The Prospects For Enforcing Monetary Judgments Of The International Court Of Justice: A Study Of Nicaragua's Judgment Against The United States, Mary Ellen O'Connell Jan 1990

The Prospects For Enforcing Monetary Judgments Of The International Court Of Justice: A Study Of Nicaragua's Judgment Against The United States, Mary Ellen O'Connell

Journal Articles

In March 1988, Nicaragua's Sandinista government asked the International Court of Justice ("ICJ") to order the United States to pay $12 billion for violations of international law, as determined by the Court in June 1986. Before the Court could rule, however, the Sandinistas were voted out of office in national elections on February 25, 1990. Nicaragua's new government has recently indicated that it does not intend to give up the claim but will seek a settlement of the judgment with the United States government. But if the parties cannot reach a voluntary settlement, can Nicaragua enforce an ICJ judgment against …

Foreword, G. Robert Blakey Jan 1990

Foreword, G. Robert Blakey

Journal Articles

The past twenty years witnessed a sea change in the way that organized crime is investigated, prosecuted, and sanctioned, both criminally and civilly. RICO allowed the law to catch up with the rest of society. In the twentieth century, organizations, not people, control the important elements of society such as: government, commerce and labor. Until the passage of RICO, organizations as such were seldom the fcus of the law-outside of, perhaps, the antitrust statutes. This is no longer true.

RICO, however, is not limited to the activities of traditional Mafia families. It does not matter to a racketeering victim what …

Dispute Processing And A Longitudinal Approach To Trial Courts, Lynn M. Mather Jan 1990

Dispute Processing And A Longitudinal Approach To Trial Courts, Lynn M. Mather

Journal Articles

This article suggests ways to integrate the insights and findings of two rather distinct fields: docket-based, longitudinal studies of trial courts and studies of dispute processing. In particular, I argue that longitudinal research on courts would benefit enormously from the incorporation of concepts and data on dispute processing. For example, instead of taking court cases as the starting point for study, longitudinal research should explore the multistage and transformative nature of disputing. Historical data should also be collected on the nature of the relationships between opposing litigants, on the roles played by participants other than the litigants (lawyers, supporters, audiences, …

Litigation Across Space And Time: Courts, Conflict, And Social Change, David M. Engel Jan 1990

Litigation Across Space And Time: Courts, Conflict, And Social Change, David M. Engel

Journal Articles

One of the problems facing researchers who have studied courts across time and space has been the cultural variability of seemingly uniform analytic categories, including conceptions of time and space themselves. This article proposes that we take such variations in meaning as a starting point for comparative studies of courts and social change rather than viewing them as were "noise" in the system. Litigation in Chiangmai, Thailand, is presented as an example. Changing conceptions of "space" in Thailand from the nineteenth century to the present illustrate the transformation of legal and political authority as well as the proliferation of normative …

Turkey's Experience With Corporatism, Nilgun Onder Jan 1990

Turkey's Experience With Corporatism, Nilgun Onder

Theses and Dissertations (Comprehensive)

The purpose of this study is to explore Turkey’s experience with corporatism from the founding of the Republic in 1923 onwards. In this study, corporatism is defined as a particular political structure within the capitalist system which acts as a linkage mechanism between the state and society. It is basically related to labour and capital organizations, and their relationship to the state.

The analysis of the Turkish case remains loyal to the traditional authoritarian/liberal corporatism classification. It is asked whether Turkey exhibits the characteristics of authoritarian corporatism or liberal corporatism, or both? Was there a transition from one type to …

The Early Latin Sources For The Legend Of St. Martha A Study And Translation With Critical Notes, Diane Peters Jan 1990

The Early Latin Sources For The Legend Of St. Martha A Study And Translation With Critical Notes, Diane Peters

Theses and Dissertations (Comprehensive)

This dissertation focuses on the legends surrounding St. Martha of Bethany. Four major Latin versions are extant, dating from the late twelfth to the mid-thirteenth centuries: the Vita Pseudo-Marcilia, the Vita Beatae Mariae Magdalenae et Sororis Eius Sanctae Marthae, and selected chapters in Vincent of Beauvais’ Speculum Historiale and Jacobus de Voragine’s Legenda Aurea. In these lives of the saint, traditional material derived from Scripture is supplemented by descriptions of Martha’s legendary life as an early missionary in Provence. The substance of these legends proved extremely influential for art and vernacular literature in the later Middle Ages. The text which …

Leisure Lifestyle And Perceived Social Support Of Older Adults In A Rural Environment, Elizabeth Dow Pittaway

Theses and Dissertations (Comprehensive)

The purpose of this study was to gain an understanding of the leisure lifestyles of rural older adults and specifically to determine whether a relationship existed among leisure lifestyle, perceived social support, and well-being. Control variables included socio-demographic factors, value of leisure, satisfaction with life domains, length of residency, ethnicity, religion, and personal and structural barriers. The theoretical framework included social exchange theory and social support perspectives. A descriptive correlational research design was utilized and a mail survey questionnaire was developed and distributed to people 55 and older. Rural older adults spent more time on indoor leisure compared to outdoor …

Remaking The Constitution: A Critical Reexamination Of The Bowers V. Hardwick Dissent, Gerard V. Bradley

Journal Articles

Not only in folklore do historical watersheds spring from trickles. We all have heard that Mrs. O'Leary's cow kicked over a lamp to start the Chicago fire, and even sober history texts tell us that one Gavrilo Princip started World War I. Princip was a politically overactive Serbian nationalist destined to die of tuberculosis in an Austrian prison, but not before immortalizing himself on June 28, 1914. That day the nineteen-year-old Princip shot and killed Austrian Archduke Francis Ferdinand and his wife as they rode in an open car through Sarajevo, Yugoslavia. The occasion, or excuse, for release of smoldering …

Endocrinological Analysis Of Sandpiper Social Systems., Cheri Lynn Gratto Jan 1990

Endocrinological Analysis Of Sandpiper Social Systems., Cheri Lynn Gratto

Theses and Dissertations

I examined the endocrinological regulation of social behavior in two sympatric species of sandpipers exhibiting very different social systems. Semipalmated Sandpipers (Calidris pusilla) are monogamous and territorial, while Red-necked Phalaropes (Phalaropus lobatus) are facultatively polyandrous and non-territorial. Both parents incubate equally in the Semipalmated Sandpiper, while only male phalaropes care for eggs and young. By comparing circulating hormone levels (prolactin, testosterone, progesterone, and estradiol) between species and sexes throughout the breeding season, differences in hormonal profiles were related to behavior.Blood samples were collected in the summers of 1985 to 1987 from individuals of both species breeding in a 3 km$\sp2$ …

This is the report of a health needs assessment for the Oneida Indian Nation of New York (ONNY). This needs assessment was conducted in order to collect population-based data related to behavioral risks and reproductive health for Oneida males and females. The survey of the Oneida was initiated because there is almost no risk factor data available on Indian tribes of the northeast, and none available for the Oneida Nation of New York. There are four primary goals for the 1990 Oneida Nation Health Needs Assessment. They are 1) to collect behavioral risk factor and reproductive health data for adult …
