First-Year Survival And Growth Of Bareroot, Container, And Direct-Seeded Nuttall Oak Planted On Flood-Prone Agricultural Fields, Hans Michael Williams, Monica N. Craft

Container and 1-0 bare root Nuttall oak ( Quercus nuttallii, Palmer) seedlings were hand-planted, and acorns were direct- seeded, in a Sharkey soil (very fine, montmorillonitic, nonacid, thermic, Vertie Haplaquepts). The seedlings and seed were planted in January, February, March, and June, 1993. Flooding, to a depth of 2 meters, occurred on the study site from late March to late May. Seedlings planted in June were not flooded. Regardless of planting date, mean first-year survival for container seedlings was greater than 80 percent. Overall mean survival for bareroot seedlings was about 40 percent and direct-seeding survival was 30 percent. Bareroot …

Effects Of Stock Type And Fall Fertilization On Survival Of Longleaf Pine Seedlings Planted In Lignite Minespoil, Mary Anne Mcguire, Hans Michael Williams

One-year-old longleaf pine (Pinus palustris Mill.) seedlings were hand-planted in January 1996 on an east Texas minespoil site. Effects of two seedling stock types and four levels of preplanting fall fertilization on seedling survival were evaluated. Fertilizer treatments consisting of a single application of ammonium nitrate (73 kilograms per hectare N), phosphorus (81 kilograms per hectare P), diammonium phosphate (73 kilograms per hectare N, 81 kilograms per hectare P), or control (no fertilizer) were applied to bare-root and container seedlings in November 1995. ABSTRACT.--We evaluated selection of nest sites by male Red-cockaded Woodpeckers (Picoides borealis) in Texas relative to the age of the cavity when only cavities excavated by the woodpecker were available and when both naturally excavated cavities and artificial cavities we available. We also evaluated nest-cavity selection relative to he ability of naturally excavated cavity trees to produce resin, which is used by the woodpeckers to maintain a barrier against predation by rat snakes (Elaphe spp.), Longleaf pines (Pinus palustris) selected by breeding males as nest trees produced significantly greater resin yields at 2, 8, and 24 h post-wounding than cavity …

Fluctuating Silicate : Nitrate Ratios And Coastal Plankton Food Webs, N Qureshi, N N. Rabalais, Q Dortch, R. Eugene Turner, R F. Shaw, J Cope

Marine diatoms require dissolved silicate to form an external shell. and their growth becomes Si-limited when the atomic ratio of silicate to dissolved inorganic nitrogen (SI:DIN) approaches 1:1, also known as the Redfield ratio. Fundamental changes in the diatom-to-zooplankton-to-higher trophic level food web should occur when this ratio falls below 1:1. and the proportion of diatoms in the phytoplankton community is reduced. We quantitatively substantiate these predictions by using a variety of data from the Mississippi River continental shelf, a system in which the SI:DIN loading ratio has declined from around 3:1 to 1:1 during this century because of land-use …

The question of dispute resolution systems for international organizations is of growing importance. Not only has there been a plethora of new international and regional organizations created in the last decade, but this trend is likely to continue. There are numerous proposals for multilateral free trade areas and agreements across Latin America and the Caribbean as well as in Asia. At the same time, existing international trade organizations have come under increasing scrutiny for their inability to reflect accurately the needs and concerns of the citizens of the member countries.

The Great Transformation Of Regulated Industries Law, Joseph D. Kearney, Thomas W. Merrill

The nation's approach to regulating its transportation, telecommunications, and energy industries has undergone a great transformation in the last quarter-century. The original paradigm of regulation, which was established with the Interstate Commerce Act's regulation of railroads beginning in 1887, was characterized by legislative creation of an administrative agency charged with general regulatory oversight of particular industries. This approach did not depend on whether the regulated industry was naturally competitive or was a natural monopoly, and it was designed to advance accepted goals of reliability and, in particular, non-discrimination. The Illusion Of Autonomy At The End Of Life: Unconsented Life Support And The Wrongful Life Analogy, Philip G. Peters Jr.

Overwhelming evidence indicates that physicians routinely ignore patient preferences about life-sustaining care. Yet, the ability of wrongfully treated patients to recover compensatory damages has recently been placed in doubt. Both courts and commentators have suggested that actions for unconsented life support are analogous to actions for wrongful life and should, for that reason, be rejected. In this article, Professor Philip Peters argues that the obvious similarity between the two kinds of claims is overshadowed by many factors that distinguish the two settings. In Commonwealth v. Woodward, the highly publicized murder trial of an au pair accused of killing an infant in her care, the defense team faced a strategic decision commonly encountered at trial: whether to request or to object to lesser included jury instructions. Put simply, the Woodward defense team had to decide whether to ask for an instruction that would permit the jury to return a manslaughter verdict, or to object to such an instruction, leaving the jury only the choice either to acquit the defendant or to convict her of second degree murder as charged in the indictment. Bibliographic citation analysis of student research papers is one method of evaluation the use of a journal collection. Journal selection and cancellation may be done on the basis of use and cost-effectiveness to maximize the usefulness of materials purchased with the library budget. An analysis of the bibliographic citations of research papers by undergraduate and graduate students in the psychology department of St. Mary's University was used as one basis for psychology journal selection and deselection in the academic library. The regulation of nuclear power in the United States provides ample opportunity for conflicts over jurisdiction. The Maine Yankee case demonstrates the complications that arise as a result. The article concludes, however, that state involvement in the federal process can be both useful and collaborative.

Cell Size Dependence Of Transport Coefficients In Stochastic Particle Algorithms, Alejandro Garcia, F. Alexander, B. Alder

Using the Green–Kubo theory, the dependence of the viscosity and thermal conductivity on cell size is obtained explicitly for stochastic particle methods such as direct simulation Monte Carlo (DSMC) and its generalization, the consistent Boltzmann algorithm (CBA). These analytical results confirm empirical observations that significant errors occur when the cell dimensions are larger than a mean free path.

American Indian Law Meets The Internal Revenue Code: Warbus V. Commissioner, Erik M. Jensen

This article examines a 1998 Tax Court decision, Warbus v. Commissioner, that has implications for both American Indian law and federal tax law. Section 7873 of the Internal Revenue Code exempts from taxation amounts derived by American Indian tribal members from fishing-rights related activit[ies] of their tribes. Taxpayer Warbus claimed that discharge of indebtedness income from the foreclosure of his fishing boat qualified for the exclusion; the Tax Court said no. The author argues that Warbus was wrongly decided for two reasons: the court failed to take account of basic principles of American Indian law, and the court misapplied the …
