Wrong Side Of The Mountain: A Comment On Bad Faith's Unnatural History, Robert H. Jerry Ii

In this Comment, I will argue that courts have ignored bad faith's contractual heritage and have undervalued contract law's ability to respond to insurer misconduct. To draw upon Professor Powers's thoughtful analysis, I believe that courts invoked the tort paradigm before it was clear that the contract paradigm was inadequate. For lack of data, I will stop short of recommending where we should go from here, but I will suggest that our behavior in the face of bad faith liability in tort may have changed no less than the environment and that the perceived relative calm in the tort's current …

Class I β‐1,3‐glucanases are antifungal vacuolar proteins implicated in plant defense that show developmental, hormonal, and pathogenesis‐related regulation. The expression was studied in germinating tobacco seeds of a chimeric β‐glucuronidase (GUS) reporter gene fused to 1.6 kb of the 5′ flanking sequence of the tobacco class I β‐1,3‐glucanase B (GLB) promoter. Histological staining for GUS activity showed that expression of the GLB promoter is highly localized in a specific zone of the endosperm in germinating seeds. The temporal and spatial patterns of GUS and β‐1,3‐glucanase activity found, suggest a novel function for class I β‐1,3‐glucanases during seed germination in a …

Methane consumption by forest soil was studied in situ and in vitro with respect to responses to nitrogen additions at atmospheric and elevated methane concentrations. Methane concentrations in intact soil decreased continuously from atmospheric levels at the surface to 0.5 ppm at a depth of 14 cm. The consumption rate of atmospheric methane in soils, however, was highest in the 4- to 8-cm depth interval (2.9 nmol per g of dry soil per day), with much lower activities below and above this zone. Methane oxidation by pure cultures of the methanotrophs Methylobacter albus BG8 and Methylosinus trichosporium OB3b was inhibited by ammonium choride and sodium nitrite relative to that in cultures assayed in either nitrate-containing or nitrate-free medium. M. albus was generally more sensitive to ammonium and nitrite than M. trichosporium. Both species produced nitrite from ammonium; the concentrations of nitrite produced increased with increasing methane concentrations in the culture headspaces. Inhibition of methane oxidation by nitrite was inversely proportional to headspace methane concentrations, with only minimal effects observed at concentrations of >500 ppm in the presence of 250 μM nitrite. The regulatory enzyme aspartate transcarbamoylase (ATCase), comprising 2 catalytic (C) trimers and 3 regulatory (R) dimers, owes its stability to the manifold interchain interactions among the 12 polypeptide chains. With the availability of a recombinant 70‐amino acid zinc‐containing polypeptide fragment of the regulatory chain of ATCase, it has become possible to analyze directly the interaction between catalytic and regulatory chains in a complex of simpler structure independent of other interactions such as those between the 2 C trimers, which also contribute to the stability of the holoenzyme. A new method of liquid sample introduction for a time-of-flight mass spectrometer (TOF-MS) has been developed by applying the method of matrix-assisted laser desorption ionization to aerosols. Analyte biomolecules are dissolved in a methanol solvent along with a UVabsorbing matrix and formed into an aerosol with a pneumatic nebulizer. The aerosol particles are dried in a heated skimmer tube before ionization by pulsed 355-nm UV laser radiation. Mass analysis is achieved in a linear TOF-MS. Results for the ionization of bovine insulin (5733.5 Mw) are reported. © 1994 American Society for Mass Spectrometry.

The coronavirus strain HECV‐4408 was isolated from diarrhea fluid of a 6‐year‐old child with acute diarrhea and propagated in human rectal tumor (HRT‐18) cells. Electron microscopy revealed coronavirus particles in the diarrhea fluid sample and the infected HRT‐18 cell cultures. This virus possessed hemagglutinating and acetylesterase activities and caused cytopathic effects in HRT‐18 cells but not in MDBK, GBK and FE cells. One of four S‐specific monoclonal antibodies reacted in Western blots with HECV‐4408, BCV‐L9 and BCV‐LY138 but not with HCV‐OC43, and two reacted with BCV‐L9 but not with HECV‐4408, BCV‐LY138 and HCV‐OC43. An experiment was conducted to determine whether sodium bentonite (NaB) or hydrated sodium calcium aluminosilicate (HSCA) would affect growth performance and tibia mineral concentrations in chicks fed nutrient-deficient diets. Two identical trials were conducted; each using 240 5- to 19-d-old broiler chicks (4 replicates of 5 chicks each) in a completely random design. A factorial arrangement of treatments consisted of four types of nutrient deficiencies [nutritionally complete basal (C), macromineral-deficient (-MM), trace mineral- and vitamin-deficient (-TMV), and crude protein-deficient (-CP)], and three types of additive (none, .5% NaB, and .5% HSCA). The -MM and -TMV diets reduced (P < .01), gain, feed intake, and gain:feed. The -CP diet decreased (P < .01) gain and gain:feed but did not affect (P > .10) feed …

The interactive effects of dietary Cu and water Cu on poult growth, water intake, whole-blood hemoglobin (Hb), and plasma and liver Cu concentrations were investigated using 232-9-old toms. Poults were randomly assigned to two levels of dietary Cu [Basal (B) and B + 204 mg Cu/kg diet] and to four levels of water Cu (0, 51.5, 103, and 206 mg Cu/kg water) in a 2 x 4 factorial arrangement of treatments. Three species of nitidulid beetles from Ecuador and Costa Rica are described as new: Pocadius maquipucunensis, P. ephite, and P. ephite and P. jelineki. These species were collected from puffball fungi of the genus Lycoperdon or in flight-intercept traps located in high-altitude cloud forests. Pocadius dimidiatus Jelínek 1977, previously known from Argentina, is reported from Tambopata Province, Peru. Specimens of P. dimidiatus were collected from fungi in the genera Lycoperdon and Geaster or in flight-intercept traps located in lowland tropical rainforest. © 1994 Taylor & Francis Group, LLC.

This Article discusses the shortcomings inherent in the consideration and enactment of the arbitrability provisions of the ADA and the 1991 Civil Rights Act. As a threshold matter, Part II demonstrates that the latter Act's textual encouragement of arbitration indicates that Congress misapprehended the effect of Gilmer, which the Supreme Court had decided barely six months before the Act's passage. Specifically, this Part will argue that after Gilmer, textual encouragement of arbitration has little or no greater legal significance than textual silence would have. This Article examines why issuers frequently cannot present bondholders with an offer that draws on collective action problems to force the acceptance of the offer by the bondholders. The analysis is restricted to publicly offered bonds. For a number of reasons, privately placed debt presents fewer opportunities for coercion. A prior business relationship among various purchasers, which facilitates cooperation, may be more likely with respect to privately placed debt. Privately placed debt often has more significant protection for the bondholders than public debt with the same level of seniority

Professor Culp has aptly warned us that in our discussion of employment discrimination we should not lose sight of the need to address the spectrum of policies affecting the status of African-Americans. Without serious efforts in all aspects of American life (e.g., housing, education, health care, political and economic empowerment) our chances of significantly improving the future for African-American men are slim.

In the aftermath of a typical strike, management often seeks to restore order to the workplace by imposing restrictions on employee expression. Although in principle employee expression is protected by section 7 of the National Labor Relations Act, courts, relying on outdated notions of workplace organization, often accept ad hoc management justifications for restrictions on employee expression. The author argues that after a strike, it is crucial for employees to be able to express their grievances or vent their frustrations at exactly the same time that employers feel it necessary to restrict expression as a way of re-imposing order in …

Diffuse galactic continuum γ-ray emission in the 0.75-30 MeV range from the inner Galaxy has been studied using data from COMPTEL on the Compton Gamma-Ray Observatory. Observations of the inner Galaxy from the Sky Survey have been used. The imaging properties of COMPTEL enable spatial analysis of the γ-ray distribution using model fitting. A model based on atomic and molecular gas distributions in the Galaxy has been used to derive the emissivity spectrum of the γ-ray emission and this spectrum is compared with theoretical estimates of bremsstrahlung emission from cosmic-ray electrons.

Natural radiative lifetimes of the states in the highly perturbed 5d10np 2P sequence in neutral gold, Au i, for n=69, as well as of four of the perturbing 5d96s6p 2P states, have been measured. This was done by direct excitation from the ground state with short-pulse vacuum-ultraviolet laser light and time-resolved detection of the laser-induced fluorescence. We found the lifetimes to be (6p 2P1/2)=6.2(2) ns, (6p 2P3/2)=4.7(2) ns, (7p 2P1/2)=6.4(7) ns, (7p 2P3/2)=5.3(7) ns, (8p 2P1/2)=63(3) ns, (8p 2P3/2)=24(2) ns, (9p 2P1/2)=28(2) ns, and (9p 2P3/2)=75(4) ns. Glacial till, glaciomarine diamictites, and ice-rafted detritus found in marine cores collected off the shore of southeast Greenland record multiple Late Cenozoic glaciations beginning in the Late Miocene. Distinct rock assemblages and seismic stratigraphic control correlate the diamictites with glaciation of the southeast Greenland margin. Glaciers advanced to the sea during several intervals in the Pliocene and Pleistocene. North Atlantic glaciation may have nucleated in southern Greenland rather than further north because of the high mountains and the high levels of precipitation in this region.

We have examined the pathway and energetics of urea‐induced dissociation and unfolding of the catalytic trimer (C3) of aspartate transcarbamylase from Escherichia coli at low temperature in the absence and presence of carbamyl phosphate (CP; a substrate), N‐(phosphonacetyl)‐L‐Asp (PALA; a bisubstrate analog), and 2 anionic inhibitors, Cl− and ATP, by analytical gel chromatography supplemented by activity assays and ultraviolet difference spectroscopy. In the absence of active‐site ligands and in the presence of ATP, c3 dissociates below 2 M urea into swollen c chains that then gradually unfold from 2 to 6 M urea with little apparent cooperativity. Results of an in vitro assay revealed that root-associated methane consumption was a common attribute of diverse emergent wetland macrophytes from a variety of habitats. Maximum potential uptake rates (V(maxp)) varied between about 1 and 10 μmol g (dry weight)-1 h-1, with no obvious correlation between rate and gross morphological characteristics of the plants. The V(maxp) corresponded to about 2 x 108 to 2 x 109 methanotrophs g (dry weight)-1, assuming that root-associated methanotrophs have cell- specific activities comparable to those of known isolates. The effects of carbon deprivation on survival of methanotrophic bacteria were compared in cultures incubated in the presence and absence of oxygen in the starvation medium. Survival and recovery of the examined methanotrophs were generally highest for cultures starved under anoxic conditions as indicated by poststarvation measurements of methane oxidation, tetrazolium salt reduction, plate counts, and protein synthesis. This paper is concerned with studying hereditary properties of primary decompositions of torsion R[X]-modules M which are torsion free as R-modules. Specifically, if an R[X]-submodule of M is pure as an R-submodule, then the primary decomposition of M determines a primary decomposition of the submodule. This is a generalization of the classical fact from linear algebra that a diagonalizable linear transformation on a vector space restricts to a diagonalizablc linear transformation of any invariant subspace. Additionally, primary decompositions are considered under direct sums and tensor product. © 1994, Hindawi Publishing Corporation. All rights reserved.
