A Catalog Of Low Surface Brightness Galaxies. List Ii, Stacy S. Mcgaugh

The second edition of a catalog of low surface brightness (LSB) galaxies is presented based on a visual search of the Second Palomar Sky Survey. This paper presents newly discovered LSB galaxies in 97 fields within the declination range of 0° to + 25°. The primary catalog (objects with diameters greater than 1 arcmin) contains 198 objects; the secondary catalog (30 arcsec < D < 1 arcmin) contains 140 objects. H I observations are presented for 171 of these newly discovered galaxies. Our 80% detection rate yields a fairly representative velocity distribution for a sample of LSB objects. The sample is dominated by LSB disks galaxies with 2000 < v < 9000 km s-1. Below 2000 km s-1 a few true dwarf galaxies are found. Approximately 10% of the sample has v > 10 000 km s-1 and thus represents additional examples of truly large LSB galaxies. The H I redshift distribution is consistent with the hypothesis that LSB and HSB disk galaxies, in general, are drawn from the same distribution …

The courts have yet to decide the issue of the enforceability of provisions in legal malpractice insurance policies that specifically exclude from coverage claims made by government regulators such as the FDIC. The question has reached the courts with respect to such exclusionary provisions in directors' and officers' liability insurance policies, and here the courts are split. The author discusses the current case law and the statutory developments.

Shell Games: The Continuing Legacy Of Rights To Minerals And Water On Spanish And Mexican Land Grants In The Southwest, G. Emlen Hall

This paper explores generally this paradoxical approach to mineral and water rights on confirmed Spanish and Mexican land grants. The analysis treats mineral and water rights separately. For each critical land grant resource, the paper explicates basic law of the Southwest's antecedent sovereigns. It then suggests how those Spanish and Mexican rights fit within the 1848 Treaty of Guadalupe Hidalgo guarantee of protection of "property rights." It proceeds to analyze how the United States implemented those guarantees, suggesting that the treatment of the succeeding sovereign owed more to its own law than it did to the law of the antecedent …

Measurements of reflectivity versus ac electric field E were performed in the nematic phase of octylcyanobiphenyl homeotropically aligned between two indium tin oxide coated glass slides. The change in reflectivity R was found to be linear in E, with d(R)/dE increasing monotonically toward the nematic-isotropic transition temperature. In addition, the phase of R at the front and back surfaces differed by. Such an effect will arise from t/Iorder electricity, whereby a term proportional to the product of the electric field and the gradient of the nematic order parameter appears in the bulk free energy. One of the major strains of feminist jurisprudence has criticized American law, and the liberal jurisprudence and political philosophy on which it is said to be grounded, as male or masculine.' A central theme of the critique has been that the law embodies a masculine perspective in emphasizing autonomy and the individual over interdependency and the community. Liberalism has been viewed as inextricably masculine in its model of separate, atomistic, competing individuals establishing a legal system to pursue their own interests and to protect them from others' interference with their rights to do so. Mum's The Word: The Supreme Court And Family Planning, Wendy K. Mariner

On May 23, 1991, the US Supreme Court upheld federal regulations that prohibit federally funded family planning programs from counseling about or referring for abortion. As a result, government benefits may now entail substantial costs. The regulations changed the nature of government-assisted family planning from comprehensive care and counseling to limited services and government-prescribed information. The reasoning in Rust v Sullivan allows government to limit freedom of speech in federally funded programs. The decision may have been influenced by antiabortion sentiment, but it does not affect the legality of abortion. Instead, it sets a precedent for government control of whether …

Molecular-Statistical Theory For Curvature Elasticity Of Thermotropic Main-Chain-Polymer Liquid Crystals, Rolfe G. Petschek, Eugene M. Terentjev

We develop a microscopic molecular-statistical theory for thermotropic nematic polymers, composed of semiflexible chains of bonded nematogenic monomers. In the framework of a mean-field approximation we account for pair-interaction forces between monomers, including long-range attraction, steric repulsion, and effective rigidity of the bonds between subsequent monomers on the same chain. The functional correction to the probability distribution in a nonuniform orienting field is obtained for the case of very-long-wavelength deformations. We then derive a curvature-elastic free energy for this system, in which the Frank elastic constants are expressed in terms of definite molecular and thermodynamic parameters. It is shown that …

The theme of this symposium, "Reconstructing Motherhood," requires an examination of laws designed to further traditional motherhood roles. Societal constructs of motherhood-women as child bearers and nurturers-have profoundly affected women's involvement in paid employment. Conversely, women's participation in paid employment affects how women experience motherhood. For example, a woman who does not work outside the home has a dramatically different mothering experience than a woman who works outside the home and leaves her children with a day-care provider. The legal system can affect the relationship between motherhood and employment opportunities for women by means of employment laws and policies. Sometimes …

This Article will attempt to analyze some of the considerations that should inform enlightened and compassionate public policy in this area. Section I will describe briefly the definition of mental retardation and common attributes of people who have the disability and the social and political world in which they live within our society. Section II will sketch some of the contexts in which legal issues about decision-making arise in the lives of people with mental retardation. This Article does not attempt a complete analysis of all the constitutional implications of Foucha,nor does it attempt to provide a definitive answer to the question of the constitutionality of Washington's sexual predator statute. Rather, because Foucha addressed important due process and equal protection questions relevant to the Washington statute, the Article is an attempt to analyze the case's basic constitutional holdings and discussion on the issue of state deprivation of physical liberty.
