Toward A Better Understanding Of Mail Balloting: The Case Of U.S. Labor Union-Representation Elections, Rafael Gely, Leonard Bierman, Timothy Chandler

The issue of how people vote in elections is important and timely. This Article examines this issue from the perspective of whether people vote by mail—i.e., mail balloting—or in person on a designated election day—i.e., in-person voting. It explores the pros and cons of mail balloting versus in-person voting from a general political perspective and in the context of elections for labor union representation in the United States. It presents heretofore unreported data on the use of mail balloting in union-representation elections. Frenemies: Why The Ftc Should Explore The Utility Of State Copas To Address Anticompetitive Consolidation In Healthcare, Alicia Gilbert

Much like other ‘90s trends, Certificates of Public Advantage (COPAs) are making a comeback. States have the potential to use COPAs as a unique healthcare antitrust enforcement mechanism. Rather than following a regime that exclusively focuses on price and output like traditional antitrust analysis, COPAs allow for greater consideration of other efficiencies, such as quality and access to care. And COPAs are designed to protect consumers through regulation rather than by protecting competition. Yet the policy position of the Federal Trade Commission (FTC) on COPAs ignores these opportunities, blanketly viewing COPAs as a threat to competition. This Article critiques the …
