This Article identifies a few of those techniques by examining a number of quasi-quantitative legal analyses that have addressed a range of legal relationships. The methodology of this Article consists of reviewing the relationship between those legal analyses and their associated non-legal disciplines. The unifying theme of the discussed examples is that a useful, well constructed quantitative analysis or approach has been improperly extended into a legal context.

In the first issue of the Clinical Law Review, Peter Hoffman challenged clinical legal educators to produce clinical scholarship that is “practical in its orientation and design” and written so as to enhance the ability of lawyers to represent their clients and to help law students prepare for law practice. [T]he Negro needs neither segregated schools nor mixed schools. What he needs is Education. What he must remember is that there is no magic, either in mixed schools or in segregated schools. A mixed school with poor and unsympathetic teachers, with hostile public opinion, and no teaching of truth concerning black folk, is bad. A segregated school with ignorant placeholders, inadequate equipment, poor salaries, and wretched housing, is equally bad. This article provides an analysis of Ernesto Che Guevara's theory of guerrilla warfare, the foco. The numerous changes to the originalfoco thesis, as presented in Guerrilla Warfare (1960), are examined in detail covering two dozen articles, speeches, essays, interviews and books authored by Guevara, Castro and Debray while stressing their relation to national and international politics. The author argues that there was an apparent discourse between Cuban politics and the numerous changes in Guevara's writings. The statio and dynamic structure factors of binary fluids in a dilute gel are computed using a two-dimensional kinetic Ising model. The wetting effect of the gel strands is modeled with ''gel atoms'' which are distributed randomly among the spins and impose a field on their neighboring spins, all in the same direction. The result for the static structure factor shows the presence of adsorption clusters which mask the gel atoms. Assessing Fundamental Power Differences In Exchange Networks: Iterative Gpi, Michael J. Lovaglia, John Skvoretz, Barry N. Markovsky, David Willer

Networks have been discovered for which Network Exchange Theory (NET Markovsky, Willer and Patton 1988; Lovaglia, Skvoretz, Willer and Markovsky 1995) fails to provide tenable predictions. Here we elaborate NET to create a more general method. We show not only when and where exchange networks break into simpler substructures, but propose rules to decisively classify networks and substructures as strong, weak, or equal power. In doing so, we advance general heuristics for power development in exchange networks and demonstrate the promise of an approach using reciprocal comparison of general heuristics, formal theory, and computer simulation.

An Adaptive Learning Model Which Accommodates Asymmetric Error Costs And Choice-Based Samples, James V. Hansen, James B. Mcdonald, Rayman D. Meservy

This paper introduces an adaptive-learning model, EGB2, which optimizes over a parameter space to fit data to a family of models based on maximum-likelihood criteria. We also show how EGB2 can be modified to handle asymmetric costs of Type I and Type II errors, thereby minimizing misclassification costs. It has been shown that standard methods of computing maximum-likelihood estimators of qualitative-response models are generally inconsistent when applied to sample data with different proportions than found in the universe from which the sample is drawn. A Provably Convergent Dynamic Training Method For Multi-Layer Perceptron Networks, Timothy L. Andersen, Tony R. Martinez

This paper presents a new method for training multi-layer perceptron networks called DMP1 (Dynamic Multilayer Perceptron 1). The method is based upon a divide and conquer approach which builds networks in the form of binary trees, dynamically allocating nodes and layers as needed. The individual nodes of the network are trained using a genetic algorithm. The method is capable of handling real-valued inputs and a proof is given concerning its convergence properties of the basic model. Simulation results show that DMP1 performs favorably in comparison with other learning algorithms.

Laboratory searches for the detection of gravitational waves have focused on the detection of burst signals emitted during a supernova explosion but have not resulted in any confirmed detections. An alternative approach has been to search for continuous wave (CW) gravitational radiation from the Crab pulsar. In this paper, we examine the possibility of detecting CW gravitational radiation from pulsars and show that nearby millisecond pulsars are generally much better candidates. We show that the minimum strain hc ∼ 10-26 that can be detected by tuning an antenna to the frequency of the millisecond pulsar PSR 1957+20, with the detector …

Murine hepatitis virus strain (MHV-3) produces a strain-dependent pattern of disease which has been used as a model for fulminant viral hepatitis. This study was undertaken to examine whether there was a correlation between macrophage activation and susceptibility or resistance to MHV-3 infection. Peritoneal macrophages were isolated from resistant A/J and susceptible BALB/cJ mice and, following stimulation with MHV-3 or lipopolysaccharide (LPS), analyzed for transcription of mRNA and production of interleukin-1 (IL-1), tumor necrosis factor alpha (TNF-alpha), transforming growth factor beta (TGF-beta), mouse fibrinogen-like protein (musfiblp), tissue factor (TF), leukotriene B4, and prostaglandin E2 (PGE2). This paper examines the legal foundations of large-value credit transfer systems and the importance of certainty, efficiency, and fairness in funds transfer law. A case study is presented to highlight key terminology and concepts. Thereafter, five particularly noteworthy legal rules are discussed in the context of the case study: (1) a rule defining the scope of the law; (2) a rule establishing when the rights and obligations of parties to a funds transfer are triggered; (3) a receiver finality rule; (4) a rule assigning liability for interloper fraud; and (5) a money-back guarantee rule, coupled with provisions on discharge. This paper proposes a conceptual framework for designing a traffic control scheme. It adopts a top-down approach to defining major design steps starting with high-level feature definition. With the desired features defined, the top-down approach then identifies and defines moves and related planning and movement functions that are required for supporting the desired features. A pixel scale digital to analog converter and driver for liquid crystal (LC) cells is presented. The circuit is a compact CMOS logic gate that sums pulse density modulation (pdm) signals. Low pass filtering of the pdm signal is 'done by the LC material. The circuit is suitable to implement large arrays of converters as, for example, in display applications. It is applicable in LC on silicon displays where gray scale data are stored and converted at each pixel site. The exclusive production of ρ{variant}0mesons in deep inelastic electron-proton scattering has been studied using the ZEUS detector. Cross sections have been measured in the range 7 < Q2< 25 GeV2for λ*p centre of mass (c.m.) energies 40 to 130 GeV. The λ*p → ρ{variant}0p cross section exhibits a Q-(4.2±0.8-0.5+1.4)dependence and both longitudinally and transversely polarised ρ{variant}0's are observed. The λ*p → ρ{variant}0p cross section rises strongly with increasing c.m. energy, when compared with NMC data at lower energy, which cannot be explained by production through soft pomeron exchange. The data are compared with perturbative QCD calculations where the rise in the cross section reflects the increase in the gluon density at low x. © 1995.

Inclusive jet cross sections for events with a large rapidity gap with respect to the proton direction from the reaction ep → jet + X with quasi-real photons have been measured with the ZEUS detector. The cross sections refer to jets with transverse energies ETjet> 8 GeV. The data show the characteristics of a diffractive process mediated by pomeron exchange. Assuming that the events are due to the exchange of a pomeron with partonic structure, the quark and gluon content of the pomeron is probed at a scale ∼ (ETjet)2. Is There A Connection Between No-Hair Behavior And Universality In Gravitational Collapse?, Jorge Pullin

We apply linear perturbation theory to the study of the universality and criticality first observed by Choptuik in gravitational collapse. Since these are essentially nonlinear phenomena our approach provides a rough approximation. In spite of this, universal behavior of the final black hole mass is observed with an exponent only slightly higher than the observed value of 0.367. The universal behavior is based on the unique form that in-falling perturbations on black holes have at the horizon. © 1995.

The histones H2B, H3 and H4, the transition protein TP1 and protamine were localised using ultrastructural immunocytochemistry in nuclei of rabbit spermatids and spermatozoa. Histones are present in round spermatid nuclei and are lost during the elongation of nuclei. TP1 and protamine appear simultaneously in all nuclei during this period. TP1 is located at the periphery of chromatin cords, while protamine seems to be located at random in the same cords. TP1 is lost in most elongated sprematids during step 13 of spermiogenesis, and the protamine stays in all sperm nuclei. TP1 remains persent in some old spermatids and ejaculated …

Demand for household furniture is shaped by a multitude of dynamic forces, from the global economic situation to subtle changes in consumer preferences. Correspondingly, the academic disciplines employed to identify, analyze, and predict these forces range from macroeconomics to psychology, and include demography, sociology, geography, and several applied fields. The demographic characteristics of furniture consumers has been a particularly popular area of research, primarily because of the availability of secondary data from various public · agencies. Some of this research is reviewed in a subsequent section of this report.

Learning and reasoning are both aspects of what is considered to be intelligence. Their studies within AI have been separated historically, learning being the topic of machine learning and neural networks, and reasoning falling under classical (or symbolic) AI. However, learning and reasoning are in many ways interdependent. This paper discusses the nature of some of these interdependencies and proposes a general framework called FLARE, that combines inductive learning using prior knowledge together with reasoning in a propositional setting. Several examples that test the framework are presented, including classical induction, many important reasoning protocols and two simple expert systems.

A new representation for electromagnetic boundary conditions involving a boundary projection operator defined using the interior and exterior products of the calculus of differential forms is developed. This operator expresses boundary conditions for fields represented by differential forms of arbitrary degree. With vector analysis, the field intensity boundary conditions require the cross product, whereas the flux boundary conditions use the inner product. With differential forms, the field intensity and flux density boundary conditions are expressed using a single operator. To understand the mechanisms responsible for seasonal fluctuations in growth and N2 fixation in intertidal microbial mat communities, we quantified seasonal changes in mat community composition, related these changes to diel and seasonal N2 fixation rates, and evaluated community responses (growth, N2fixation, composition) to long-term (22 d) nutrient addition bioassays. A temperate intertidal cyanobacterial mat community, located in coastal North Carolina, USA, was sampled at monthly intervals for 1 yr (1993-94) to determine changes in community composition. The abundances of major phototrophic groups were quantified based on the relative concentrations of taxaspecific photopigments (chlorophylls and carotenoids). …

Exocytosis of transmitter at most synapses is a very fast process triggered by the entry of Ca2+ during an action potential. A reasonable expectation is that the fast step of exocytosis is followed by slow steps readying another vesicle for exocytosis but the identity and kinetics of these steps are presently unclear. By voltage clamping both pre- and postsynaptic neurons in an isolated pair of retinal amacrine cells, we have measured evoked synaptic currents and responses to single vesicles of transmitter (minis). From these currents, we have computed the rate of exocytosis during a sustained presynaptic depolarization. We show here …

Photoproduction at HERA is studied in ep collisions, with the ZEUS detector, for γp centre-of-mass energies ranging from 130-270 GeV. A sample of events with two high-pT jets (pT > 6 GeV, η < 1.6) and a third cluster in the approximate direction of the electron beam is isolated using a clustering algorithm. These events are mostly due to resolved photoproduction. The third cluster is identified as the photon remnant. Its properties, such as the transverse and longitudinal energy flows around the axis of the cluster, are consistent with those commonly attributed to jets, and in particular with those found for the two jets in these events. The mean value of the photon remnant pT with respect to the beam axis is measured to be 2.1 ± 0.2 GeV, which demonstrates substantial mean transverse momenta for the photon remnant. © 1995.
