A Rational Choice Theory Of Supreme Court Statutory Decisions With Applications To The State Farm And Grove City Cases, Rafael Gely, Pablo T. Spiller

In this article we follow the recent developments of the modern theory of administrative agencies, by developing a rational choice theory of the Supreme Court. Our framework combines two of the main characteristics of this literature: namely, the rational choice modeling strategy with the notion that institutions matter in the design of public policy. We differ basically by modeling the Supreme Court as a self-interested, ideologically motivated institution, making its decisions subject not to the traditional legal rules of precedent, but to the constraints arising from the political interests of other institutions of government-namely, Congress and the President.

Analysis Of Bacterial Genome Organization And Replication Using Pulsed-Field Gel Electrophoresis, A. Dingwall, L. Shapiro, Bert Ely

The techniques described in this chapter provide a framework with which to begin an analysis of important features of bacterial genome organization and gene function. In this report we describe the preparation of chromosomal DNA, conditions for digestion with restriction endonucleases, and electrophoretic methods that result in the optimal resolution of large DNA restriction fragments. The sizes of the separated fragments can be summed to accurately determine genome size. The fragments can also be probed in hybridization experiments to produce low-resolution genomic restriction maps, and the precise locations of insertion or deletion mutations can be rapidly identified. This work is a continuation of the debate regarding the Establishment Clause. The focus lies with Justice O’Connor’s concurrence in County of Allegheny v. ACLU and how this opinion harkens back to a concept shared by Jefferson and Madison, that the establishment clause is designed to prevent government favoritism.

The burning of agricultural residues, particularly rice straw, has long been an issue of public concern in California's Sacramento Valley. Especially during days of autumn temperature inversions, the smoke in the atmosphere from burning is regarded by some as a serious health hazard and by nearly all residents as a public nuisance. Strong pressures have resulted in stringent regulations over agricultural burning, but a growing number of voices advocate a strict prohibition on burning. The prospect of a burning ban is worrisome to rice growers since burning is not only the most cost-effective way of disposing of the straw, but …

A high-frequency oscillating electric field can change the properties of diocotron modes in non-neutral plasmas. The effect depends crucially on the azimuthal mode number, m, of the applied field. For m=0, plus or minus 1 there is no effect, and for applied standing waves there is also no effect. But if the applied field has the form of a traveling wave with the norm of m greater than or equal to 2, the frequency of stable diocotron modes can be modified and for the norm of m greater than or equal to 3, the l=2 instability of hollow density profiles …

The United States military presence in Central and South America is under attack, both literally and politically, as bombings and sniper fire directed against U.S. military personnel characterize the low-intensity conflict (LIC) environment in certain parts of Latin America. The process of contracting support for U.S. forces in a LIC environment is oriented toward sustaining operations in the field, as opposed to contracting for mobilization or surge production. Computer Simulation Study Of Conductivity In A 2-Dimensional Binary Fluid Mixture, Ras B. Pandey

A computer-simulation model is introduced to study the transport properties of a binary fluid mixture in which the constituents of one fluid (the tracer particles) carry charges in a linear charge-density gradient in the background charge of the second fluid. In the steady-state equilibrium, an effective conductivity σc(p,r) is estimated as a function of the carrier concentration p and the range of interactions r. The conductivity is observed to vary nonmonotonically with the concentration p, and it exhibits a maximum at a characteristic value pc. The conductivity decreases when the …

Relationships Between Wetland Fragmentation And Recent Hydrologic Changes In A Deltaic Coast, R. Eugene Turner, Yeleswarapu S. Rao

Patterns in coastal wetland loss in the northern Gulf of Mexico were examined using aerial imagery from 1955–56 and 1978. Five qualitative types of wetland changes are evident: (1) spoil bank-parallel pond formation, (2) pond formation with apparent random distribution for the smallest ponds, but very clumped distribution for larger ponds, (3) semi- or complete impoundment resulting in open water formation, (4) cutting off of stream channels upstream of where a spoil bank crosses a natural channel, and (5) erosion at the land-water interface. It is entirely possible that prospective teachers whose early school exposures are limited to the short student teaching endeavor will have an inaccurate or distorted perception of the problems and frustrations they will actually encounter when they being their initial teaching assignment. This study was designed to determine the impact that extensive early field experiences had on the ranking of the middle school teacher characteristics at specific stages of maturation during the teacher preparation program. Of the 10 teacher characteristics ranked, half showed significant changes in priorities across the three assessments of the opinionnaire. Evidence from this study seems to …

A survey of some techniques that may have potential for free-form modeling with algebraic surfaces is continued. Classical results as well as several recent innovations are included. Specific attention is paid to cubic algebraic surfaces, although many of the ideas presented have application to algebraic surfaces of any degree. Topics addressed include piecewise constructions, interpolation to points and space curves, and parameterization.

Theory Of Light Scattering By A Nonequilibrium Binary Mixture, J.C. Nieuwoudt, B.M. Law

A binary mixture subject to a large temperature gradient is studied. Solutions of the evolution equations for the time-dependent fluctuation correlations are obtained using mode-coupling theory subject to the assumption that the mixture is not close to a critical point. From these results predictions for the light-scattering spectrum at the Rayleigh and Brillouin lines are made. The temperature gradient is shown to cause a large enhancement of the scattering amplitude at the Rayleigh line, whereas the effect at the Brillouin line is found to be small.

In this experiment we have identified and partially characterized the immunosuppressive activity of preimplantation horse conceptus-conditioned medium (HCCM). Horse conceptuses were nonsurgically flushed from mares at Days 9-10 (n = 6), 15-16 (n = 3), and 25-26 (n = 3). After incubating the conceptuses for 24 h in RPMI-1640 supplemented with 15% fetal calf serum (FCS) and 1% penicillin/streptomycin, HCCM was obtained from cultures and tested for immunosuppressive activity in lymphocyte proliferation assays. Peripheral blood lymphocytes obtained from randomly selected mares were stimulated with mitogens (pokeweed mitogen [PWM], concanavalin A [Con A], and phytohemagglutinin [PHA]) in cultures supplemented with 0%, …

For conical bodies, at moderate angles of attack, the flow separates from the lee side, forming two vortices. Although the vortex lift contrihution is highly desirable, as the angle of attack increases, the vortex system becomes asymmetric, and eventually the vortices breakdown. Thus, some control of the separation process is necessary if the vortex lift is to be exploited at higher angles of attack. The theoretical model which is used in this analysis has three parts. First, the 'single line-vortex' model is used within the framework of 'slender-body theory' to compute the outer inviscid field for specified separation lines. Second, …

The tutorial presents some tools for free-form modeling with algebraic surfaces, that is, surfaces that can be defined using an implicit polynomial equation f(x, y, z )=0. Cubic algebraic surfaces (defined by an implicit equation of degree 3) are emphasized. While much of this material applies only to cubic surfaces, some applies to algebraic surfaces of any degree. This area of the tutorial introduces terminology, presents different methods for defining and modeling with cubic surfaces, and examines the power basis representation of algebraic surfaces. Resistance fluctuations in small metal samples result from coherent transport of the carriers. The wave functions of the carriers extend into regions which are not accessible classically. We have directly measured the length dependence of the nonlocal magnetoresistance fluctuations in Sb and Au wires by studying regions of our samples separated from the classical current path by a distance L which varied from 3Lcphi down to 0.2Lcphi (where Lcphi is the phase coherence length for the carriers in the metal). These fluctuations decay exponentially with L/Lcphi. Measurements along the classical current paths scale more slowly …
