The debate over improving the civil justice system has gone through many permutations over the years. Discovery, punitive damages and alternative dispute resolution are but a few of the paths that have been pursued. A case argued to the U.S. Supreme Court in January addresses the question from yet another-and potentially a more fundamental direction: the reach of the Seventh Amendment's guarantee of a jury trial in civil cases in federal court.

Variable-Complexity Trellis Decoding Of Binary Convolutional Codes, David W. Matolak, S. G. Wilson

Considers trellis decoding of convolutional codes with selectable effort, as measured by decoder complexity. Decoding is described for single parent codes with a variety of complexities, with performance "near" that of the optimal fixed receiver complexity coding system. Effective free distance is examined. Criteria are proposed for ranking parent codes, and some codes found to be best according to the criteria are tabulated, Several codes with effective free distance better than the best code of comparable complexity were found. Asymptotic (high SNR) performance analysis and error propagation are discussed. Simulation results are also provided.

As the United States moves from being a predominantly biracial to a multiracial society, racial attitudes continue to become more diverse and more complex. Scholars need to address these changes not only in terms of black and white Americans, but also how these changes involve and affect other racial groups, particularly Asian and Hispanic Americans. This inquiry looks at some of these complexities by examining how social construction differentials in the minds of white Americans affect their attitudes toward the issues of equal opportunity and multiculturalism. Electrostatics are central to the function and regulation of Escherichia coli aspartate transcarbamylase, and modeling has suggested that long range electrostatic effects are likely to be important (Glackin, M. Spectrum Generating Operators And Intertwining Operators For Representations Induced From A Maximal Parabolic Subgroup, Thomas Branson, Gestur Ólafsson, Bent Ørsted

We present a new method of calculating intertwining operators between principal series representations of semisimple Lie groups G. Working in the compact realization we find the eigenvalues of the operators on the K-types, and give several examples. Among the advantages of our method is its applicability to bundle-valued cases. © 1996 Academic Press, Inc.

North Mississippi has significant hardwood timber resources. Hardwood timber in the region has traditionally been an important source of raw material for furniture and other wood-based industries. In recent years, however, demand has greatly increased for hardwood timber for use in the pulp and paper industry, resulting in increased harvest levels of pole-sized and small sawtimber-sized hardwoods in the region. Increased harvests of hardwood timber have given rise to concerns about the longerterm availability of hardwoods that are large enough in size to be efficiently converted into lumber and other solid wood products. Total And Partial Stand-Level Yield Prediction For Loblolly And Slash Pine Plantations In East Texas, J. David Lenhart

Observations from East Texas Pine Plantation Research Project permanent plots in loblolly (Pinus taeda L.) and slash (Pinus elliottii Engelm.) pine plantations throughout East Texas were utilized to develop methods to estimate stand-level yield values. Predicted yields are volume in cubic feet and green weight in pounds. Predictor variables for total yield are plantation age, site index (base age 25 yr) and surviving trees per acre. Partial yield is derived using total yield and plantation quadratic mean diameter in conjunction with specified threshold dbh and upper stem dob values. Concerns are being raised in both professional literature as well as in the popular press regarding certain aspects of the literature-based movement. Here we report on findings from a longitudinal study of a group of first -grade teachers who have been attempting (with varying degrees of success)to introduce literature-based teaching strategies into their classrooms. We inspect the experiences of these teachers in relation to four areas of concern that have been raised regarding literature-based teaching: 1. skills instruction; 2.guided reading strategies; 3. literature selection;and 4. thematic teaching (or curriculum integration). A dual convex programming approach to solving linear programs with inequality constraints through entropic perturbation is derived. The amount of perturbation required depends on the desired accuracy of the optimum. The dual program contains only non-positivity constraints. An ϵ-optimal solution to the linear program can be obtained effortlessly from the optimal solution of the dual program. Since cross-entropy minimization subject to linear inequality constraints is a special case of the perturbed linear program, the duality result becomes readily applicable. In this paper, three-level block coded 8-PSK modulations, suitable for satellite broadcasting of digital TV signals, are presented. A design principle to achieve unequal error protection is introduced. The coding scheme is designed in such a way that the information bits carrying the basic definition TV signal have a lower error rate than the high definition information bits. The large error coefficients, formally associated with standard mapping by set partitioning, are reduced by considering a nonstandard partition of an 8-PSK signal set. The bits-to-signal mapping induced by this partition allows the use of suboptimal low-complexity soft-decision decoding of binary block …

Infection And Fungal Development Of Tubakia Dryina On Sweet Gum (Liquidambar Styraciflua), Josephine Taylor, Shane Clark

Infection and fungal development of Tubakia dryina were investigated on leaves of sweet gum using a combination of microscopic techniques. Conidia of T. dryina adhered to the leaf surface and formed septate germ tubes. Germ tubes terminated in small appressoria that formed directly over epidermal cells. Intra- and intercellular hyphae ramified extensively throughout the leaf tissue. Host cells associated with the infection site became necrotic and collapsed, resulting in macroscopic disease symptoms.

A stomach content analysis was conducted on Hemidactylus turcicus, the Mediterranean gecko, from 19 April 1990 to 15 October 1990, on the campus of Stephen F. Austin State University, Nacogdoches, Texas. Geckos (N = 167) were placed into four size groups based on snout-vent-length (5 29 mm, 30-39 mm, 40-49 mm, and z 50 mm) and three microhabitat groups based on perch height (those occupying perch sites < 1.52 m, 2 1.52 m to 5 3.05 m, and > 3.05 m). Stomach contents were analyzed and sex, size, and microhabitat groups were compared using Schoener's percent overlap index. Statutory Interpretation In Securities Jurisprudence: A Failure Of Textualism, Ediberto Román

This Article critiques the development of textualist theory in securities jurisprudence and analyzes the Central Bank decision as an example of the defects inherent in the application of a textualist approach. It demonstrates how the development of textualist securities jurisprudence stemmed from decisions that casually rejected precedent and mischaracterized existing law, thereby resulting in a distortion of the legislature’s intent. An analysis of the Securities Exchange Act demonstrates how the Central Bank Court’s approach towards statutory interpretation led to its failure to analyze other relevant Exchange Act provisions, including the most relevant provision – Section 20(a). Two important features of modern accounts of associative learning are (1) the capacity for contextual stimuli to serve as a signal for an unconditioned stimulus (US) and (2) the capacity for a previously conditioned (excitatory) stimulus to "block" learning about a redundant stimulus when both stimuli serve as a signal for the same US. Here, we examined the process of blocking, thought by some to reflect a cognitive aspect of classical conditioning, and its underlying mechanisms in the marine mollusc Hermissenda. Considers the implications of privatizing the Food and Drug Administration's (FDA) review of the safety and efficacy of medical devices and drugs. Concludes that the FDA's flaws - namely, a risk avoidance culture and autocratic style of regulation - can only be accomplished by breaking the agency's monopolization of this review function.

Pine plantations on Typic Quartzipsamments in East Texas are difficult to establish. Forest management options following clearcutting are limited. An 8-year regeneration study of the growth and survival of loblolly, Pinus taeda, L. shortleaf, P. echinata Mill., slash, P. elliotii Engelm and longleaf pines P. palustris Mill. was conducted to determine optimum tree species and treatments for reforestation, and to recommend practical alternative land uses and management strategies for Typic Quartzipsamments. Successful regeneration provides new opportunities for insects and pathogens. Repeated measurement during 1982-1992 of East Texas Pine Plantation Research Project permanent plots in loblolly( Pinus taedaL .) and slash( Pinus elliottii Engelm.) pine plantations throughout East Texas were used to develop equations for predicting the future number of trees per acre. A typical condition of East Texas pine plantations is the incidence of fusiform rust( Cronatrium quercuum [Berk.] Miyabe ex Shirai f. sp. fusiforme). For several decades general opinion has suggested that southern flying squirrels (Gluucomys volans) have a negative effect on Red-cockaded Woodpeckers (Picoides borealis) through competition for cavities and egg/nestling predation. Complete removal of hardwood trees from Red-cockaded Woodpecker cavity tree clusters has occurred on some forests because southern flying squirrel abundance was presumed to be associated with the presence and abundance of hardwood vegetation. In some locations, southern flying squirrels have been captured and either moved or killed in the name of Red-cockaded Woodpecker management.
