In the 1993 New York City School Board elections, a system of proportional representation allowed lesbians and gay men to elect representatives of their choice. In response to the School Board's plan to introduce the Children of the Rainbow Curriculum, the New York City chapter of the Christian Coalition, an organization of the Christian Right, began an opposition campaign with the slogan "No Sodom on the Hudson" that pitted parents of color against so-called “rich white gays.” Having succeeded in forcing the school chancellor's resignation, the Christian Coalition formulated a plan for the takeover of all New York City …

As the 1996 election year commenced, the leading issues of the day included welfare reform, late-term abortions, Bosnia, immigration, drugs, taxes, the budget deficit, and the budget impasse that had shut parts of the federal government. The "hot" national issues did not include judicial philosophy, federal judicial appointments, individual judges or particular judicial decisions. Within weeks, however, that changed, thanks to a single judicial opinion. In January of 1996, the South African Parliament ratified the long-awaited Land Reform (Labour Tenants) Bill, which has engendered heated controversy since its inception. For many, the success of the Land Reform Bill portends the economic and political future of South Africa and is a gauge of apartheid's vital signs. Without land, most South Africans would remain in the same impoverished and disenfranchised conditions that they were in under the apartheid regime. The Pentium Papers: A Case Study Of Collective Institutional Investor Activism In Litigation, Joseph A. Grundfest, Michael A. Perino

This article suggests that institutional investors have rational incentives to become more active in the litigation arena, but that the current debate is falsely constrained because it rests on the assumption that institutional investors must participate either by (1) assuming the formal role of lead plaintiff, class representative, or intervenor or, (2) not participating at all. This is a false dichotomy because, as this article demonstrates, institutions have available to them a rich array of flexible, informal, and relatively inexpensive mechanisms by which they can make their views known to litigants and courts alike.

One hears a great deal these days about the decline of the nation state. The concept of a sovereign country whose inhabitants share a common ancestry or culture is said to be obsolescent, if not already obsolete. Several factors, apparently, are responsible: the creation of supranational institutions like the European Union and the World Trade Organization; the growing influence of nongovernmental organizations; the emergence of a new global economy; and the formation of a worldwide consumer culture, to name just a few. The law, it is argued, must adapt.

This article will explore potential antitrust liability arising from attempted enforcement of invalid patents or trade secrets known to be invalid. A fundamental tension exists between the law of intellectual property and antitrust law. Federal patent laws and the state law doctrines of trade secrets confer on the holder exclusive rights to exploit an invention or creation and to exclude others from its use. The rationale of the patent laws and state intellectual property laws is to foster innovation and to provide inventors with protection for the fruits of their labor. This Article examines the question of whether journalists in the print or electronic media are professionals and hence exempt from coverage under the Fair Labor Standards Act of 1938 ("FLSA") or whether they are wage earners and therefore covered by the FLSA. Department of Labor regulations are unclear as to the status of journalists under the FLSA; they recognize that journalists may qualify as professionals but appear to state that most journalists are covered by the FLSA. Starting and operating an electronic journal is similar to starting and operating any journal; it is only the actual “mailing” of an electronic journal that is easier. The author discusses his experience in starting the Journal of Online Law, an electronic journal dealing with the legal issues of cyberspace. He describes his experience in addressing questions such as whether to charge for access, how to gain visibility for the journal, what type of articles make the most sense for electronic publication, which forms of electronic distribution make the most sense, and other issues.

This paper describes how the University of Northern Iowa constructed formal networks that increased communications with public school practitioners and infused new ideas into the teacher training program. Faculty in the Office of Student Field Experience decided all regional campuses of the university should provide some common experiences for teacher trainees; including not only a common core curriculum; but similar structures for delivery as well. The core curriculum was built on five ingredients: teaching experiences; seminars; journals; conferences; and action research projects. Currently every Area Education Agency; community college; and Regent University in Iowa is connected by a fiber optic system known as the Iowa Communications Network (ICN). Every semester; 7 to 13 college credit classes have been offered at the University of Northern Iowa (UNI) via the ICN since 1993. In the Spring of 1995 seven classes (six graduate; one undergraduate) were offered on the ICN by UNI; all were taught by a different instructor; each of whom had participated in a 3-day preparatory workshop. First, this essay details the technical elements required to set up a computer for Web-surfing, then it discusses the rationale for a Web-browser component in Culture and Civilization courses. The first part of this study (the technical portion) is geared specifically toward teachers with little or no familiarity with the Internet and the World-Wide Web. The class B organ identity genes, APETALA3 and PISTILLATA, are required to specify petal and stamen identity in the Arabidopsis flower. We show here that the activities of these two genes are sufficient to specify petals and stamens in flowers, in combination with the class A and C genes, respectively. Flowers of plants constitutively expressing both PISTILLATA and APETALA3 under the control of the 35S promoter from cauliflower mosaic virus consist of two outer whorls of petals and inner whorls of stamens. The Effects Of Multiple Electroplated Zinc Layers On The Inhibition Of Hydrogen Permeation Through An Iron Membrane, D. H. Coleman, G. Zheng, Branko N. Popov, Ralph E. White

The Devanathan-Stachurski permeation technique was used to investigate the rate of hydrogen permeation through an iron membrane with consecutively electroplated zinc layers. Hydrogen evolution rates and hydrogen permeation rates were followed as functions of time at different applied potentials. Hydrogen evolution and permeation decreased with each successive zinc layer until finally reaching an average decrease of 93 and 96%, respectively, as compared with bare iron. Hydrogen surface coverage, exchange current density, absorption-adsorption reaction constant, and hydrogen recombination constant were estimated on bare iron and on zinc-plated iron. Anomalous Codeposition Of Fe-Ni Alloys And Fe-Ni-Sio2 Composites Under Potentiostatic Conditions, M. Ramasubramanian, S. N. Popova, Branko N. Popov, Ralph E. White, K. M. Yin

A mathematical model has been developed to describe the electrodeposition of Fe-Ni alloys and Fe-Ni-SiO2 composites under potentiostatic conditions. This model can be used to predict the polarization behavior, partial current densities, and alloy composition of each of the components as a function of the applied potential. Fe-Ni-SiO2 samples were deposited on platinum rotating disk electrodes from sulfate electrolytes under potentiostatic conditions, and the results obtained were compared to the model. The model predictions were found to agree well with the experimental observations for the Fe-Ni and Fe-Ni-SiO2 systems.

Determination Of Transport And Electrochemical Kinetic Parameters Of Bare And Copper-Coated Lani4.27Sn0.24 Electrodes In Alkaline Solution, G. Zheng, Branko N. Popov, Ralph E. White

Electrochemical properties of bare and copper-coated LaNi4.27Sn0.24 electrodes were investigated in alkaline solution. The exchange current density, polarization resistance, and equilibrium potential were determined as functions of the state of charge in the electrodes. The symmetry factors for bare and copper-coated electrodes were estimated to be 0.53 and 0.52, respectively. By using a constant current discharge technique, the hydrogen diffusion coefficient in bare and coated LaNi4.27Sn0.24 was estimated to be 6.75 × 10–11 cm2/s.

Porous electrode theory was applied to estimate the exchange current density, the polarization resistance, and symmetry factor for LaNi4.27Sn0.24 hydride electrode in alkaline solution. The exchange current density, polarization resistance, and symmetry factor were determined from polarization curves which were obtained at low overpotentials.

Galvanostatic pulse and pulse reverse techniques have been used to study the plating of zinc–nickel alloys in the presence of nonyl phenyl polyethylene oxide. The effects of average current density, rotation speed of disc electrode and the presence of nonyl phenyl polyethylene oxide in the electrolyte on deposition of zinc–nickel alloys were evaluated. Zinc–nickel plating bath solution chemistry was studied by determining the equilibrium concentrations at various pH levels. A mathematical model is presented for the galvanostatic deposition of Ni(OH)2 films in stagnant Ni(NO3)2 solutions. The objective is to quantify the anomalous deposition behavior reported previously in which the utilization of the electrochemically generated OH– species decreased drastically as the concentration of Ni(NO3)2 increased beyond 0.1 M. For example as the Ni(NO3)2 concentration increased from 0.1 to 2.0 M, the deposition rate decreased by a factor of ten at 2.5 mA/cm2. This paper describes a new approach to solving the equations comprising the shrinking core model for diffusion and reaction of a chemical species in a solid spherical particle. The reactant adsorbs on the particle surface, diffuses into the particle's interior, and reacts with the particle to form a solid product. The shrinking core model assumes a fast reaction rate compared to reactant diffusion so that the reaction is localized in the interfacial zone between the unreacted solid core and the surrounding shell of reacted product.
