An Application And Defense Of Ronald Dworkin's Theory Of Adjudication, Vincent William Wisniewski Jr. Jan 2007

An Application And Defense Of Ronald Dworkin's Theory Of Adjudication, Vincent William Wisniewski Jr.

Graduate Student Theses, Dissertations, & Professional Papers

Laws are intended to put individuals on notice as to how they should act in society and what behavior they may expect from others. But what happens when the text of a law is vague and open to multiple interpretations? How can individuals be expected to conform to laws when the laws are unclear as to what they demand? If the law is to retain legitimacy, there must be a principled way of determining what the law requires in these so-called “hard cases.” Ronald Dworkin argues that if interpretation is not constrained, adjudicators are creating the law rather than simply …

Change, Principal Trust And Enabling School Structures: An Analysis Of Relationships In Southern Alberta Schools, Cheryl Anne Gilmore

Graduate Student Theses, Dissertations, & Professional Papers

Improved student learning continues to be a pressing issue compelling schools and districts to undergo change. Schools are complex organizations and there are a number of interrelated factors that contribute to the success or failure of change into a new model. In Alberta, organizational change was mandated in 2003 through government acceptance of a Commission’s recommendation that all schools operate as a professional learning community. The context of mandated change provided a unique opportunity to examine large scale change with factors that may have a relationship to successful change. The purpose of this quantitative study was to examine the relationship …

Richert, Jennifer Kathleen, M.A., May 2007 IYFD Changing Attitudes: Congressional Rhetoric, Race, and Education Inequalities Chairperson: Otto Koester Through an analysis of Congressional rhetoric regarding public school in the context of racial equality, three terms emerge as reoccurring concepts that drive discussions on contemporary educational conversations: narrowing the gap, disadvantaged students, and accountability. I have designed this study to determine whether the way politicians in U.S. Congress use these terms have racial undertones that ultimately work to maintain a culture of minority oppression. This study opens with an introduction describing my personal interest, followed with an extensive literature review regarding …

As the community forestry movement matures, a question remains regarding what kind of educational experience nurtures and inspires people in community forestry? This thesis seeks to contribute to a better understanding of community forestry education by examining a field educational program known as “Landscape and Livelihood” (LL) offered by Northwest Connections, a small community-based conservation organization in the upper Swan Valley of western Montana. Based on extensive interviews, observation and the author’s own personal experience as a former LL student, the thesis documents the program’s use of field ecological studies involving both scientific and local knowledge integrated with journaling, homestays, …

Inequality And Civic Participation In The Rocky Mountain West: Missoula, Mt, Benjamin C. Harris Jan 2007

Inequality And Civic Participation In The Rocky Mountain West: Missoula, Mt, Benjamin C. Harris

Graduate Student Theses, Dissertations, & Professional Papers

This study considers the impact of community-level inequality of income and education on the ways individuals participate in local government and community development activities. It adapts the standard identity-augmented utility model to demonstrate that, given the choice to participate or not to participate, increases in inequality can decrease overall group participation, and an individual's distance from the characteristics of an ideal community member can also decrease the benefits and likelihood of participation. The theory predicts, however, that increasing the responsiveness of civic bodies to input from citizens can mitigate the negative effects of inequality. Original survey data from a stratified …

Legitimacy And The Use Of Natural Resources In Kruger National Park, South Africa, Randy Tanner Jan 2007

Legitimacy And The Use Of Natural Resources In Kruger National Park, South Africa, Randy Tanner

Graduate Student Theses, Dissertations, & Professional Papers

Around the globe, protected area managers confront an increasingly complex web of interests and demands, expressed by a variety parties, that often compete or conflict. When an action concerning the governance and management of a protected area is infused with such complexity, decision-making requires an evaluation of that action's legitimacy. Most often, this evaluation is implicitly made rather than expressly articulated. The purpose of this dissertation was both to illustrate the importance and utility of explicitly evaluating legitimacy and to provide a conceptual framework for understanding how the legitimacy of protected area governance and management may be understood. To better …

Lobachevski Illuminated: Content, Methods, And Context Of The Theory Of Parallels, Seth Braver Jan 2007

Lobachevski Illuminated: Content, Methods, And Context Of The Theory Of Parallels, Seth Braver

Graduate Student Theses, Dissertations, & Professional Papers

In the 1820's, Nikolai Ivanovich Lobachevski discovered and began to explore the world's first non-Euclidean geometry. This crucial development in the history of mathematics was not recognized as such in his own lifetime. When his work finally found a sympathetic audience in the late 19th century, it was reinterpreted in the light of various intermediate developments (particularly Riemann's conception of geometry), which were foreign to Lobachevski's own way of thinking about the subject.

Because our modern understanding of his work derives from these reinterpretations, many of Lobachevski's most striking ideas have been forgotten. To recover them, I have produced an …

Managing Multiple Identities: A Qualitative Study Of Nurses And Implications For Work-Family Balance, Claire Marie Spanier Jan 2007

Managing Multiple Identities: A Qualitative Study Of Nurses And Implications For Work-Family Balance, Claire Marie Spanier

Graduate Student Theses, Dissertations, & Professional Papers

The ways in which people manage organizational, professional, and familial identities can have significant implications for work-family balance. This is particularly true for nurses, who have a strong sense of professional identity and may be likely to experience work-family tensions. By framing work-family tensions as related to identity, we can see the ways in which being a “good” employee, a “good” nurse, and a “good” family member are both complementary and contradictory. This study highlights ways in which being “good” employee facilitates and hinders an individual’s ability to be a “good” nurse. Furthermore, it demonstrates how being a “good” nurse …

Negotiated Forgiveness In Parent-Child Relationships: Investigating Links To Politeness, Wellness And Sickness, Jennifer Lynn Geist Jan 2007

Negotiated Forgiveness In Parent-Child Relationships: Investigating Links To Politeness, Wellness And Sickness, Jennifer Lynn Geist

Graduate Student Theses, Dissertations, & Professional Papers

Upon experiencing conflict in a relationship, individuals have a variety of response options. While one can seek revenge or avoid that person, another option – forgiveness – can repair the relationship and foster health for both relationship partners. In coming together to confront the conflict and move beyond it, relational partners negotiate forgiveness in interpersonal interactions to accommodate face needs. In doing so, individuals must communicate by seeking forgiveness from and granting it to their relational partners. While much research has pointed to the health benefits associated with forgiving, little has explored the role communicating specifically plays in later received …

The Relationship Between Level Of Empathy And Stress Contagion, Heather Lynn Kirby Jan 2007

The Relationship Between Level Of Empathy And Stress Contagion, Heather Lynn Kirby

Graduate Student Theses, Dissertations, & Professional Papers

Although potential benefits associated with social support are well documented, it is also the case that social networks expose an individual to the stressful life events of others. Studies have shown that the stressful life events of others are positively related to negative affect. It has been theorized by several researchers that relationships between, for example, stressful life events of others and negative affect are evidence of a stress contagion process that may occur through empathy. The current study addressed this idea by testing whether the positive relationship that exists between network stress and depressive symptoms varied dependent upon (ie. …

The Role Of Attention In Second Language Development, Amanda Marie Mcginnis Jan 2007

The Role Of Attention In Second Language Development, Amanda Marie Mcginnis

Graduate Student Theses, Dissertations, & Professional Papers

This pilot study investigated the role of attention in language learning. I began by examining the most current research into how attention functions in the brain; then I discussed how attention as a cognitive mechanism is believed to fit into models of data processing and language learning. Once the nature and role of attention in language development was understood, it became possible to discover the practical implications for language teachers and learners. The most recent means to a grammar pedagogy is the Focus on Form approach: a language teaching option which takes into account the research on the role of …

Essential Understandings: Exploring My Personal Relationship With The Multiple Intelligences Through Art, Jeffrey Wardlaw Brown Jan 2007

Essential Understandings: Exploring My Personal Relationship With The Multiple Intelligences Through Art, Jeffrey Wardlaw Brown

Graduate Student Theses, Dissertations, & Professional Papers

The theory of Multiple Intelligences holds that there are an array of different kinds of intelligences in human beings. Howard Gardner has identified 8 multiple intelligences: Verbal/Linguistic, Logical/Mathematical, Spatial, Bodily/Kinesthetic, Musical, Interpersonal, Intrapersonal, and Naturalist. This project was designed to explore the practical applications of the theory through personal experience. A series of five artworks were produced using the artistic mediums of oil and acrylic paints, clay, natural found objects, songwriting and musical performance. The artworks served as external documentation of the inner processes through which the eight intelligences were manifested. A public lecture was held describing the artworks and …

First-Year Growth And Survival Of Habitat Revegetation Trials On The Lower Colorado River, Mexico, Stephen Dwight Handler Jan 2007

First-Year Growth And Survival Of Habitat Revegetation Trials On The Lower Colorado River, Mexico, Stephen Dwight Handler

Graduate Student Theses, Dissertations, & Professional Papers

Sweeping changes across the Colorado River watershed in the 20th century resulted in near-complete collapse of the natural communities in the Colorado River Delta (CRD) in Mexico. A brief return of freshwater flows in the 1980s and 1990s showed the riparian corridor remains resilient to past damage, and the CRD remains a vital area for habitat conservation and restoration. This project aimed to test conclusions drawn from similar projects in the United States and show that revegetation projects are possible along the lower Colorado River in Mexico. From November 2006 to October 2007, we tested the effects of various treatments …

The Diaspora Of Korean Children: A Cross-Cultural Study Of The Educational Crisis In Contemporary South Korea, Young-Ee Cho Jan 2007

The Diaspora Of Korean Children: A Cross-Cultural Study Of The Educational Crisis In Contemporary South Korea, Young-Ee Cho

Graduate Student Theses, Dissertations, & Professional Papers

The diaspora of Korean children first started after the Korean War in the 1950s. Abandoned by their impoverished mothers and shunned by society, many orphan children were sent abroad for adoption, which was the best, if not the only, available solution at the time. Half a century later, South Korea today is no longer a desperately poor country, and yet an increasing number of young children are still being sent abroad. The exodus of children, termed as the diaspora of Korean children in this study, is an out-of-country solution chosen by both students and parents in response to an educational …

The Experience Of Rural Battered Women: Overcoming Challenges, Joanna Legerski

Graduate Student Theses, Dissertations, & Professional Papers

The purpose of this study is to examine the impact of physical isolation in rural battered women. The relationships between physical isolation, level of traumatic symptoms and social support are assessed. By definition rural women are usually geographically isolated, which may contribute to the difficulty of leaving abusive relationships. Strong rural, socio-cultural norms such as traditional gender and marital roles, combined with a lack of access to beneficial services may prevent rural victims from fleeing to safety. As a result victims may be even more vulnerable to their batterers. To more fully understand difficulties faced by battered women, archival data …

Self-Control Choices Using Running Reinforcement, Jennifer Lynn Brinegar Jan 2007

Self-Control Choices Using Running Reinforcement, Jennifer Lynn Brinegar

Graduate Student Theses, Dissertations, & Professional Papers

Rats were given a choice between two amounts of a run-reward after responding on one of two equidistant levers. Responding on one lever resulted in the delivery of a smaller, immediate access to a running wheel (Impulsive) while responding on the other lever resulted in the delivery of larger but delayed access to a running wheel (Self-control). A variable inter-trial-interval was used to control the session duration regardless of the distribution of choices made by the subject. The results demonstrate that the use of a wheel-running reinforcer results in a significant self-control choice bias. This suggests that the use of …

Self-Report Measures Of Psychopathic And Schizotypal Personality Characteristics: A Confirmatory Factor Analysis Of Characteristics Of Antisocial Behavior And Hypothetical Psychosis-Proneness In A College Sample, Amber Nicole Bonogofsky

Graduate Student Theses, Dissertations, & Professional Papers

This study separated the constructs of hypothetical psychopathy and hypothetical psychosis-proneness by performing Confirmatory Factor Analyses on different proposed factor structures of both psychopathic and schizotypic subclinical symptoms using data from a college sample. The study validated and provided evidence for existing structures of each construct. Research showed that the constructs overlap in their factor structures, as do their measures, although psychopathy and schizotypy are most likely distinct constructs. As conceptualized by Dr. Robert Hare, originator of the Psychopathy Checklist Revised (PCL-R; 2003), psychopathy reflects two interrelated but distinct factors of symptoms. The first symptom factor (Factor 1) reflects the …
