The Rights And Remedies On Permitting, Diverting, Increasing And Obstructing The Natural Flow, John R. Rood
Michigan Law Review
It is evident that no one hard and fast rule could be applied to all cases, either in city or country, "without producing injustice and impolitic results. The needs and conditions in city and country are different. They usually differ widely in different parts of the same city. These considerations have induced the Supreme Court of New Hampshire to adopt the flexible rule, that: "In determining this question all the circumstances of the case would, of course, be considered; and among them the nature and importance of the improvements sought to be made, the extent of the interference with the …
Legal Ethics, Charles A. Kent
Legal Ethics, Charles A. Kent
Michigan Law Review
Legal ethics is a branch of general ethics. Some consideration of the latter is necessary to an understanding of the former. It is a fundamental fact that men generally, if not all sane men, distinguish certain courses of conduct as right and wrong; just as they say particular objects are beautiful and others ugly. They feel a duty to do some things and to refrain from others. If savages do not feel distinctly the sense of duty, at least they are indignant at certain conduct in their associates, and approve of other acts, on moral grounds. This sense of duty …

The Government's Suit Against The Union Pacific Railroad Company, Edson R. Sunderland
The Government's Suit Against The Union Pacific Railroad Company, Edson R. Sunderland
Michigan Law Review
On February 1st, 1908, a bill was filed in the United States Circuit Court for the District of Utah by the government of the United States, against the Union Pacific, the Southern Pacific, the Northern Pacific, the Great Northern, the Atchison, Topeka & Santa Fe and the San Pedro, Los Angeles and Salt Lake railroad companies, and several individual defendants, under the Anti-Trust law. The principal defendant is the Union Pacific company, which is charged by the government with controlling or influencing the management of the other defendant corporations, in restraint of competition. The suit was brought at the direct …

May Congress Levy Money Exactions, Designated "Taxes," Solely For The Purpose Of Destruction?, John Barker Waite
May Congress Levy Money Exactions, Designated "Taxes," Solely For The Purpose Of Destruction?, John Barker Waite
Michigan Law Review
The questions of taxation have furnished a cause of warfare, armed or wordy, since the meaning of government has been known. The possibility of our Constitution was due, superficially, to the imposition of a tax; its adoption, in great measure, to the absence of a tax, to the lack of a taxing power in the Confederation. Since the adoption of the Constitution with its grant of a taxing power, much of our legislative disagreement has centered on the interpretation of that grant. The case of McCray v. United States, opens up a comparatively untrammeled field of dispute. The basis of …

Is A Provision For The Initiative And Referendum Inconsistent With The Constitution Of The United States?, W. A. Coutts
Michigan Law Review
We are told today that the Constitution of the United States forbids the adoption of the Initiative and the Referendum, as these involve such purely democratic principles as to be inconsistent with the republican form of government guaranteed by the fourth section of the fourth article of the Federal Constitution. The special interests that are opposed to the Initiative tell us that we must find some other cure for the evils at which it aims; that the Initiative is a purely democratic principle and, as such, it is forbidden by the fourth section of the fourth article of the Federal …

Are Too Many Executive Officers Elective?, Bradley M. Thompson
Michigan Law Review
Michigan manage and conduct state affairs. No one would ship a dead dog over that line without having taken the precaution to skin the animal and save his hide. Listen to the conclusion of the whole matter. Give the people an opportunity to govern the state. Amend the constitution and provide for the election of just two state executive officers, a governor and a lieutenant governor. Give the governor power to appoint by and with the advice and consent of the senate, the other state officers now elected, with power to remove at will such officers to constitute his counsel …

The Constitution Of Oklahoma, John A. Fairlie
Michigan Law Review
The constitution of the latest state to be admitted to the Federal Union contains many interesting features, some significant of recent tendencies in state government, and others distinctly novel, which suggest queries as to the probable trend of future development. Public attention has already been attracted to some of the most striking provisions; and a more careful analysis of the constitution as a whole should be of value to those concerned in the problems of American government. At the outset, one familiar with the constitution of the older states will be struck by the length of the Oklahoma document. It …

The Position Of The Law Of Torts In The Spanish System, Clyde Alton Dewitt
Michigan Law Review
The penal and civil codes of Spain, together with its procedural codes, its commercial and notarial codes, and its mortgage law combine to form as highly developed a system of jurisprudence as that enjoyed by any of the civilized nations of today. Under it, the people of our insular possessions have carried on an extensive domestic and foreign commerce, and have developed an organized social and political life. Our government has adopted the commendable policy of interfering as little as possible with the local laws and institutions of the Philippines and Porto Rico, it being evident that any extensive attempt …

A Written Constitution In Some Of Its Historical Aspects, Andrew C. Mclaughlin
A Written Constitution In Some Of Its Historical Aspects, Andrew C. Mclaughlin
Michigan Law Review
That an institution of government, like an institution or practice of society, is a growth and not a creation is now an accepted proposition. No one seeks to argue for it; no one endeavors to deny it. The introduction of this idea into our political thinking strongly influenced our methods and our ideas. In no field of study has the evolutionary idea shown itself more strongly than among workers in history and political science. And yet occasionally one is surprised by seeing how recently this idea has manifested itself in the examination of some historical problems. Until a short time …

Professor Kales And Common Law Remainders, Joseph W. Bingham
Michigan Law Review
In an article in Vol. 22 of the Law Quarterly Review, Professor Albert M. Kales presents a reclassification of future interests in land, the salient feature of which is an attempt to overthrow the conventional conception of a contingent remainder as a future estate given, not presently, but on condition precedent, and to substitute an entirely new conception of his own. This effort, by its boldness and novelty commands something more than a mere passing mention. It is my purpose, first to present as briefly as is consistent with clearness what I conceive to be the common law theory of …
The Scottish Jury, Rufus Fleming
The Scottish Jury, Rufus Fleming
Michigan Law Review
The origin of the jury is one of the subjects on which an agreement has not been. reached by writers on the history of law. A number of theories have been put forward at different times. At this day two of these theories receive considerable support. The first is that the jury system is a gradual and natural sequence from the modes of trial in use among the Anglo-Saxons and Anglo-Normans. The second-and perhaps the one more widely accepted at present-is that we owe trial by jury to the legal institutions of the Frankish empire. (Forsyth's "History of Trial by …
