Opting Out Of Fiduciary Duties: A Response To The Anti-Contractarians, Henry N. Butler, Larry E. Ribstein

Washington Law Review

Professors Butler and Ribstein present an extensive analysis of opting out of fiduciary duties, based on the contractual theory of the corporation and a substantial body of economic literature, as well as a comprehensive response to prominent corporate law commentators who have argued that private ordering of corporate manager duties should be restricted by mandatory legal rules.

The increasing popularity of nonprobate transfers of property at death has created a "revolution" in family wealth transmission. Yet the law on creditors' rights to reach such transfers is badly confused. In some cases, exemptions from creditors' claims are far broader than can be justified. In others, existing creditors' rights are protected but undefined. In still others, it is unclear whether creditors can reach the property at all. There is no procedure for the enforcement of such rights as creditors may have no specified time limit within which claims may be brought. This lack of system invites abuse and is …

Old-Growth Forests On State School Lands—Dedicated To Oblivion?—Private Trust Theory And The Public Trust, John B. Arum

Washington Law Review

The application of private trust principles to management of state forest lands granted to Washington by Congress in the Enabling Act conflicts with the public trust established in the state constitution and hampers efforts to preserve ecological values on these lands. This Comment explores alternative common law doctrines which courts employ to construe restrictive land grants. Principles applying to dedications of land for public use better suit the task of harmonizing the language of the Enabling Act and the state constitution to allow for protection of ecological values on state forest lands.

Child Sexual Abuse And Criminal Statutes Of Limitation: A Model For Reform, Jessica E. Mindlin

Washington Law Review

Many states permit courts to toll criminal statutes of limitation in a child sexual abuse case if the victim is under a minimum age, or if the offender prevents the victim from reporting the abuse. Twenty-four states have no such tolling provision, however, and their state courts have not devised a common law solution to avoid the problem of time-barred prosecutions. This Comment examines child sexual abuse in the context of state criminal law. It concludes that statutes of limitation present a formidable obstacle to the successful prosecution of perpetrators of child sexual abuse, and proposes a model legislative amendment …

The Problem: Science education at the elementary level has not been successful. As a nation we are producing fewer and fewer scientists and science teachers, as evidenced by the narrowing of the pipeline of students entering science classes in high school and beyond. Since a student's interest in science begins at the elementary level, any improvement in science education in these grades will help ameliorate the trend toward science illiteracy. Such an improvement rests on three critical areas: the teacher, the curriculum, and the methodology. English-Japanese: The Dictionary of Anglo-American Law, published by the University of Tokyo Press, represents a tremendous achievement. Its publication in 1991 culminated a'seven-year effort in which more than fifty leading Japanese scholars actively participated. These included specialists in a wide range of fields, not just professors of Anglo-American law. The effort was overseen-and a heavy share of the work borne by-a seven-member Editorial Committee, which held more than 150 meetings in the process of preparing the dictionary. Phenotypic and functional properties of B lymphocytes from individual young and old mice of different inbred strains were studied. B lymphocyte subpopulation defined by the ratios of the densities of cell surface IgM and IgD were found to be altered with age. However, such alterations in B cell subsets were found only in 30-40% of the old mice. B cell mitogenic responses to anti-μ and anti-Lyb2 antibodies were decreased in a majority of DBA/2 mice. Proliferative responses to LPS and antiμ were reduced only in a minority of CBA/Ca mice but there was a very good correlation in the responsiveness …

This article argues for attention to a neglected dimension of family planning services—their quality. A framework for assessing quality from the client’s perspective is offered, consisting of six parts (choice of methods, information given to clients, technical competence, interpersonal relations, follow-up and continuity mechanisms, and the appropriate constellation of services). The literature is reviewed regarding evidence that improvements in these various dimensions of care result in gains at the individual level; an even scarcer body of literature is reviewed for evidence of gains at the level of program efficiency and impact. A survey of fishes in and around Shipstern Nature Reserve in Northern Belize, Central America, was carried out over a period of eight months, from February to September 1990. Its purpose was to establish a preliminary list of the fishes of Shipstern Nature Reserve, including descriptions, distribution and collecting data and additionally to describe some of the habitats in which the fishes were found. This study focuses on fishes considered to be freshwater species. These occurred for the greater part in brackish habitats. Strategies For Increasing Contraceptive Use In Factories In Barbados, Charles Alleyne, Elrene Sealy, Pauline Russell-Brown

This report outlines results of a study on factory-based family planning operations. The 18-month study compared the relative effectiveness of two interventions: 1) ongoing contraceptive distribution by a trained factory employee supported by monthly education visits by the Barbados Family Planning Association (BFPA); and 2) monthly service and education visits by the BFPA. Service and survey data indicated that the education/information program component was stronger than the contraceptive delivery component. There were remarkable increases in the employees' knowledge of contraceptive methods, especially in factories with employee distributors.

This project presents a history of occupational medicine and workers' compensation laws in the United States as a prelude to discussing the development of computer systems in occupational health. The history of a private corporate health service is outlined and the development of a management information system for that corporate health service is discussed. A computer instruction manual developed for the management information system is included. The results of an evaluation of the billing system, a major component of the management information system, indicate that the majority of the clients of the corporate health service are pleased with the system.

Perhaps the most important reason is the many stressors within the black community which attribute to health problems such as hypertension. Not only is hypertension more prevalent in blacks than whites, but it is also more severe (Butcher & Allen, Dec. 1989). Men and women between the ages of 18 and 29 were the subjects of a study designed to explore their gender preferences for their children , to examine the stated reasons for the preferences, and to consider the implications of these attitudes for the subjects and society as a whole . Four-hundred and forty- three respondents completed a one- page questionnaire addressing these issues and requesting data regarding sex, age , and marital status . Yucca Mountain, in southern Nevada, is being studied by the Department of Energy and the State of Nevada as the site of high-level nuclear waste repository. Geochemical and isotopic modeling were used in this thesis to define the relationship of the volcanic tuff aquifers and aquitards to the underlying regional carbonate ground-water system. The chemical evolution of aground water as it passes through a hypothetical tuffaceous aquifer was developed using computer models PHREEQE, WATEQDR and BALANCE. The tuffaceous system was divided into five parts, with specific mineralogies, reaction steps and temperatures. The initial solution was an analysis of a soil …
