Allocation Of Highway Costs And Revenues, Jerry G. Pigman, John A. Deacon Jan 1990

Allocation Of Highway Costs And Revenues, Jerry G. Pigman, John A. Deacon

Kentucky Transportation Center Research Report

This highway cost and revenue allocation study is the fourth of a recent Kentucky series begun in 1982. Experience gained with each study has resulted in subsequent refinements that have enlarged the data base, enhanced the accuracy, and simplified the study process. One of the long-term aims is to develop an easy-to-use process for continuously monitoring effects of changes in traffic patterns, in finance and tax policy, and in highway expenditures.

The primary objective of the current study was to determine the 1989 levels of revenue contribution and cost responsibility for each of several classes of Kentucky highway users. As …

Regulation Of Imports And Foregn Investment In The United States On National Security Grounds, David Scott Nance, Jessica Wasserman Jan 1990

Regulation Of Imports And Foregn Investment In The United States On National Security Grounds, David Scott Nance, Jessica Wasserman

Michigan Journal of International Law

Traditionally, concerns over the effects of trade and investment on national security have centered upon the transfer of products and technologies with potential military uses. However, national security concerns also arise with respect to the economic and military impact of imports and of foreign acquisition of domestic assets. The United States has a longstanding statute, section 232 of the Trade Expansion Act of 1962, that allows the President to restrict imports of goods on national security grounds. More recently, another statute, popularly referred to as the Exon-Florio Act, provides the President with authority to bar the acquisition of United States …

Companies In The European Community: Are The Conflict-Of-Law Rules Ready For 1992?, Andreas Reindl

Michigan Journal of International Law

This article describes the current situation in the emerging integrated system of the European Community, focusing on the potential conflict between Community rules on the freedom of establishment and national conflict-of-law rules relating to companies. In the first part, I shall outline the relevant provisions of EC law and the two conflict-of-law concepts presently exhibited in the national laws of the Member States. In the second part, I shall discuss three cases in which the European Court of Justice recently addressed this subject. In the third part, I shall analyze the impact of the Court's opinions, and finally outline options …

Note, The United States, Israel And Their Extradition Dilemma, Sheryl A. Petkunas Jan 1990

Note, The United States, Israel And Their Extradition Dilemma, Sheryl A. Petkunas

Michigan Journal of International Law

Part I of this note will examine the different approaches taken by the Second, Seventh and Ninth Circuits in their application of the Treaty's political offense exception. Part II will discuss the conflict that may arise from Israel's application of a domestic law which contravenes the purpose of the Treaty. Part III will address both the need for the United States and Israel to reconcile problems in applying the political offense exception through renegotiation and the dilemma arising from the failure of the Israeli government and the Knesset to coordinate policy with regard to the extradition of nationals.

Soft Law And The International Law Of The Environment, Pierre-Marie Dupuy Jan 1990

Soft Law And The International Law Of The Environment, Pierre-Marie Dupuy

Michigan Journal of International Law

Because the existing body of international environmental law has, in part, emerged on the basis of "soft" norms, it provides a good field for observing the general sociological and juridical phenomenon termed "soft" law. The 1972 Stockholm Declaration adopted by the UN Conference on the Human Environment, for example, constitutes the normative program for the world community 'in this field. Although, from a formal point of view, the Declaration is only a nonbinding resolution, many of its "principles," particularly Principle 21, have been relied upon by governments to justify their legal rights and duties. The subsequent State practice has been, …

U.S. Trade Policy Toward The New Nics Of Southeast Asia, Linda Y.C. Lim Jan 1990

U.S. Trade Policy Toward The New Nics Of Southeast Asia, Linda Y.C. Lim

Michigan Journal of International Law

As export and economic growth in Korea and Taiwan has slowed since 1988, it has increased dramatically in several countries of Southeast Asia. Thailand, for one, is chalking up a second year of eleven percent real GDP growth in 1989 to become the fastest-growing economy in the world. Malaysia and even the Philippines are not far behind, with growth predicted to reach the six to eight percent range for the second or third year in a row. Even Indonesia's growth is rising above five percent for the first time since the oil price slump of the early 1980s. Manufactures now …

The Hormone Conflict Between The Eec And The United States Within The Context Of Gatt, Werner P. Meng Jan 1990

The Hormone Conflict Between The Eec And The United States Within The Context Of Gatt, Werner P. Meng

Michigan Journal of International Law

For many years, consumer organizations within the European Community have demanded the prohibition of natural and synthetic hormones from use in animal fodder. Since the level of hormone use by breeders varies among Member States, demands for a hormone prohibition have also differed in intensity from State to State. After lengthy negotiations beset with legal difficulties, a general, community-wide prohibition became reality at the beginning of 1989. The price of this policy has been trade difficulties with the United States which, up to the present time,' have resulted in trade sanctions and economic losses on both sides. Since both parties …

Igbo Names In The Nominal Roll Of Amelié, An Early 19th Century Slave Ship From Martinique: Reconstructions, Interpretations And Inferences, Chukwuma Azuonye

Africana Studies Faculty Publication Series

The names discussed in the present paper come from the nominal roll of “212 Africans, all Ibos, who constituted the clandestine freight of Amelié, a slave-ship commissioned at Saint-Pierre, Martinique, and captured by the royal corvettee, Sapho, on February 8, 1822, in the Caribbean Sea.” The list was forwarded to me as far back as 1985 through Abiola Irele (then of the University of Ibadan), at the instance of the great Martinique cultural nationalist poet, Aimé Cesaire (1913–2008), by Mme Thesée, a French scholar who was then completing a study of the secret passage of this particular group of slaves. …

Quantification Of Spermatozoa In The Sperm-Storage Tubules Of Turkey Hens And The Relation To Sperm Numbers In The Perivitelline Layer Of Eggs, J. P. Brillard, M. R. Bakst Jan 1990

Quantification Of Spermatozoa In The Sperm-Storage Tubules Of Turkey Hens And The Relation To Sperm Numbers In The Perivitelline Layer Of Eggs, J. P. Brillard, M. R. Bakst

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

This study was conducted to determine the number of spermatozoa residing in the oviduct sperm-storage tubules (SST) and the relationship between these numbers and the number of spermatozoa embedded in the perivitelline layer of oviductal eggs after a single insemination of 200 X 104 spermatozoa. The SST of hens inseminated within one week before the expected onset of egg production were filled faster (4 h vs. 2 days) and possessed more spermatozoa (4.1 vs. 2.0 X 106) than the SST of hens inseminated after the onset of egg production. Furthermore, for hens in egg production, significantly fewer …

Evaluation Of Chlorpyrifos-Methyl And Chlorpyrifos-Methyl Plus Methoprene As Protectants Of Stored Corn: Small Bin Tests, Frank H. Arthur, James E. Throne, Richard A. Simonaitis, James M. Zehner

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Chlorpyrifos-methyl applied at 6 ppm and a combination of 6 ppm chlorpyrifos- methyl + 1 ppm methoprene were evaluated as protectants of stored corn (Zea mays L.) against a standard malathion application of 8 ppm and an untreated control. Corn was treated in October 1987, placed in 10-, 19-, and 76-bu bins, and infested at selected intervals with red flour beetle, Tribolium castaneum (Herbst); flat grain beetle, Cryptolestes pusillus (Schonherr); maize weevil, Sitophilus zeamais Motschulsky; and Indianmeal moth, Plodia interpunctella (Hiibner). Indianmeal moths did not establish populations on treated or untreated corn. Beetle populations in untreated controls were not …

Bargaining Over Equity's Share In The Bankruptcy Reorganization Of Large, Publicly Held Companies, Lynn M. Lopucki Jan 1990

Bargaining Over Equity's Share In The Bankruptcy Reorganization Of Large, Publicly Held Companies, Lynn M. Lopucki

UF Law Faculty Publications

This Article reports some of the results of an empirical study of the bankruptcy reorganization of large, publicly held companies. We present data relevant to what many consider to be the central issue of reorganization theory-how the value of the reorganizing enterprise should be divided among the various claims and interests. We demonstrate that there is indeed systematic deviation from the absolute priority rule in favor of junior interests; but, with respect to large, publicly held corporations, the debate about how to prevent these deviations is, for the most part, a tempest in a teapot-the difference between absolute priority and …

Alkali-Labile Cell-Wall Phenolics And Forage Quality In Switchgrasses Selected For Differing Digestibility, B. C. Gabrielsen, Kenneth P. Vogel, J. K. Ward Jan 1990

Alkali-Labile Cell-Wall Phenolics And Forage Quality In Switchgrasses Selected For Differing Digestibility, B. C. Gabrielsen, Kenneth P. Vogel, J. K. Ward

United States Department of Agriculture-Agricultural Research Service / University of Nebraska-Lincoln: Faculty Publications

Alkali-labile cell-wall phenolics have been implicated in previous research as factors that affect forage digestibility by ruminants. Alkali- labile cell-wall phenolics, in vitro dry matter digestibility (IVDMD), neutral-detergent fiber (NDF), acid-detergent fiber (ADF), lignin (permanganate-oxidation), and crude protein (CP) were determined in three switchgrass (Panicum virgatum L.) strains differing genetically for IVDMD to determine relationships between • these quality parameters and IVDMD during the grazing season. Grazed (upper 1/3 of grazed plants) and ungrazed (whole plants in caged exclosures) forage was collected weekly from replicated 0.4- ha pastures of 'Trailblazer' (high IVDMD), 'Pathfinder', and a low- IVDMD strain during …

Physical Properties Of Coarse Aerosol Particles And Haze Elements In Polluted Urban-Marine Environment, Josef Podzimek

Physics Faculty Research & Creative Works

Measurements of coarse particles (with r ≥ 1.0 μm) with the aid of a cascade impactor and of particle (droplet) identification in sensitized gelatine layers reveal their mean concentration of about 1.5 cm-3 during the months of May and June 20 km west from Napoli in Italy. Haze particles (droplets) are usually featured by insoluble core and many small particles deposited on their surface. Sea salt aerosol does not play a dominant role in the haze element formation at this site of measurement. © 1990.
