is a continuation of the debate regarding the Establishment Clause. The focus lies with Justice O’Connor’s concurrence in County of Allegheny v. ACLU and how this opinion harkens back to a concept shared by Jefferson and Madison, that the establishment clause is designed to prevent government favoritism.

Performance Evaluation Of A User Network Interface For Atm Networks, Andreas D. Bovopoulos, Einir Valdimarsson Oct 1990

Performance Evaluation Of A User Network Interface For Atm Networks, Andreas D. Bovopoulos, Einir Valdimarsson

All Computer Science and Engineering Research

In this paper the functionality requirements of a user-network interface for bandwidth allocation are discussed. Such requirements include the capability to provide end users with a variety of non-deteriorating connection types. In addition effective policy enforcement and traffic shaping mechanisms are required to facilitate network management and the efficient utilization of network resources. Based on these requirements, a user-network interface model is proposed, and its performance is studied. Its intrinsic properties are revealed for two cases, a Poisson source and a bursty source.

The Effect Of Externally Applied Oscillating Electric Fields On The L=1 And L=2 Diocotron Modes In Non-Neutral Plasmas, Ross L. Spencer Oct 1990

The Effect Of Externally Applied Oscillating Electric Fields On The L=1 And L=2 Diocotron Modes In Non-Neutral Plasmas, Ross L. Spencer

Faculty Publications

A high-frequency oscillating electric field can change the properties of diocotron modes in non-neutral plasmas. The effect depends crucially on the azimuthal mode number, m, of the applied field. For m=0, plus or minus 1 there is no effect, and for applied standing waves there is also no effect. But if the applied field has the form of a traveling wave with the norm of m greater than or equal to 2, the frequency of stable diocotron modes can be modified and for the norm of m greater than or equal to 3, the l=2 instability of hollow density profiles …

The Law Of The Commons: A Framework For The Efficient And Equitable Use Of The Lagrange Points, Lawrence D. Roberts Oct 1990

The Law Of The Commons: A Framework For The Efficient And Equitable Use Of The Lagrange Points, Lawrence D. Roberts

Connecticut Journal of International Law

Poets are fond of speaking of outer space as infinite. Having a diameter of billions of light years, the vastness of the universe might just as well be described as infinite. As a practical matter, however, space is finite. That portion of the universe which can be touched by mankind given current technological prowess is comparatively minuscule; encompassing (if one is charitable) only our own solar system. Given the limits imposed by the current state of technology and economic realities, the resources of outer space should be construed as exhaustible, and the acts of one spacefaring nation can and often …

Trade Adjustment Assistance: An Analysis, Mary Anne Joseph Oct 1990

Trade Adjustment Assistance: An Analysis, Mary Anne Joseph

Connecticut Journal of International Law

International trade is regulated and protected by laws promulgated by individual nations and by international law produced under the ongoing General Agreement on Tariffs and Trade1 [hereinafter GATT]. This comment will address a specific United States program, trade adjustment assistance, which attempts to protect United States industries from harm caused by increased foreign imports.

The trade adjustment assistance program will be initially introduced within the framework of the GATT provision allowing such protection. The comment will then briefly review the history of United States escape clause relief provisions. It will examine the adjustment assistance program, including the program's goals, the …

Nauru V. Australia: A Sacred Trust Betrayed?, Ellen M. Fitzgerald Oct 1990

Nauru V. Australia: A Sacred Trust Betrayed?, Ellen M. Fitzgerald

Connecticut Journal of International Law

In May of 1989, the Republic of Nauru, an island nation in the Pacific measuring 8.25 square miles,' filed suit against the Commonwealth of Australia in the International Court of Justice.2 The fundamental legal framework for the Nauruan claim is the 1947 Agreement between Australia, New Zealand and Great Britain, which rendered Nauru a United Nations Trust Territory principally administered by Australia. The factual focus of the pending litigation, however, is an issue which has characterized the relationship between the tiny island and Australia since the early twentieth century; the use, alleged misuse and rehabilitation (or lack thereof) of "certain …

International Law Revisited: Davis V. Davis And The Need For Coherent Policy On The Status Of The Embryo, Dan Fabricant Oct 1990

International Law Revisited: Davis V. Davis And The Need For Coherent Policy On The Status Of The Embryo, Dan Fabricant

Connecticut Journal of International Law

In the dozen years since in vitro fertilization (IVF) led to the world's first "test-tube" baby1 and painted a suddenly brilliant horizon for millions of infertile couples, the legal and ethical dilemmas accompanying biotech developments have remained largely overshadowed by the abortion debate that has transfixed the American consciousness since Roe v. Wade.2 When these dilemmas have surfaced, they have illustrated how immensely difficult it is to find principled, policy-oriented solutions to problems that implicate fundamental concerns such as when life begins and, more basically, what constitutes life itself. More importantly, they have served to illustrate the need to re-examine …

The New "Jamaica Discipline": Problems With Piracy, Maritime Terrorism And The 1982 Convention On The Law Of The Sea, Samuel Pyeatt Menefee Oct 1990

The New "Jamaica Discipline": Problems With Piracy, Maritime Terrorism And The 1982 Convention On The Law Of The Sea, Samuel Pyeatt Menefee

Connecticut Journal of International Law

To an 18th-century seafarer, "Jamaica discipline" represented the temptation to go a-pirating. Far from being the chaos and anarchy represented in the grade B movies of our youth, piracy was a business, and the pirate was as conscious of his obligations and rights as any Mafia capo. For the captains and sailors who crossed the line of legality to go "on the account," 2 the articles of Jamaica discipline - while differing from crew to crew - represented a social contract, indeed a treaty in microcosm, which enabled the business of piracy to thrive.

Today, two centuries later, "Jamaica discipline," …

Policing The World: The Long Reach Of U.S. Law And The Short Arm Of The Constitution, Mark Gibney Oct 1990

Policing The World: The Long Reach Of U.S. Law And The Short Arm Of The Constitution, Mark Gibney

Connecticut Journal of International Law

One of the most noteworthy and troubling aspects of this nation's latest "war on drugs" 1 is how far it has gone in erasing the distinction between what is considered domestic and what is considered international, and also the distinction between law enforcement, on the one hand, and military or national security affairs on the other. In simpler times, we had domestic law enforcement agents who, among other things, sought to prosecute those who violated criminal laws-local, state and federal-related to the use, transportation and manufacturing of controlled substances.' Not only were the officials responsible for ferreting out drug violations …

Undoing And Redoing Business In South Africa: The Lifting Of The Comprehensive Anti-Apartheid Act Of 1986 And The Continuing Validity Of State And Local Anti-Apartheid Legislation, Lynn Berat Oct 1990

Undoing And Redoing Business In South Africa: The Lifting Of The Comprehensive Anti-Apartheid Act Of 1986 And The Continuing Validity Of State And Local Anti-Apartheid Legislation, Lynn Berat

Connecticut Journal of International Law

Foreign investment, direct and indirect, has been of great importance to the South African economy. After World War II, South Africa's cheap labor system attracted billions of dollars in direct foreign investment.' Although the apartheid system of cheap labor was largely responsible for the favorable investment climate,2 the United States government adopted a neutral policy on South African investment by United States companies.' Even the Carter Administration with its foreign policy emphasis on North/South and human rights issues reiterated this position stressing that "[t]he Government should therefore normally avoid measures which would give special incentives or disincentives to investment flows …
