Once it concluded that the Sherman Act did not apply to the states, the United States Supreme Court apparently found it necessary to hold that the Act did not reach agents of the state or those whose action was compelled by the state. The state action defense to an antitrust proceeding was thus created. In Cantor, at least four Justices decided they did not like the results of this experiment, and they virtually put an end to the state action defense. The Court of Justice of the European Communities was not similarly pressured to find a state action defense to …

The Federal Judicial District As Community In Obscenity Cases, Carl B. Rubin, Gary Winters

Few problems have plagued the courts in the last decade with greater persistence than those associated with obscenity. The concept of obscenity varies from place to place and from time to time, and since it is essentially a subjective concept, it also tends to vary from person to person. The development of a concept of "community standard" recognizes that diverse viewpoints exist and has resulted in the consideration by courts of the concept of obscenity in light of a local standard rather than a national one. It has also incidentally relieved the Supreme Court of the United States from consideration …

Chapters Of The Civil Jury, Doug R. Rendleman
Faculty Publications
The civil jury, though constitutionally protected by the seventh amendment, has remained a controversial institution throughout much of Anglo-American legal history. Our romantic ideals are questioned by critics who view the civil jury as prejudiced and unpredictable; proponents note the sense of fairness and "earthy wisdom" gained by community participation in the legal process. This debate surfaces in the process of accommodation between certain substantive goals of the law and the pre-verdict and post-verdict procedural devices courts have employed to control the jury. In this article, Professor Rendleman examines this conflict in his three "chapters" involving racially motivated discharges of …
