Statutory Prohibitions On The Negotiation Of Insurance Agent Commissions: Substantive Due Process Review Under State Constitutions, Robert H. Jerry Ii, Reginald L. Robinson

In Part I, this Article examines and categorizes the state statutes that prohibit an insurance agent from returning a portion of his commission for the sale of the policy to the consumer. Part II discusses substantive due process' in the state courts. After briefly summarizing the rise and fall of federal substantive due process, this part explores the use of state constitutions as independent constitutional authority in the area of economic regulation. This part concludes that two distinct models of substantive due process analysis exist in the state courts. Part III comments on two recent cases where the validity of …

This volume is a collection of seven papers delivered at a symposium assembled in April 1989 upon the occasion, almost two hundred years hence, of the passage of the Bill of Rights by the First Congress. The unifying theme is stated to be the historical context of both Religion Clauses in the First Amendment, but the authors are driven primarily by Establishment Clause concerns. The Thrust of the essays deal with the originalism advanced during the years of Reagan Administration, and nonpreferentialism comes in for particular criticism, both pejoratively characterized as that "growing clamor".

The legal place and role of national space agencies in general has not yet been the subject of much debate. This paper tries to argue however that this problem is of some relevance indeed. Concurrently with debating it namely, by concentrating on the case of some European agencies the problems of defining a "national space agency" and of the relevance of such definitions as to such a place and role will be answered to some extent.

Thus, Article VI of the Outer Space Treaty is seen as providing for a subdivision of space agencies in 'governmental agencies' and 'nongovernmental entities.' …

Ten populations of Xiphinema americanum sensu lato (S. l.)from California and two from the eastern United States were studied in a morphometric comparison. Morphometrics were generated by descriptive statistics and a stepwise discriminant analysis (SDA) from nine California field populations, and voucher specimens from a previous California vector study (Hoy, Mircetich & Lownsbery, 1984); identifed as X. californicum. AIso included were greenhouse populations of X. americanum Cobb, 1913 sensu stricto (s. s.) from New York (N.Y.) and X. rivesi Dalmasso, 1969 from Pennsylvania (Pa). Sixty subjects classified as high or low in social anxiety participated in a structured heterosocial interaction under conditions of either high or low social-evaluative threat. Following the interaction, subjects were asked to recall detailed information about the interaction partner’s appearance and the content of the conversation. Socially anxious subjects recalled less information and made more errors in recall than nonanxious subjects. Contrary to prediction, social-evaluative threat did not affect recall. Anxious subjects also reported greater self-focused attention during the interaction. High self-focused attention was associated with superior recall for nonanxious subjects but associated with more frequent omission errors for anxious …

In American Ritual Dramas: Social Rules and Cultural Meanings (Greenwood Press, 1989), Mary Jo Deegan presents a theory of core codes and communitas that implicitly challenges the present organization of sociological practice in bureaucratic structures such as universities. The rituals of modern academic sociology are permeated by the same core codes that Deegan finds in many modern participatory and media-constructed rituals, specifically: the codes of oppression (class and sex codes) and the codes of repression (bureaucracy and time codes). Sociology remains little more than a rationalization for repressive and oppressive social control mechanisms unless it convincingly demonstrates and acts upon …

Archivally-based research in the history and sociology of sociology (especially the recent work of Mary Jo Deegan on Jane Addams and the Men of the Chicago School, 1892-1918) powerfully demonstrates the central epistemological importance of excavating and rehabilitating the contributions of sociologists who have long been ignored by historians of sociology. Archival experience reveals that uncovering the unknown, the unwritten, or the unrecognized in the history of sociology frequently requires reversing the conventional wisdoms of sociological research. Ten archival research strategies are identified. These approaches are best adapted to long-term rather than short-term research programs. It is concluded that. the …

The Pinturas Formation is a pyroclastic and epiclastic aeolian deposit of Miocene age lying discordantly upon Jurassic rocks in the elevated Andean precordillera of northwest Santa Cruz Province, Argentina. The history of de\'elopment of the Pinturas Formation was significantly affected by the gradual, though sporadic, draping of this aeolian sediment across a profound, slowly filling paleotopography. The Pinturas depositional cycle consisted of: (1) minor aeolian deposition followed by soil formation, and (2) major aeolian deposition followed by intervals of regional erosion. Fluvial action seems to have been almost wholly confined to intraformational erosion, and two significant intraformational erosional unconformities divide …

In 1984 and 1985 seasonal changes in phytoplankton were studied in a system of three lakes in Loch Vale, Rocky Mountain National Park, Colorado. Three periods were evident: (1) A spring bloom, during snowmelt, of the planktonic diatom Asterionella Formosa, (2) a mid- summer period of minimal algal abundance, and (3) a fall bloom of the blue-green alga Oscillatoria limnetica. Seasonal phytoplankton dynamics in these lakes are controlled partially by the rapid flushing rate during snowmelt and the transport of phytoplankton from the highest lake to the lower lakes by the stream, Icy Brook. A new species of Plectus Bastian, 1865 is described and illustrated, P. minutus n. sp. is characterized by its small size, indistinct body annulation, generally one longitudinal ala visible with light microscope on each lateral surface of the body (two seen with SEM), cervical papilla dorsatlo lateral ala, high cephalic region not set off from the body, cephalic setae not reaching the apex of the cephalic region, and tail conoid elongated generally with three pairs of setae.

The purpose of this article is to analyze the context, properties, and constitutionality of these instances of nonconsensual arbitration. Although FIFRA data arbitration and the constitutional challenges to which it has been subjected will receive the most extensive study, the other examples also will be explored in some detail. It is first necessary, however, to lay some groundwork. Each of the nonconsensual arbitration systems to be studied, including FIFRA data arbitration, draws the inspiration for its design and operation from contract-based commercial arbitration. The Accuracy In Estimating Truck Class Rates For Logistical Planning, Ronald H. Ballou

Truck class rates are usually needed in strategic logistical planning, especially for facility location. Using point-to-point transport rates is exact, but for practical reasons it is often necessary to estimate them from distance. Two sources of rate estimating error are examined: (1) the error resulting from the linear approximation of rates from distances and (2) the error associated with estimating distances from shipment origin-destination coordinate points. Suggestions are made as to how the rate estimating error may be minimized. [Published circa 1990.]

Physician manpower requirements of most developing countries can often be met by developing local training facilities, sending indigenes to train abroad, and/or by recruiting expatriate physicians. Foreign training and having expatriates often involve expenditures of scarce foreign exchange in competition with other development projects. This paper develops a manpower planning model which coordinates physician manpower requirements of a developing country with its capacity to train such physicians along with national objectives to contain costs. The paper presents computational results from a dynamic programming model using the best data available from Nigeria.

This article reports on the relative performance of several popular heuristic approaches to the vehicle routing and scheduling problem. It is a continuation of a previous study where the problems addressed were small. This research extends the problem size to see if the results would still be valid. Because of disappointing performance in the previous study, two of the algorithms were redesigned to see if their performance would improve.

To aid in the design of a computerized teaching system, including a database of patient information, a patient case generator using an expert system shell, and a tutoring module, several existing patient management problem (PMP) presentation or tutoring programs were reviewed. Some attributes were identified as required for a computerized PMP system to constitute an effective instructional tool. After reviewing the literature, four major areas were identified on which to evaluate computerized PMPs: 1) Ability to simulate the Patient/Physician Encounter 2) Provision of Educational Feedback 3) User-Friendliness, Ease of Use, Flexibility 4) Tracking of Student Performance. Consumers Swallow Another Lemon: Agency Consent Order Preemption Of State Lemon Law Standards For Informal Dispute Resolution - General Motors V. Abrams, Gregory L. Barnes

This Note will first examine the background of GM v. Abrams, which involves a successful attempt by General Motors (GM) to use a Federal Trade Commission (FTC) consent order to block the application of New York's "Lemon Law" 6 to the arbitration program contained in the order.7 Second, it will discuss the legal context of the dispute (chiefly the extension of the federal preemption doctrine to "implicitly preemptive" agency consent orders). Third, it will outline the court's application of that doctrine in the instant case. Finally, it will offer a critical evaluation of both the legal and policy grounds of …
