The Costs Of Settlement: The Impact Of Scarcity Of Adjudication On Litigating Lawyers, Kevin C. Mcmunigal
The Costs Of Settlement: The Impact Of Scarcity Of Adjudication On Litigating Lawyers, Kevin C. Mcmunigal
Faculty Publications
This Article, by comparison, focuses on the implications of lack of trial experience for litigating lawyers. Does lack of trial experience affect the way lawyers function in litigation? Does it influence their performance as advocates? As negotiators settling cases? Does it affect adherence to existing ethical standards such as those regarding competence and conflict of interest? Can one expect lawyers to understand, respect, and adhere to the values of an ethical and legal system premised, as ours is, upon a process of adjudication lawyers seldom, if ever, experience? Do the answers to these questions yield any insight for guiding reform …

Clinics And "Contextual Integration": Helping Law Students Put The Pieces Back Together Again, Eric S. Janus
Clinics And "Contextual Integration": Helping Law Students Put The Pieces Back Together Again, Eric S. Janus

In legal education, as in all education aimed at practice, the relationship between theory and practice is an uneasy one. William Mitchell College of Law, one of the nation’s few free-standing law schools, has traditionally placed itself squarely on the practice side of the theory/practice axis. It has aimed to produce law graduates who could walk into a law office and begin practicing law—not lawyers who would spend additional years learning the profession at someone’s elbow. In recent years, William Mitchell has begun to embrace a more academic approach to legal education. This paper suggests that the College need not, …
The Privilege Against Compelled Self-Incrimination, John O. Sonsteng
The Privilege Against Compelled Self-Incrimination, John O. Sonsteng
Faculty Scholarship
This article examines the fifth amendment right against compelled self-incrimination, as compared to principles in confession law. These two areas of law are not the same. In 1966, however, the Supreme Court decision of Miranda v. Arizona announced that many of the principles involved in confession law also implicated the fifth amendment privilege against compelled self-incrimination. The popular impact of Miranda has resulted in the equating of confession law with the fifth amendment privilege. This article examines the history of the fifth amendment privilege, its application, and how it can be distinguished from other, related areas of law.

A Proposal For Legislative Effectuation Of Double Jeopardy Protection, Kevin A. Hicks
A Proposal For Legislative Effectuation Of Double Jeopardy Protection, Kevin A. Hicks
UC Law Journal
In addition to protecting a criminal defendant against multiple trials, the double jeopardy clause protects those convicted of crimes from multiple punishment for the same offense. This protection presents the problem of how to determine whether two or more charged offenses are truly separate or whether they constitute a single offense. In Blockburger v. United States, the United States Supreme Court adopted a mechanical test, holding that two offenses are different where each requires proof of a fact that the other does not. For many years this "same evidence" test seemed to be the last word on whether two offenses …
The Timber Harvest Plan Exemption From The California Environmental Quality Act: Due Process And Statutory Intent, Ruth Mclay
UC Law Journal
The California Environmental Quality Act was enacted to prevent unnecessary environmental degradation and encourage citizen involvement in environmental protection. One of CEQA's most important means to accomplish this purpose is the environmental impact report, which requires state agencies to respond to public concerns regarding the significant environmental effects of proposed projects before they may be begun. An important exception to the EIR requirement is the exemption for timber harvesting. Although the exemption of timber harvesting is required by law to meet the standards of CEQA, this Note argues that it fails to do so. The Note contends that this exemption …
Watershed And Water Quality Protection In National Forest Management, Tony Arjo
Watershed And Water Quality Protection In National Forest Management, Tony Arjo
UC Law Journal
One of the significant duties of the United States Forest Service is the protection of watersheds and water quality in the National Forests. The primary statutory authority for the Forest Service in this area is the National Forest Management Act of 1976 (NFMA). This Act was intended to transform the management practices that had embroiled the Forest Service in controversy during the 1960s and 1970s. This Note argues that while the NFMA added procedural protections, it also continues an historical tradition that allows the Forest Service to pursue management practices detrimental to watersheds and water quality as long as they …
Decorative Figureheads: Eliminating Class Representatives In Class Actions, Jean Wegman Burns
Decorative Figureheads: Eliminating Class Representatives In Class Actions, Jean Wegman Burns
UC Law Journal
The role of the class respresentative in class actions has become an enigma. On a doctrinal level, the United States Supreme Court has, at times, treated the named plaintiff as the pivotal figure in the class lawsuit; the fate of the entire action rising or falling with the status of the representative. On other occasions, however, the Court has reduced the representative to nothing more than a figurehead with little or no function. On a practical level, there has been an increasingly open acknowledgement from both courts and commentators that the latter view is closer to reality. That is, the …

High- Resolution Shock-Capturing Schemes For Inviscid And Viscous Hypersonic Flows, Helen C. Yee, G. H. Klopfer, J.-L. Montagne
High- Resolution Shock-Capturing Schemes For Inviscid And Viscous Hypersonic Flows, Helen C. Yee, G. H. Klopfer, J.-L. Montagne
United States National Aeronautics and Space Administration: Publications
A class of high-resolution implicit total variation diminishing (TVD) type algorithms suitable for transonic multidimensional Euler and Navier-Stokes equations has been extended to hypersonic computations. The improved conservative shock-capturing schemes are spatially second- and third-order and are fully implicit. They can be first- or second-order accurate in time and are suitable for either steady or unsteady calculations. Enhancement of stability and convergence rate for hypersonic flows is discussed. With the proper choice of the temporal discretization and implicit linearization, these schemes are fairly efficient and accurate for very complex two-dimensional hypersonic in viscid and viscous shock interactions. This study is …

Evaluating Honors Programs: An Outcomes Approach, Jacqueline Reihman, Sara Varhus, William R. Whipple
National Collegiate Honors Council Monographs
The evaluation of academic programs has always been a complex and sensitive issue. Evaluations are undertaken to determine which programs will survive in an era of straitened economic circumstances, to gain or maintain accreditation, or to tell us how our programs can be improved. They may apply some normative standard of quality, 0r address an academic program's unique situation and mission. They may include the following: review of budget, evaluation of staff, description of the program's operation, demonstration of faculty and student satisfaction, or measures of what students have learned. They may use standardized or locally developed tests of achievement; …

Don Alvaro Tarfe: ¿Ente Fantasmal O Hecho Ficticio?, Elizabeth Wilhelmsen

Ectoparasites Of Ring-Necked Pheasants In Nebraska, William R. Payne, David W. Oates, Glen E. Dappen
Nebraska Game and Parks Commission: Staff Research Publications
In 1971, 1983 and 1984, ectoparasites were identified on 61 ring-necked pheasants (Phasianus colchicus) from Nebraska. Birds were collected throughout the state from 11 of 93 counties. Four species of chewing lice (Mallophaga) were collected: Lipeurus maculosus, Goniodes colchici, Lagopoecus coichicus and Amyrsidea megalosoma. One species of analgid mite, Megninia sp. was collected. Apparently, this species is new and undescribed. The four mallophagan species have not been reported from Nebraska.
