The Complexity Of American Federalism, Christian G. Fritz
The Complexity Of American Federalism, Christian G. Fritz
Faculty Scholarship
For the Balkinization Symposium on Alison L. LaCroix, The Interbellum Constitution: Union, Commerce, and Slavery in the Age of Federalisms (Yale University Press, 2024).
Alison LaCroix’s insightful new book, The Interbellum Constitution, builds on an often-overlooked fact: that Americans living before the Civil War did not know they were part of an “antebellum” period. That oversight has contributed to a conventional narrative of constitutional history and doctrine during the first half of the nineteenth-century that tends to read that history and doctrine backwards through the lens of a war that contemporaries did not know would define them. From this …

Using Latent Variables To Improve The Management Of Depression Among Hemodialysis Patients, Douglas D. Gunzler, Martha Sajatovic, Ashwini R. Sehgal
Faculty Scholarship
Background: Screening for depression can be challenging among hemodialysis patients due to the overlap of depressive symptoms with dialysis or kidney disease related symptoms. The aim of this study was to understand these overlapping symptoms and develop a depression screening tool for better clinical assessment of depressive symptoms in dialysis patients. Methods: We surveyed 1,085 dialysis patients between March 1, 2018 and February 28, 2023 at 15 dialysis facilities in Northeast Ohio with the 9-item patient health questionnaire (PHQ-9) and kidney disease quality of life (KDQOL) instrument. To evaluate overlap across questionnaire items, we used structural equation modeling (SEM). We …

The theme for this symposium, “We the People: Citizenship, Race, and Equality,” grew out of my concern for unequal citizenship for immigrants and non-white marginalized persons in their enduring quest to obtain fuller citizenship and belonging. More specifically, the theme furthers a dialogue sparked by my past writing on the structural limits on equal citizenship. In Pursuing Citizenship, I argued that citizenship entails both substantive and formal citizenship and that people cannot fully belong without formal citizenship. Uncovering the importance of formal citizenship led to some important policy reforms, including a reduction in the naturalization backlog under the Biden …
The Limits Of Immigrant Resilience, Huyen Pham, Natalie C. Cook, Ernesto Amaral, Raymond Robertson, Suojin Wang
The Limits Of Immigrant Resilience, Huyen Pham, Natalie C. Cook, Ernesto Amaral, Raymond Robertson, Suojin Wang
Faculty Scholarship
Economists have identified important adaptations that immigrant workers have made to weather economic crises. During times of economic contraction, immigrant workers have moved across industries or geographical locations, downshifted to part-time work, and accepted lower wages to stay employed. Evidence from the Great Recession (2007–2009) shows the benefits of that economic resilience: immigrant workers were more likely than native-born workers to remain continuously employed, to have shorter periods of unemployment when they lost their jobs, and to regain jobs more quickly in the recovery period. Of course, these adaptations had significant personal costs for immigrant workers and their families, but …

Labour And Democracy, Kate Andrias
Labour And Democracy, Kate Andrias
Faculty Scholarship
Democracy has always been a central project of labour law, but it is all the more important today, with authoritarianism on the rise and democracy under threat across the globe. This chapter examines the relationship between labour law and democracy. It explores the central tension between democracy and labour under capitalism; traces how ideas and arguments about workplace democracy have evolved over time; and explores the relationship between workplace democracy and political democracy, including how and when unions serve as a bulwark against authoritarianism. Ultimately, it argues that a critical task for labour law scholarship is to rethink the body …

Medical-legal partnership (MLP) integrates the unique expertise of lawyers into collaborative clinical environments. MLP teams meet the needs of individual patients while also detecting structural problems at the root of health inequities and advancing solutions at the institutional, community, and system levels. Yet MLPs today operate in limited settings and survive on scant budgets. Expanding their impact requires secure funding. Financing MLPs as health care can do the following: (1) help address inequity at the point of care; (2) enable expert diagnosis and treatment of nonmedical drivers of health; (3) enhance team-based practice in health care organizations; (4) offer another …

As artificial intelligence (AI) continues to evolve, its impact on software development and programming is profound, drawing parallels to the shift from assembler to object-oriented programming. This article explores how AI is reshaping the landscape of software jobs, creating new opportunities rather than diminishing them. By simplifying complex tasks and lowering barriers to coding, AI is expanding the technology "pie," introducing new use cases, and enhancing efficiency. The transition from monolithic services to microservices has reduced risks and accelerated deployment processes, and AI is poised to further this evolution by managing the complexities of service interactions through advanced orchestration layers. …
Limits To Asset Manager Adaptation, Madison Condon
Limits To Asset Manager Adaptation, Madison Condon

In Our Lives in Their Portfolios, Brett Christophers provides an account of the rise of ‘asset manager society’ – a world in which the infrastructures of public life are converted from public to private ownership. Here I use Christophers’ analysis to comment on growing calls for asset manager investment in climate adaptation. The asset manager business model requires ever-escalating returns, a poor fit with the now unavoidable losses that climate change promises to bring.

Correlation signal processing of optical three-dimensional (x, y, t) data can produce super-resolution images. The second-order cross-correlation function XC2 has been documented to produce super-resolution imaging with static and blinking emitters but not for diffusing emitters. Here, we both analytically and numerically demonstrate cross-correlation analysis for diffusing particles. We then expand our fluorescence correlation spectroscopy super-resolution optical fluctuation imaging (fcsSOFI) analysis to use cross-correlation as a postprocessing computational technique to extract both dynamic and structural information on particle diffusion in nanoscale structures simultaneously. Cross-correlation maintains the same super-resolution as auto-correlation while also increasing the sampling rates to reduce aliasing for …
Alpha Angle And Anterior Femoral Neck Offset Identify Different Cohorts Of Cam Morphology: An Osteologic Study, Grigory A. Manyak
Alpha Angle And Anterior Femoral Neck Offset Identify Different Cohorts Of Cam Morphology: An Osteologic Study, Grigory A. Manyak
Faculty Scholarship
Purpose: To explore differences in cam morphology defined by alpha angle (AA) and anterior femoral neck offset (AFNO) in the context of other anthropometric parameters in an osteologic collection to further elucidate whether each measurement tool is identifying the same underlying pathology. Methods: Anthropometric measurements of 992 cadaveric hips from the Hamann-Todd Osteological Collection were analyzed. Femurs with cam morphology were identified by AA >55° or AFNO <7 mm. Anthropometric parameters stratified by cam morphology were assessed with Wilcoxon rank-sum and Pearson χ2 tests. Multivariate logistic regressions were performed on significant variables in univariate analysis to examine the predictive ability of anthropometric variables to cam morphology. Results: Cam morphology was identified in 242 hips via AA, 344 hips via AFNO, and 123 hips via both measures. Multivariate logarithmic regression analysis demonstrated that sex negatively predicted AA (females with less pathology, β = –0.14, P = .04), race negatively predicted AA (Blacks with less pathology, β = –0.21, P < .01), and proximal femoral osteoarthritis was positively associated with AA (β = 0.16, P = .02), while none of these were associated with AFNO. On the other hand, right-side specimens were associated with AA (β = 0.15, P = .02) and AFNO (β = 0.25, P < .01), whereas the combined version was unassociated with both measures. Conclusions: In conclusion, cam morphology was identified in a modest percentage of osteologic specimens by both AA and AFNO in our study. Further, associations of multiple demographic, anthropometric, and anatomical parameters to AA and AFNO suggest they may identify different subsets of cam morphology. Clinical Relevance: Cam morphology identified by AA versus AFNO may represent 2 different pathologic entities. Future studies should assess differences between these measures in a clinical cohort and determine whether these 2 definitions of cam morphology identify different clinical populations.

Over the past decade, various two-phase cooling solutions have been implemented to dissipate power in high heat flux electronic components. The manifold microchannel heat sink is an efficient thermal management solution that reduces heat resistance while also limiting the pumping power. However, there is limited work available on small form factor manifold microchannels with traditional heat sinking materials like copper. In this study, an experimental investigation is conducted to evaluate the heat transfer and pressure drop performance of copper manifold microchannel heat sinks using an environmentally friendly refrigerant, R1233zd(E), as the working fluid. A microchannel plate and a manifold plate, …

Nocturnal Paroxysmal Dystonia To Sleep-Related Hypermotor Epilepsy: A Critical Review, Neel Fotedar, Hans O. Lüders
Faculty Scholarship
Sleep-related paroxysmal motor episodes (SPMEs) have been described by various names, including nocturnal paroxysmal dystonia, nocturnal frontal lobe epilepsy (NFLE), and sleep-related hypermotor epilepsy. The underlying pathophysiology has been debated over the years, with these episodes assumed to be a form of paroxysmal dystonia or parasomnia versus a form of epilepsy. In most studies published on SPMEs and their variants (paroxysmal arousals, nocturnal paroxysmal dystonia, and episodic nocturnal wanderings) in the early 1990s, the authors speculated on the pathophysiology but did not commit to one idea. It was not until the mid-1990s that epilepsy became the leading prospect. We performed …

Machine Learning Boiling Prediction: From Autonomous Vision Of Flow Visualization Data To Performance Parameter Theoretical Modeling, Cho Ning Huang, Issam Mudawar, Chirag R. Kharangate
Faculty Scholarship
Flow boiling is a highly efficient configuration for meeting the high heat dissipation demands of thermal management systems. However, the complex physics of two-phase flow has hindered its broader application, especially in terms of quantifying visual information. Recent advancements in machine learning vision tools have revolutionized the analysis of phase change phenomena by enabling the digitalization of physically meaningful features such as void fraction, vapor-liquid interfacial behaviors, and liquid-solid wall wetting front areas en masse. In this study, we systematically investigate two-phase models that compute void fractions, heat transfer coefficients, and critical heat flux using live bubble data streams under …

AU Long-read: Pleaseconfirmthatallheadinglevelsarerepresentedcorrectly sequencing is driving rapid progress in genome assembly : across all major groups of life, including species of the family Drosophilidae, a longtime model system for genetics, genomics, and evolution. We previously developed a cost-effective hybrid Oxford Nanopore (ONT) long-read and Illumina short-read sequencing approach and used it to assemble 101 drosophilid genomes from laboratory cultures, greatly increasing the number of genome assemblies for this taxonomic group. The next major challenge is to address the laboratory culture bias in taxon sampling by sequencing genomes of species that cannot easily be reared in the lab. Here, we build …

Psychedelic Experiences And Long-Term Spiritual Growth: A Systematic Review, William A. Schutt, Julie J. Exline, Kathleen C. Pait, Joshua A. Wilt
Faculty Scholarship
Psychedelic substances, which can occasion mystical experiences, are sometimes used for religious and spiritual reasons. Despite strong links between psychedelics and spirituality, no previous systematic review has investigated connections between psychedelics and indicators of long-term spiritual growth. Thus, 34 empirical studies were analyzed with 19,724 total participants from 32 independent samples. A variety of methodologies were used among the reviewed studies, and some studies included international samples. Results showed that psychedelics—especially classic psychedelics (e.g., psilocybin, LSD, and DMT)—have been studied more often in this context than other substances. Findings indicate that psychedelic use is linked with a variety of subjective …

A Sequential, Multiple Assignment, Randomized Trial Design With A Tailoring Function, Holly Hartman
Faculty Scholarship
We present a trial design for sequential multiple assignment randomized trials (SMARTs) that use a tailoring function instead of a binary tailoring variable allowing for simultaneous development of the tailoring variable and estimation of dynamic treatment regimens (DTRs). We apply methods for developing DTRs from observational data: tree-based regression learning and Q-learning. We compare this to a balanced randomized SMART with equal re-randomization probabilities and a typical SMART design where re-randomization depends on a binary tailoring variable and DTRs are analyzed with weighted and replicated regression. This project addresses a gap in clinical trial methodology by presenting SMARTs where second …

The reduction of selenate, SeO²₄⁻(aq),in 0.1 M HClO₄ solutions, induced by underpotential deposition, UPD, of Cu on polycrystalline Au electrodes was investigated using the rotating ring-disk electrode, RRDE, technique. Design and implementation of electrode potential-rotation rate protocols made it possible to determine the rates of SeO²₄⁻(aq)reduction as a function of Cu coverage, θCu, as determined by the Bruckenstein method (Swathirajan et al. J. Phys. Chem. 1982, 86, 2480–2485). In agreement with the results reported recently for Au(111) film electrodes (Strobl et al. Electrochimica Acta 2024, 493, 144,298), the reaction was found to proceed only for θCu above a critical value, …

Thermoplastic polyurethanes (TPUs) are a family of thermoplastic elastomers with great properties such as high elongation and excellent chemical and abrasion resistance, which are processable by conventional melting methods. Nevertheless, TPUs lose mechanical properties and thermal stability at higher temperatures. In this work, we designed and synthesized a new TPU with limited crosslinking of the soft segments in order to improve its performance at high temperatures while preserving processability. Additionally, the new TPU maintains its transparency. With the incorporation of 10% trifunctional polyol, the T was increased by 7°C, the storage modulus at room temperature (25°C) was improved by 412 …

An advanced light scattering model for Total Internal Reflection Microscopy (TIRM) is presented. The model considers the specific TIRM geometry and deals with the scattering by an axisymmetric particle of arbitrary orientation placed in a stratified medium and the imaging of the scattered field. The scattered field is computed by truncating the scattered and internal field expansions and by using spherical and plane wave expansions for the free-space dyadic Green's function. While the first expansion is valid outside a sphere enclosing the particle, the second one is valid outside the tangent planes bounding the particle from above and below. We …

Money impacts relationships. And when the money involved is a foster care subsidy to kinship caregivers, it can drive a wedge in relationships between parents and kinship caregivers that should be strengthened, not strained. Unfortunately, foster care funding incentivizes the “relational disruption”1 endemic to foster care, when it should instead support family members coming together to support each other and their children.
In contrast, Medicaid funding has increasingly supported family members taking care of each other and can provide child welfare with a model for funding family caregiving without disrupting relationships and without even requiring a family court or foster …

New York courts are showing impatience with local governments that withhold or stretch out approval of projects without valid environmental grounds. In seven cases last year under the State Environmental Quality Review Act (SEQRA),courts overturned municipal actions that rejected projects or delayed approvals. In all, the courts decided 46 cases under SEQRA in 2023. Where the government agency had decided that an environmental impact statement (EIS) was not needed, that choice was upheld in 23 cases and overturned in eight. Where an EIS had been prepared, the EIS was upheld in 11 and found inadequate in only one. The remaining …
